OR 63 Adopts the Fire Prevention Code of the American Insurance Association, 1965 Edition
ORDINANCE NO. 63 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ADOPTING THE FIRE PREVENTION CODE OF THE AMERICAN IN- SURANCE ASSOCIATION, 1965 EDITION; MAKING CERTAIN AMENDMENTS THERETO; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE; REPEALING ALL ORDINANCES OR PARTS THEREOF IN CONFLICT WITH THIS ORDINANCE AND DECLARING EMERGENCY. BE IT ORDAINED BY TtIE CITY CONqCIL OF THE CITY OF COPPILL, TEXAS: SECTION 1. TITLE: This ordinance shall be known as "The City of Coppell Fire Prevention Code". SECTION 2. ADOPTION OF CODE: There is hereby adopted by the City of Coppell, Texas that certain Fire Prevention Code of the ~erican Insurance Association, 1965 Edition, a copy of which is attached hereto as Exhibit "A". Provided however, said adoption is subject to such portions thereof as are here- inafter deleted, modified or amended. SECTION 3. SPECIFIC A~ZNDMENTS & MODIFICATIONS: The Code adopted hereby and attached hereto as Eiibit "A" is amended as follows: The 1966 Revision of said code which is attached hereto as Exhibit "B" is hereby adopted revising Division VI. SECTION 4. REPEALING CLAUSE: All ordinances or parts of ordinances incon- sistent or in conflict with the provisions of this ordinance are hereby repealed. Provided however, the repeal of existing laws by this ordinance shall not effect or prevent the prosecution or punishment of any person for or any act done or committed in violation of any ordinance hereby repealed prior to the effective date of .this ordinance; and prosecution for such offense may be instituted and causes presently pending proceeded with in all respects as if such prior law or ordinance had not been repealed. SECTION 5. SEVERABILITY CLAUSE: If any article, paragraph or sub-division, clause, phrase or provision of this Ordinance shall be adjudged invalid or held unconstitutional, the same shall not affect the validity of this Ordinance as a whole or any part or proviision thereof other than the part so decided to be in- valid or unconstitutional. SECTION 6. PENALTY CLAUSE: Any person, firm or corporation violating any of ~ the provisions of this Ordinance shall be deemed guilty of a misdemeanor and, upon conviction, shall be fined not to exceed the sum of $200.00 for each offense and each s.nd every day such offense is continued shall constitute a separate offense. Should anv secnion of the Code adopted by this ordinance be in conflict with this p2nalty clause then this section shall be controlling. SECTION 7. SPECIAL IIANI)LiNG OF ORDINANCE: Due to the size of the Volume attached hereto as Exhibit "A" it is hereby directed that the original of this ordinance, with volume attached, be kept in a separate file in the office of the City Secretary, and that a duplicate original of this ordinance, with a copy of the title sheet of such volume attached thereto, be placed in the official Ordinance Book. SECTION 8. E~RGENCY CLAUSE: The fact that the present City regulations are inadequate to properly protect the public health, safety and welfare, creates an urgency and an emergency and re- quires that this Ordinance shall take effect inmediately from and after the publication of its caption as the law in such cases provides.
