ORDINANCE NO. 86
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS,
CREATING THE OFFICE OF BUILDING OFFICIAL TO SERVE AS THE
OFFICER IN CHARGE OF THE BUILDING DEPARTMENT OF THE CITY;
PROVIDING FOR APPOINTMENT AND TERM; PROHIBITING CONFLICT-
OF-INTEREST; PROVIDING FOR THE DESIGNATION OF AN ACTING
BUILDING OFFICIAL DURING TEMPORARY ABSENCE OF BUILDING
OFFICIAL; PROVIDING FOR POWERS AND DUTIES OF BUILDING
OFFICIAL: REPEALING ORDINANCE NO. 82, AND ALL OTHER
ORDINANCES IN CONFLICT WITH THIS ORDINANCE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING AN ENACTING CLAUSE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COPPELL, TEXAS:
SECTION 1. CREATION OF OFFICE OF BUILDING OFFICIAL
The Office of Building Official, as that office
is referred to in Section 201 of The City of Coppell Building
Code, is hereby created and the officer in charge shall be
known as the "Building Official."
SECTION 2. APPOINTMENT AND TERM
The Building Official shall be appointed by the
City Council and shall hold his office at the pleasure of the
City Council, and shall receive such compensation as the City
Council shall fix from time to time by ordinance or resolution.
SECTION 3. CONFLICT OF INTEREST
The Building Official shall not have any interest
whatever, directly or indirectly, in the sale or manufacture
of any material, process or device used in or in connection
with the construction, alteration, removal or demolition of
any structure within the City.
SECTION 4. ACTING OFFICIAL
During temporary absence or disability of the
Building Official, the City Administrator shall designate
an Acting Building Official who shall be approved by the
City Council at its next meeting.
SECTION 5. POWERS AND DUTIES
The Building Official shall devote such time
as necessary to properly carry out the duties of his office
and any other duties as the City Council or City Administra-
tor may direct.
The Building Official shall have such other powers
and duties as provided for by Ordinance and specifically those
set forth in the City of Coppell Building Code.
SECTION 6. ACCEPTANCE OF REPORTS FROM RECOGNIZED
INSPECTION SE~FICES
The Building Official may accept reports of inspectors
or recognized inspection services after investigation of their
qualifications and reliability. No certificate called for by any
provision of the City of Coppell Building Code shall be issued
on such reports unless the same are in writing and certified to
by a responsible officer of such service.
SECTION 7. RECORDS
Following specific procedure set forth in the Building
Code and other specific ordinances of the City, the Building
Official shall keep comprehensive records of applications of
permits issued, of inspections made, or reports rendered, and of
notices or orders issued. He shall retain on file copies of re-
quired plans and all documents relating to building work, so long
as any part of the building or structure to which they relate
may be in existence.
All such records shall be open to public inspection
for good and sufficient reasons during regular office hours,
but shall not be removed from the office of the Building Official
without his written consent.
SECTION 8. REPORTS
The Building Official shall make written reports to
the City Administrator once each month, or oftener, if requested,
including statements of permits and certificates issued and orders
promulgated.
SECTION 9. ASSISTANCE AND COOPERATION FROM
OTHER OFFICIALS
The Building Official may request and shall receive,
so far as may be necessary in the discharge of his duties, the
assistance and cooperation of other officials of the City.
SECTION 10. REPEALING CLAUSE
All ordinances or parts of ordinances inconsistent
or in conflict with the Drovisions of this ordinance are hereby
repealed. Ordinance No. 82 is specifically repealed.
SECTION 11. SEVERABILITY CLAUSE
If any article, paragraph or subdivision, clause,
phrase or provision of this ordinance shall be adjudged invalid
or held unconstitutional, the same shall not affect the validity
of this ordinance as a whole or any Dart or provision thereof
other than the part so decided to be invalid or unconstitutional.
SECTION 12. ENACTING CLAUSE
This ordinance shall take effect immediately from
and after its Dassage.
