AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING ORDINANCE
NO. 95, THE CITY OF COPPELL ANIMAL CONTROL ORDINANCE, BY CHANGING
SECTION 7 OF SAID ORDINANCE, SO AS TO ESTABLISH POUNDAGE FEES TO BE
CHARGED FOR THE IMPOUNDMENT OF ANIMALS; PROVIDING FOR REDEMPTION
OF IMPOUNDED ANIMALS; PROVIDING FOR THE DISPOSITION OR DESTRUCTION
OF UNREDEEMED ANIMALS; PROVIDING A REPEALING CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS
ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS ($200.00)
FOR EACH OFFENSE, AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL,
TEXAS:
SECTION 1. AMENDING (SECTION 7) OF ORDINANCE NO. 95.
That Ordinance No. 95, the basic "City of Coppell Animal
Control Ordinance," is hereby amended so that Section 7 thereof
shall read as follows:
"SECTION 7. FEES, REDEMPTION AND DISPOSAL OF
IMPOUNDED ANIMALS.
The following shall be the fees charged as poundage
for the impoundment of animals under the provisions
of the ordinances of the City.
(1) For taking up and impounding, per head - $ ~.OD
(2) For taking care of animals, per head,
per day ........ $ D-O~
(3) For large animals requiring special treat-
ment, the actual cost as determined from
time to time.
The owner of any animal impounded under the provisions
of the ordinances or regulations of the City may redeem
the same by paying the poundage fees imposed against
said animal and meeting such vaccination requirement
as established in Section 8 of Ordinance No 95, or
such other vaccination requirement as may from time to
time be established as a prerequisite to redemption.
All impounded animals shall be redeemed within seventy-
two (72) hours after their capture and impoundment, or
they shall become subject to sale, destruction or other
disposition under the terms of this Ordinance.
The Animal Control Officer of the City of Coppell,
Texas, may authorize the sale, giving away or destruc-
tion of any animal impounded under the provisions of
this or any other ordinance of the City after it has
been impounded for a period of three (3) days. The
Chief of Police shall act as the "Animal Control
Officer" for the City in the absence of a specific
appointment of another person to that position."
SECTION 2. REPEALING CLAUSE.
Specifically, Section 7 of Ordinance No. 95, and all other
ordinances or parts of ordinances inconsistent or in conflict
with the provisions of this Ordinance are hereby repealed. Pro-
vided, however, all other parts of Ordinance No. 95 shall remain
in full force and effect.
SECTION 3. SEVERABILITY CLAUSE.
If any article, paragraph or subdivision, clause, phrase or
provision of this Ordinance shall be adjudged invalid or held
unconstitutional, the same shall not affect the validity of this
Ordinance as a whole or any part or provision thereof other than
the part so decided to be invalid or unconstitutional.
SECTION 4. PENALTY CLAUSE.
Any person, firm or corporation violating any of the provisions
of this Ordinance shall be deemed guilty of a misdemeanor and,
upon conviction, shall be fined not to exceed the sum of Two
Hundred Dollars ($200.00) for each offense and each and every day
such offense is continued shall constitute a new and separate
offense.
SECTION 5. EMERGENCY CLAUSE.
The fact that the present City regulations are inadequate
to properly protect the public health, safety and welfare, creates
an urgency and an emergency and requires that this Ordinance shall
take effect immediately from and after the publication of its
caption as the law in such cases provides.
