OR 55 Establishes "Pro Rate" for owners of land or lot whose sewer line connects with CHS Sewer line No.1 ORDINANCE NO. 55
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ESTABLISH-
ING A CHARGE TO BE KNOWN AS A "PRO RATA" CHARGE WHICH SHALL
BE MADE AGAINST EACH LOT OR TRACT OF LARD AND THE OWNER THERE-
OF WHOSE SEWER LINE SHALL BE CONNECTED WITH "COPPELL HIGH SCHOOL
SEWER LINE SECTION NUMBER ONE"; SETTING THE RATE OF SAID CHARGE
AT $1.00 PER FRONT FOOT OF LOT OR TRACT OF LAND TO BE SERVED;
PROVIDING FOR THE ESTABLISHMENT OF A BANK ACCOUNT AND PROCEDURE
FOR COLLECTING AND DEPOSITING THE RECEIPTS FROM SAID "PRO RATA"
CHARGE; PROVIDING FOR REIMBURSEMENT TO THE COPPELL INDEPENDENT
SCHOOL DISTRICT OUT OF SAID PRO RATA CHARGES COLLECTED; PRO-
VIDING FOR THE EFFECTIVE DATE OF THIS ORDINANCE; AND PROVIDING
A SEVERABILITY CLAUSE.
WHEREAS, a sewer line has been constructed and installed
in that certain easement situated in the City of Coppell, Dallas
County, Texas, in the Jas. A. Simmons Survey Abstract No. 1296
which said easement lies 10 feet on each side of a line from a
point near the new High School, northerly across the Loyse E.
Caldwell tract of land; said centerline being more particulary
described as follows:
BEGINNING at a point 2209.0 feet S 89°12, west of the
east survey line of the jas. A. Simmons Survey, Abstract No.
1296, and in the south line of the said Jas. A. Simmons Sur-
vey, Abst. 1296, said point also being the north line of a
county road;
THENCE: N-O0° -06' E a distance of 894.0 feet to an
angle point to the left;
THENCE: N-05° -05' W a distance of 427.5 feet to an
angle point to the right;
THENCE: N-O0° -50' W a distance of 1049.9 feet to an
angle point to the right;
THENCE: N-IO° -25" E a distance of 87.1 feet to an
angle point to the left;
THENCE: N-00° -50' W a distance of 275.5 feet to an
angle point to the right;
THENCE: N-19° -15' E a distance of 287.4 feet to a
point in the south right-of-way line of Coppell Road.
The said sewer line to be known as the 'Coppe11 High
School Sewer Line Section Number One", and
WHEREAS, the cost of the construction and installation
of said sewer line has been paid for by the Coppell Independent
School District, and
WHEREAS, the City of Coppell was unable to financially pro-
vide for the cost of the construction and installation of said
sewer line, and
WHEREAS, due to the circumstances, the City of Coppell is
of the opinion that a pro rata charge should be levied against
the property owners who may connect to said sewer line.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF COPPELL, TEXAS:
SECTION 1: Hereafter, the Tax Assessor and Collector of
the City of Coppell, Texas, shall charge and collect from each
person, firm or corporation desiring to connect with the sewer
line above described, a charge which shall be known as a "Pro
Rata Charge" which shall be made against each lot or tract of
land and the owner thereof whose sewer line shall hereafter
connect with the above described Coppell High School Line Section
Number One. Said charge shall be at the rate of $1.00 per front
foot of lot or tract of land to be served and no connection will
be permitted by the City of Coppell until such time as the Pro
Rata charge has been paid by the said owner of the lot or tract
of land to which such connection is being made. The City Treasurer
shall open an account with the Lewisville State Bank of Lewisville,
Texas, on which checks may be drawn only by the co-signature of
the Treasurer of the City of Coppell, Texas, and the Mayor of the
City of Coppell, Texas. Said account to be designated as the
"School Sewer Line Section One Account". The Tax Assessor and
Collector shall deposit in said account all said Pro Rata funds
collected in regard to the connections made to said sewer line.
The Tax Assessor and Collector shall keep accurate records of all
taps and connections made to said sewer line and of the fees collected
for the same.
SECTION 2: Every third month after said account is opened,
the City of Coppell shall pay to the Coppell Independent School
District the accumulated funds in said account, and shall continue
to do so until the City shall have paid to the Coppell Independent

School District as reimbursement, the sum of $ Pro-
vided, however, that the City may leave on deposit in said account
the sum of $ / O ~. ~ ~ so as not to close out said account with
each withdrawal.
SECTION 3: Each person, firm or corporation desiring to
connect with said Coppell High School Sewer Line Section Number
One shall make application for the same to the City Council of
the City of Coppell or to such official or employee as they may
from time to time designate to accept such application, on forms
to be provided by the City. Approval of the said application
shall not be made and no person, firm or corporation shall connect
with said Coppell High School Sewer Line Section Number One until
the above mentioned Pro Rata charge has been paid to the City or
an arrangement has been made with the City to pay said charge un-
der terms satisfactory to the City.
SECTION 4: No person shall acquire any vested interest
or right under the terms and provisions of this Ordinance, and
the terms and provisions of this Ordinance shall be deemed to
be severable in that if any section, phrase word or part there-
of shall be deemed to be invalid or unconstitutional, the same
shall not affect the validity of the remaining portions of this
Ordinance.
SECTION 5: This Ordinance shall take effect immediately
from and after its passage.
