OR 83 Amends any & all previous City ordinances regulating, affecting or zoning propertyI CITY OF COPPELL ORDINANCE ORDINANCE NO. �j AN ORDINANCE AMENDING ANY AND ALL PREVIOUS CITY ORDIN- ANCES REGULATING, AFFECTING OR OTHERWISE ZONING PROPERTY LOCATED WITHIN THE CITY LIMITS OF COPPELL, TEXAS, AND SPECIFICALLY AMENDING, TO THE EXTENT NECESSARY BUT OTHERWISE IN CONFORMANCE WITH ORDINANCE NO. 49 OF THE CITY OF COPPELL, TEXAS, PASSED AND APPROVED JANUARY 23, 1969; SETTING A PENALTY AND DECLARING AN EMERGENCY. WHEREAS, the City of Coppell adopted an official zoning ordinance on the 23rd day of January, 1969, known as Ordinance No. 49 of the City of Coppell, Texas; and WHEREAS, such Ordinance establishes zoning regulations and districts with a comprehensive plan and regulating the use of land, buildings and structures within the City of Coppell and providing a method for amending such Ordinance; and WHEREAS, such Zoning Ordinance provides that any person or corporation having a proprietary interest in any property covered may petition the City Council for a change or amendment to the provisions of the Ordinance; and WHEREAS, the City Council may, from time to time, amend, supplement or change by ordinance the boundaries of districts or the regulations therein established, in conformity with Section 20 of the Zoning Ordinance heretofore referred to; and WHEREAS, a public hearing sna11 oe neld before adopting any proposed amendment; and WHEREAS, heretofore a person or corporation having such a proprietary interest has complied with the prerequisites and requirements of Section 20 of the Zoning Ordinance of the City of Coppell, and the City Council has, after proper notice and M hearing, determined that an amendment should be made to such Zoning Ordinance, changing or amending the use of land within the area affected by such petition; and WHEREAS, all prerequisites necessary for the amendment to such Ordinance nave been met and the amendment has been approved by the necessary governmental action and vote by the City Council; and WHEREAS, it is in the public interest and welfare to amend such Zoning Ordinance, as hereinafter described; and WHEREAS, there exists an emergency requiring that this Ordinance become effective immediately upon its passage in order to safeguard the general public welfare, health, peace and safety; NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF COPPELL, TEXAS: Section 1. That attached hereto and incorporated herein for all purposes is a map of a part and portion of the City of Coppell, Texas, such map containing a zoning legend. That such map and plat, as attached, identifies the property located within the City of Coppell, covered by this Ordinance. Section 2. That attached hereto is a tract -by -tract legal description of tracts of land contained within the prop- erty covered by this Zoning Ordinance, identifying the zoning hereby granted to each such tract of land, within the boundaries of the City of Coppell, Texas. Section 3. That hereafter the tracts of land described in the attached documents shall be zoned as described in such documents, and the land shall be used only as now used or in conformance with such documents and not otherwise. Section 4. That the official certified map upon which boundaries of various zoning districts and areas are :drawn shall be modified so as to reflect changes made by this Ordinance. -2- 11 Section 5. That the definitions used in City of Coppell Ordinance No. 49 are incorporated into this Ordinance, and all restrictions upon use within a zoning category or dis- trict shall continue to exist and apply as if herein copied, and they are hereby adopted. Section 6. It shall be unlawful for any person to use or develop property within the area covered by this Ordinance without complying herewith, and any such violation or threatened violation may be enjoined by the City of Coppell, by bringing suit in any court having jurisdiction thereof; and additionally, any person violating any of the provisions of this Ordinance shall, upon a conviction, be fined any sum not exceeding $200.00; and each and every day that the provisions of this Ordinance are violated shall constitute a separate and distinct offense. Section 7. The fact that zoning regulations have not been provided so as to meet current requirements of the City of Coppell and the persons and property therein creates an emergency requiring protection,and the general public welfare, health, peace and safety require that this Ordinance become effective immediately upon its passage, and it is accordingly so ordained.
