OR 85 Creates the office of City Administrator & repeals Ordinance 81 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 85 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, CREATING THE OFFICE OF CITY ADMINISTRATOR; PROVIDING FOR THE APPOINTMENT OF A CITY ADMINISTRATOR; FIXING QUALIFICATIONS; PROVIDING FOR POWERS AND DUTIES OF THE CITY ADMINISTRATOR; REPEALING ORDINANCE NO. 81 AND ALL OTHER ORDINANCES IN CONFLICT WITH THIS ORDINANCE; PROVIDING A SEVERABILITY CLAUSE; AND PRO- VIDING AN ENACTING CLAUSE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. CREATING OFFICE OF CITY ADMINISTRATOR There is hereby created the office of City Admini- strator for the City of Coppell, Texas, which shall be filled by some suitable person who possesses the qualifications prescribed by the City Council. SECTION 2. APPOINT~ENT OF CITY ADMINISTRATOR The City Administrator shall be appointed by majority vote of the City Council for an indefinite term. He Shall be chosen by the Council solely on the basis of his executive and administrative qualifications with special reference to his actual experience in or his knowledge of accepted practice in respect to the duties of his office hereinafter set forth. At the time of his appointment, he need not be a resident of the City or State. No councilman shall receive such appointment during the term for which he shall have been elected nor within one year after the expiration of his term. SECTION 3. REMOVAL OF CITY ADMINISTRATOR The City Council may remove the City Administrator at any time by a majority vote of its members. If requested, the Council shall grant him a public hearing within 30 days following notice of removal. may suspend the administrator salary. During the interium, the Council from duty, but shall continue his SECTION 4. POWERS AND DUTIES OF CITY ADMINISTRATOR The City Administrator shall be the chief administra- tive officer of the City. He may head one or more departments and shall be responsible to the City Council for the proper administration of all affairs of the City. To that end, he shall have power and shall be required to: A. Make recommendations to the City Council concerning the employment, suspension or termination of salaried employees of the City. B. Prepare and submit to the Mayor a recommended annual budget in sufficient time each year to aid the Mayor as Budget Officer of the City in the submission of his annual budget to the City Council. C. Prepare and submit to the Council as of the end of the fiscal year a complete report on the finances and admini- strative activities of the City for the preceding year. D. KeeD the Council advised of the financial condition and future needs of the City, and make such recommendations as he may deem desirable. E. Recommend to the governing body a standard schedule of pay for each appointive office and position in the City service, including minimum, intermediate and maximum rates. F. Recommend to the governing body (from time to time) adoption of such measures as he may deem necessary or expedient for the health, safety or welfare of the community or for the improvement of administrative services. G. Consolidate or combine offices, positions, depart- ments or units under his jurisdiction, with the approval of the City Council. The City Administrator may be the head of one or more departments. H. Attend all meeting of the City Council, unless excused therefrom, and take part in the discussion of all matters coming before the Council. He shall be entitled to notice of all regular and special meetings of the Council. I. As directed by the City Council, he shall, supervise the purchase of all materials, supplies and equipment for which funds are provided in the budget; he may purchase without prior Council approval materials and supplies as are necessary for day to day administration of the City Hall in amounts up to and including $fO~ He shall advise the Council on the advantages or disadvantages of all contracts and bid proposals. The Administrator may issue such rules governing purchasing procedures within the administrative organization as the Council shall approve. J. With the cooperation of the City Attorney, see that all laws and ordinances are duly kept. K. Investigate the department or division thereof. relation to matters concerning affairs of the City or any Investigate all complaints in the administration of the govern- ment of the City, and in regard to service maintained by the public utilities in the City, see that all franchises, permits and privileges granted by the City are faithfully observed. L. Coordinate the activities of salaried employees and may issue orders to salaried employees without prior consultation with the City Council or Mayor. M. Devote his entire time to the discharge of his official duties. N. Perform such other legal and lawful duties as may be required by the Council. SECTION 5. EMERGENCIES In case of accident, disaster or other circumstance creating a public emergency, the City Administrator may award contracts and make purchases for the purpose of meeting said emergency; but he shall file promptly with the Council a certificate showing such emergency and the necessity for such action, together with an itemized account of all expenditures. SECTION 6. BOND The City Administrator shall furnish a surety bond to be aDproved by the Council, said bond to be conditioned on the faithful performance of his duties. The premium of the bond shall be Daid by the City. SECTION 7. COMPENSATION The City Administrator shall receive such compensa- tion as the Council shall fix from time to time by ordinance or resolution. SECTION 8. VACANCY Any vacancy in the office of City Administrator shall be filled as soon as practicable after the effective date of such vacancy. SECTION 9. REPEALING CLAUSE All ordinances or parts of ordinances inconsistent or in conflict with the provisions of this ordinance are here- by repealed and Ordinance Number 81 is specifically repealed. SECTION 10. SEVERABILITY CLAUSE If any article, paragraph or subdivision, clause, phrase or provision of this Ordinance shall be adjudged in- valid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or provision thereof other than the part so decided to be invalid or uncon- stitutional. and SECTION 11. ENACTING CLAUSE This ordinance shall take effect immediately from after its passage.
