RE 2002-12-10.4RESOLUTION NO. 2002-1210.4 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, SUPPORTING THE SUBMISSION OF AN AMICUS BRIEF IN SUPPORT OF CITIES TO DETERMINE LOCALLY THE DECISIONS REGARDING FILTERING OF PORNOGRAPHIC, OBSCENE AND MATERIAL HARMFUL TO MINORS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the Supreme Court will decide the case of the United States v. American Library Association, which held that cities may not decide to use filters to stop pornographic, obscene and material harmful to minors in their Internet access; and, WHEREAS, cities and local municipalities should have the right to make the decision of whether to filter in local municipal libraries; and, WHEREAS, child pornography, obscenity and other material harmful to minors not only harms children, but families and our communities as well; and, WHEREAS, cities across the county, if not permitted to determine locally to provide such harmful material, will choose to limit liability and to stop providing Internet access which has a detrimental and chilling effect on the dissemination of information; and WHEREAS, if the Court of Appeals decision is affirmed, it will usurp the right of cities to decide whether they will filter such materials in said case in its libraries; NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the City of Coppell will request to add its name to the list of mayors and cities in support of the Amicus Brief which confirms the rights of local municipalities to make decisions regarding filtering of harmful internet content within municipal libraries. SECTION 2. This Resolution shall become effective immediately from and after its passage, as the law and charter in such cases provide. 51405 DULY PASSED and approved by the City Council of the City of Coppell, Texas, on this the 10th day of December, 2002.
