OR 32 Authorizes disannexation of land located south of Denton Creek, east of Allen Rd & North of Sandy Lake Rd ORDINANCE NO. 32
WHEREAS, on February 1, 1966, the City Council of the
City of Coppell, Texas, passed Ordinance No. 28, which dis-
annexed from the City a certain parcel of land in northwest
Dallas County, Texas, lying south of Denton Creek, east of
Allen Road and north of Old U.S. Highway 77, (also known as
Sandy Lake Road), and
WHEREAS, the fourth call of the legal description in
said Ordinance reads as follows:
"THENCE Northwest and west along the northeast
and north right-of-way line of Old U.S. Highway
#77 to a point in the west line of the E.eook
Survey, Abst. 300; "and
WHEREAS, the fifth call of said description reads as
follows:
"THENCE North along the west line of the E.Cook
Survey, Abst. 300 and the west line of the
Mounts Survey, Abst. #903 to the place of
eS~inning", and
WHEREAS, it has come to the attention of the City Council
that the various Maps of this area are confusing as to whether
or not the west line of the E.Cook Survey and the west line of
the J. H. Mounts Survey, run down the centerline of Allen Road
or run slightly east of Allen Road, and
WHEREAS, the City Council of the City of Coppell,
Texas, wishes to express by this Ordinance its intention in re-
gard to said area disannexed by said Ordinance No. 28,
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF
THE CITY OF COPPELL, TEXAS:
Section 1. That in passing Ordinance No. 28, dis-
annexing from the City a certain parcel of land in northwest
Dallas County, Texas, lying south of Denton Creek, east of Allen
Road and north of Old U.S. Highway #77, also known as Sandy Lake
Road, it was the intention of the City Council to make the west
line of the parcel so detached run along the centerline of Allen
Road which was the then existing corporate limits of the City.
That because of the confusing appearance of the Map used in the
preparation of the description set forth in Ordinance No. 28, it
was thought by the City Council that the west line of the E. Cook
Survey No. 300 ran down the centerline of Allen Road. The City
Council still being uncertain as to the correct location of said
west line of said surveys, but noting from the Plat attached
hereto as Exhibit "A" the possibility that said west lines of
said surveys run slightly east of Allen Road, the City Council
feels that it is necessary to hereby express its intention in
regard to said matter.
Section 2. It was the intention of the City Council
to have said fourth call run to a point in the center of Allen
Road and THENCE north ~long the centerline of Allen Road, said
line being the then existing corporate limit line of the City,
to the place of beginning, as shown on the Plat attached hereto
as Exhibit "B".
Section 3. The fact that there is a necessity for the
City Council of the City of Coppell to express its intention in
regard to the area disannexed by Ordinance No. 28, creates an
urgency and an emergency which in the interest of the public
welfare, requires that this ordinance shall take effect imme-
diately from and after its passage, and it is accordingly so
ordained.
