AN ORDINANCE OF THE CITY OF COPPELL, TEXAS,
ADOPTING THE UNIFORM BUILDING CODE OF THE INTERNATIONAL
CONFERENCE OF BUILDING OFFICIALS, 1970 EDITION, VOLUME I,
PROVIDING FOR THE REGULATION OF ERECTION, CONSTRUCTION,
ENLARGEMENT, ALTERATION, REPAIR, MOVING, REMOVAL, CONVER-
SION, DEMOLITION, OCCUPANCY, EQUIPMENT AND MAINTENANCE OF
BUILDINGS OR STRUCTURES IN THE CITY OF COPPELL, TEXAS;
PROVIDING FOR THE ISSUANCE OF PERMITS AND COLLECTION OF
FEES THEREFOR; DECLARING AND ESTABLISHING FIRE DISTRICTS;
PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE;
REPEALING ALL ORDINANCES OR PARTS THEREOF IN CONFLICT
WITH THIS ORDINANCE, EXCEPT THE COMPREHENSIVE ZONING ORD-
INANCE OF THE CITY AND DECLARING AN EMERGENCY.
BE IT ORDAINED BY THE CITY CO~CIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. TITLE:
This ordinance shall be known as "The City of
Coppell Building Code".
SECTION 2. ADOPTION OF UNIFOP~ BUILDING CODE:
There is hereby adopted by the City of Coppell,
Texas, for the purpose of providing requirments for safe-
guarding persons and property and promoting the welfare
of the public, that certain b~IFORM BUILDING CODE OF THE
INTERNATIONAL CONFERENCE OF BUILDING OFFICIALS, 1970
EDITION, VOLUME I, save and except such portions as are
hereinafter deleted, modified, or amended, a copy of which
is attached hereto as Exhibit "A" and made a part hereof
the same as if fully set out at length herein, and from
the date on which this ordinance shall take effect the
provisions thereof shall be controling within the corporate
limits of the City.
SECTION 3. SPECIFIC AMENDMENTS TO SAID UNIFORM
CODE.
The Uniform Building Code adopted hereby and
attached hereto as Exhibit "A" is amended as follows:
(a) By ommitting therefrom Section 6003.
(b) By ommitting therefrom Section 6004.
SECTION 4. REPEALING CLAUSE:
All ordinances or parts of ordinances inconsistent
or in conflict with the provisions of this ordinance, except
the compregensive Zoning Ordinance of the City, are hereby
repealed. In case of conflict between said Zoning Ordinance
and this ordinance the said zoning ordinance shall be con-
troling. Provided, however, the repeal of existing laws by
this ordinance shall not effect or prevent the prosecution
or punishment of any person for or any act done or committed
in violation of any ordinance hereby repealed prior to
the taking effect of this ordinance; and prosecution
for such offense may be instituted and causes presently
pending proceeded with in all respects as if such prior
law or ordinance had not been repealed.
Section 4. SEVERABILITY CLAUSE:
If any article, paragraph or sub-division, clause,
phrase or provision of this Ordinance shall be adjudged in-
valid or held unconstitutional~ the same shall not affect
the validity of this Ordinance as a whole or any part or
proviision thereof other than the part so decided to be in-
valid or unconstitutional.
Section 5. PENALTY CLAUSE:
Any person, firm or corporation violating any of
the provisions of this Ordinance shall be deemed guilty of
a misdemeanor and, upon conviction, shall be fined not to
exceed the sum of $200.00 for each offense and should any
section of said Uniform Building Code adopted by this Ordi-
nance be in conflict with the penalty clause of this section
then this section shall be controlling.
Section 6. SPECIAL HANDLING OF ORDINANCE:
Due to the size of the Volume attached hereto as
Exhibit "A" it is hereby directed that the original of this
Ordinance, with Volume attached, be kept in a separate file
in the officeof the City Secretary, and that a duplicate
original of the Ordinance, with photocopy of the cover sheet
of such Volume, be placed in the official Ordinance Book.
Section 7. EMZRGENCY CLAUSE:
The fact that the present regulations with re-
ference to Building requirements are inadequate, creates
an urgency and an emergency for the immediate preservation
of the public peace, health, comfort, safety and general
welfare, and requires that this Ordinance shall take effect
in~aediately from and after the publication of its caption
as provided by law, and it is accordingly so ordained.
