AN ORDINANCE OF THE CITY OF COPPELL, TEXAS,
CREATING THE DEPARTMENT OF AMIMAL CONTROL; CREATING THE POSITION
OF ANIMAL CONTROL OFFICER WHO SHALL OPERATE UNDER THE CHIEF OF
POLICE; MAKING IT UNLAWFUL FOR ANY PERSON KEEPING ANY ANIMAL OR
FOWL TO ALLOW SUCH TO RUN AT LARGE WITHIN THE CITY; AUTHORIZING
IMPOUNDMENT; PROVIDING FOR PLACES OF IMPOUNDMENT; ESTABLISHING
REDEMPTION FEES; PROVIDING FOR THE SALE OR DESTRUCTION OF ANIMALS
NOT REDEEMED WITHIN TEN (10) DAYS; REPEALING ORDINANCE NO. 70 ;
REPEALING ANY PART OF ANY OTHER ORDINANCE INCONSISTENT OR IN
CONFLICT WITH TIlE PROVISIONS OF THIS ORDINANCE, BUT, PROVIDING
THAT THIS ORDINANCE SHALL BE IN ADDITION TO AND DOES NOT REPEAL
OR MODIFY THE PROVISIONS OF "THE CITY OF COPPELL ANIMAL CONTROL
ORDINANCE"; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES
FOR THE VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO
HUNDRED ($200.00) DOLLARS FOR EACH OFFENSE AND DECLARING AN
EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COPPELL, TEXAS:
SECTION 1. ANIMALS AND FOWL RUNNING AT LARGE.
It shall be unlawful and a nuisance for any per-
son raising or keeping any animal or fowl to fail to prevent
any such animal or fowl from running at large within the city,
or to fail to prevent any such animal or fowl from going upon
the premises of another. The provisions of this ordinance
shall be in addition to and shall not in any way repeal or
modify the provisions of the "City of Coppell ~imal Control
Ordinance" which deals with dogs and other domesticated
carnivorous mammals.
SECTION 2. ANImaL CONTROL OFFICER
There is hereby created the Department of Animal
Control which shall be a department operating under the Chief
of Police.
There is hereby created the position of "Animal
Control Officer" which shall be filled by the City Council, as
in the case of other employees of the City. The City Council
shall select and establish a place for impounding animals which
shall be known as the "Animal Pound." The City Council may also
authorize contracts with private individuals for the use of
their premises for impoundment purposes.
The Animal Control Officer shall be in charge of
the City Animal Pound under the direct supervision of the Chief
of Police.
SECTION 3. OFFICERS AUTHORIZED TO IMPOUND.
The Chief of Police, any other Police Officer, any
other persons designated by the Chief of Police or the Animal
Control Officer or any person designated by the Animal Control
Officer shall have the authority to impound animals and fowl
found in violation of this or other ordinances of the city.
SECTION 4. CONFINEmeNT OF ANIMALS BY PROPERTY OWNER.
If any animal or fowl is found upon the premises of
anyone, the owner or occupant of such premises shall have the right
to confine such animal or fowl until he can notify the Animal
Control Officer or other persons authorized to impound animals
under the terms of this ordinance. When so notififed, it shall
be the duty of such officer to at once cause such animal or
fowl to be impounded.
SECTION 5. REDEMPTION PERIOD AND FEES.
The owner of any animal or fowl impounded under the
terms of this or any other ordinance of the City, shall have
ten (10) days, excluding Sundays, in which to redeem such
animal or fowl by paying a redemption fee of $5.00 plus a
charge of $1.00 per day of impoundment or any fractional part
of a day. In addition to the above charges any special or
unusual expense incurred by the City during such period of
impoundment shall be paid prior to redemption.
SECTION 6. SALE OF IMPOUNDED ANIMALS AND FOWL.
At any time after the expiration of the period for
redemption of impounded animals or fowl as established herein,
the Animal Control Officer or any other person designated by the
governing body , may wiNlout further notice and without advertising
in any manner, sell at private or public auction, for cash, any
animal or fowl not redeemed or reclaimed. The proceeds of such
sale shall be deposited into the general fund of the City.
SECTION 7. DESTRUCTION.
Any animal or fowl impounded and not redeemed, re-
claimed or sold after the period of time for redemption has ex-
pired may be destroyed in a humane manner. Any animal or fowl
may be destroyed without regard to the aforementioned time period
in humane cases.
SECTION 8. IMPOUNDMENT RECORDS.
The Animal Control Officer under the direction of
the Chief of Police shall keep a book giving description of all
animals or fowl impounded by him, the date of impounding, the
date of sale, the amount realized from such sale and the name
and address of the purchaser.
SECTION 9. REPEALING CLAUSE:
All parts of ordinances inconsistent or in conflict
with the provisions of this ordinance are hereby repealed.
However, Ordinance Nur~ber ~ is repealed in full.
This Ordinance shall in no way repeal the City of Coppell Animal
Control Ordinance, but, shall be inaddition thereto.
SECTION 10. SEVERABILITY CLAUSE:
If any article, paragraph or sub-division, clause,
phrase or provision of this Ordinance shall be adjudged in-
valid or held unconstitutional, the same shall not affect the
validity of this Ordinance as a ~vhole or any part or provision
thereof other than the part so decided to be invalid or uncon-
stitutio~ 1.
SECTION 11. PENALTY CLAUSE:
Any person, firm or corporation violating any of the
provisions of this Ordinance shall be deemed guilty of a mis-
demeanor and, upon conviction, shall be fined not to exceed the
sum of two hundred ($200.00) dollars for each offense and each
and every day such offense is continued shall constitute a new
and separate offense.
SECTION 12. EMERGENCY CLAUSE:
The fact that the present City regulations are in-
adequate to properly protect the public health, safety and
welfare, creates an urgency and an emergency and requires that
this Ordinance shall take effect immediately from and after
the publication of its caption as the law in such cases pro-
