AN ORDINANCE OF THE CITY OF COPPELL, TEXAS,
MAKING IT UNLAWFUL AND A NUISANCE TO LEAVE, PARK OR STAND, FOR
A PERIOD LONGER THAN THIRTY (30) DAYS, IN ANY FRONT, SIDE OR
REAR YARD OF ANY LOT OR TRACT OF LAND IN THE CITY, A MOTOR
VEHICLE WHICH IS IN A CONDITION SUCH AS TO MAKE IT INCAPABLE
OF BEING DRIVEN OR OPERATED; PROVIDING CERTAIN CONDITIONS
UNDER WHICH SUCH VEHICLE SHALL BE PRESUMED TO BE INCAPABLE
OF BEING DRIVEN OR OPERATED; MAKING IT UNLAWFUL TO PERMIT WEEDS,
GRASS OR BRUSH TO GROW TO A HEIGHT GREATER THAN TWELVE (12)
INCHES AROUND ANY VEHICLE PARKED OR LEFT STANDING FOR A PERIOD
LONGER THAN THIRTY (30) DAYS ON ANY TRACT OF LAND WITHIN THE
CITY; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR
VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO
HUNDRED ($200.00) DOLLARS FOR EACH OFFENSE AND DECLARING
AN EMERGENCY.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
COPPELL, TEXAS:
SECTION 1. It shall be unlawful and a nuisance for any
person, firm or corporation, to leave, park or stand for a period
longer than thirty days in any front, side or rear yard of any lot
or on any tract of land within the City, any motor vehicle which
is in a condition such as to make it incapable of being driven or
operated, except where permitted or authorized under the provisions
of the Comprehensive Zoning Ordinance or except where such vehicle
is screened from the public view by a solid wall or fence.
SECTION 2. The existence of any one of the following
conditions shall raise the presumption of and shall be prima
facie evidence that such a motor vehicle is in a condition such
as to make it incapable of being driven or operated:
Any such vehicle which has stood at such location
for a period longer than thirty days with a de-
flated tire or tires or a missing wheel or wheels
or any other visibly missing part to said vehicle
which would be necessary in order for said vehicle
to be driven.
Any such vehicle which has remained on blocks or
other items supporting it above the ground for a
period longer than thirty days.
c. Any such vehicle which cannot be driven by reason
of physical damage to said vehicle.
d. Any such vehicle which does not have attached to
it a registration license plate.
Any such vehicle which has attached to it a regis-
tration license plate older than one year next pre-
ceding the year in which the violation is alleged.
(For example, should the violation be alleged in
the year 1971, any vehicle with a registration
license plate dated 1969 or for some year prior to
1969, would be presumed to be in a condition such
as to be incapable of being driven or operated.)
SECTION 3. It shall be unlawful for any person, firm
or corporation to permit weeds, grass or brush to grow to a
height greater than twelve inches around any vehicle parked or
left standing for a period longer than thirty days on any tract
of land within the City.
SECTION 4. SEVERABILITY CLAUSE:
If any article, paragraph or sub-division, clause,
phrase or provision of this Ordinance shall be adjudged in-
valid or held unconstitutional, the same shall not affect the
validity of this Ordinance as a whole or any part or provision
thereof other than the part so decided to be invalid or uncon-
stitutional.
SECTION 5. PENALTY CLAUSE:
Any person, firm or corporation violating any of the
provisions of this Ordinance shall be ~deemed guilty of a mis-
demeanor and, upon conviction, shall be fined not to exceed the
sum of two hundred ($200.00) dollars for each offense and each
and every day such offense is continued shall constitute a new
and separate offense.
SECTION 6. EMERGENCY CLAUSE:
The fact that the present City regulations are in-
adequate to properly protect the public health, safety and
welfare, creates an urgency and an emergency and requires that
this Ordinance shall take effect immediately from and after
the publication of its caption as the law in such cases pro-
vides.
