AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, CREATING
THE DALLAS FTo WORTH REGIONAL JOINT AIRPORT ZONING BOARD FOR
THE PURPOSE OF PREVENTING THE CREATION OR ESTABLISHMENT OF
AIRPORT HAZARDS SURROUNDING THE DALLAS FT. WORTH REGIONAl, AIR-
PORT; DELINEATING THE MEMBERSHIP OF SAID BOARD; APPOINTING TWO
REPRESENTATIVES TO THE DALLAS FT. WORTH REGIONAL JOINT AIRPORT
ZONING BOARD FROM THE CITY OF COPPELL, TEXAS, AND DECLARING AN
EMERGENCY.
WHEREAS, the creation or establishment of an airport
hazard, as defined in Vernon's Annotated Texas Statutes,
Article 46e-1(2), would endanger the lives and property of
users of the Dallas Ft° Worth Regional Airport and of occupants
of land in its vicinity, and also would tend to destroy or im-
pair the utility of the Airport and the public investment there-
in; and
WHEREAS, the Federal Aviation Administration has
established certain minimum standards concerning the creation
or establishment of airport hazards, and such standards are
applicable to the Dallas Ft. Worth Regional Airport pursuant
to Title 14, Chapter 1, Subchapter E, Part 77, Code of Federal
Regulations; and
WHEREAS, Texas State Law--Vernon's Annotated Texas
Statutes, Article 46-e-1 through Article 46e-15, as amended--
grants authority to political subdivisions within an airport
hazard area to cooperate with each other in regulating the
creation and establishment of airport hazards, and outlines
the procedures to be followed by them in accomplishing such
regulation; and
IN CONSIDERATION of other political subdivions within
the airport hazard area of the Dallas Ft. Worth Regional Airport
enacting similar legislation;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF COPPELL, TEXAS:
SECTION 1. There is hereby created a Joint Airport
Zoning Board to be known as the Dallas Ft. Worth Regional
Joint Airport Zoning Board, which shall have the powers and
exercise.the duties set forth in Vernon's Annotated Texas
Statutes, Article 46e-1 through Article 46e-15, inclusive, as
amended, or as may be amended in the future, commonly known as
the "Airport Zoning Act"; provided, however, that all regulations
adopted by the joint airport zoning board shall be administered
by the governing body of the political subdivision adopting the
regulations unless said governing body shall specifically provide
otherwise.
SECTION 2. The Dallas Ft. Worth Regional Joint Airport
Zoning Board shall be composed of two members to be appointed by
each of the following political subdivisions within the airport
hazard area of the Dallas Ft. Worth Regional Airport participat-
ing in its creation: Dallas, Denton and Tarrant Counties; Arling-
ton, Bedford, Colleyville, Coppell, Dallas, Euless, Flower Mound,
Ft. Worth, Grand Prairie, Grapevine, Irving, Lewisville, Southlake,
and Westlake; and in addition a Chairman elected by a majority of
the members so appointed above.
Members shall be appointed for a term of two (2) years and may
be removed by the authority which appointed them. 'Vacancies
shall be filled for the uncxpired term of any member whose term
becomes vacant.
SECTION 3. and
are hereby appointed as members on the
Dallas Ft. Worth Regional joint Airport Zoning Board from the City
of Coppell, Texas.
SECTION 4. If any Article, Paragraph or Subdivision,
Clause, Phrase, or Provision of this Ordinance shall be adjudged
invalid or held unconstitutional, the same shall not affect the
validity of this Ordinance as a whole or any part or pA'ovision
thereof under than the part so decided to be invalid or un-
constitutional.
SECTION 5. The fact that the present City regulations
are inadequate to properly protect the public health, safety and
welfare in regard to Airport hazards has hereinabove defined,
creates an urgency and an emergency and requires that this Ordi-
nance shall take effect immediately as the law in such cases
provides.
