OR 77 Establishes speed zones & school zones on certain streets AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 77 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ESTABLISHING SPEED ZONES ON CERTAIN STREETS; ESTABLISHING SCHOOL ZONES; MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE ANY MOTOR OR OTHER VEHICLE ON SAID STREETS AT A GREATER SPEED THAN THE SPEED DESIGNATED; REPEALING SPECIFICALLY SECTION 53a OF ORDINANCE NO. 8; REPEALING ALL ORDINANCES IN CONFLICT WITH THIS ORDINANCE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED ($200.00) DOLLARS FOR EACH OFFENSE AND DECLAR- ING AN EMERGENCY. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That no person shall operate or drive any motor or other vehicle on the following designated streets at a greater speed than the speed designated for that street or portion Of that street as set forth below in this section, and any speed in excess of the limit set forth in this section shall be prima facie evidence that such speed is neither reasonable prudent and is unlawful: STREET Bethel School Rd. SCHOOL ZONES No person shall operate a motor or any other vehicle in any school t~affic zone at a greater speed than twenty miles per hour and any speed in excess of twenty miles per hour shall be prima facie evidence that the speed is not reasonable or pru- dent and it is unlRwful. The Director of Traffic Control shall designate school traffic zones with appropriate street markings and signs. The speed limit designated for school traffic zones shall be effective only at such times as appropriate signs advis- ing motorists to ~his effect are placed in conspicous places. SECTION 3. REPEALING CALUSE: All ordinances or parts of ordinances inconsistent or in conflict with the provisions of this ordinance are here- by repealed. Section 53a of Ordinance Number 8 is specifically repealed. However, the repeal of existing ordinances by this ordinance shall non effect or prevent the prosecution or the punish~nent of any person for any act done or comnitted prior to the effective date of this ordinance in violation of any ordinan=e hereby repealed; and prosecution for such offenses may be instituted and causes presently pending proceeded with in all respects as if such prior ordinance or ordinances had not been repealed. SECTION 4. SEVERABILITY CLAUSE: If any article, paragraph or sub-division, clause, phrase or provision of this Ordinance shall be adjudged in- valid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or airy part or provision thereof other than the part so decided to '~ invalid or uncon- stitutional. SECTION 5. PENALTY CLAUSE: Any person, firm or corporation violating any of the provisions of this Ordinance shall be deemed guilty of a mis- demeanor and, upon conviction, shall be fined not to exceed the sum of two hundred ($200.00) dollars for each offense and each and every day such offense is continued shall constitute a new and separate offense. SECTION 6. EMERGENCY CLAUSE: The fact that the present City regulations are in- adequate to properly protect the public health~ safety and welfare~ creates an urgency and an emergency and requires that this Ordinance shall take effect immediately from and after the publication of its caption as the law in such cases pro- vides0 DULY PASSED by the Coppell, Texas, this ~ City Council of the City of MAYOR ATTEST: CITY SECTETARY APPROVED AS TO FORM: ~TY ATTORN~'
