OR 31 Defines house trailer, house trailer park, person & unit plot ORDINANCE NO. 31 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, DEFINING HOUSE TRAILER, HOUSE TRAILER PARK, PERSON AND UNIT PLOT; PRO- VIDING THAT EXISTING AND NEW HOUSE TRAILER PARKS MUST COMPLY WITH THE PROVISIONS OF THIS ORDINANCE; ALLOWING EXISTING HOUSE TRAILER PARKS 30 DAYS FROM THE DATE OF THE PASSAGE OF THIS ORDINANCE TO CONFORM TO THE REQUIREMENTS OF SAID ORDINANCE; REQUIRING A BUILDING PERMIT FOR HOUSE TRAILER PARKS; ESTABLISHING THE REQUIRE- MENTS FOR "UNIT PLOTS" AND REQUIRING EACH HOUSE TRAILER PARK TO HAVE AT LEAST FIVE (5) UNIT PLOTS WHICH SEPARATE SEWER, WATER AND ELECTRICAL CONNECTIONS; MAKING IT UNLAWFUL TO ALLOW OCCUPANCY OF UNIT PLOTS WHICH DO NOT HAVE TOILET, WATER AND ELECTRICAL FACILI- TIES AVAILABLE TO SAID UNlT PLOT; REQUIRING A LICENSE TO OPERATE A HOUSE TRAILER PARK; MAKING IT UNLAWFUL TO PARK A HOUSE TRAILER WITHIN THE CITY FOR LONGER THAN 3 DAYS, EXCEPT ON THE PRE- MISES OF A LICENSED "HOUSE TRAILER PARK OR UNDER A SPECIAL TEMPO- RARY PERMIT ISSUED BY THE CITY COUNCIL; PROVIDING FOR THE ISSUANCE OF A SPECIAL TEMPORARY PERMIT; REPEALING ALL INCONSISTENT ORDINANCES; FIXING A PENALTY NOT TO EXCEED $200.00 FOR EACH OFFENSE; PROVIDING A SEVERABILITY CLAUSE AND DECLARING AN EMERGENCY. BE IT ONDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL,, TEXAS: Section 1: DEFINITIONS. For the purposes of this ordinance, the following words and phrases shall have the meanings respectively ascribed to them by this section: "House Trailer." A House Trailer is any vehicle used or intended to be used as a conveyance upon the public streets or highways and so designed, constructed or reconstructed or added to by means of accessories In such a manner as will permit the occupancy thereof as a dwelling or s~eeping place for one or more persons. "House Trailer Park." A House Trailer Park is any lot, tract or parcel of land used in whole or part for the accommodation of transients by the day or week, or for a longer period of time with or without compensation and where parking facilities are provided for one or more house trailers. "Person." A person means any human being, his heirs, executors, administrators or assigns, and also includes a f~rm, partnership, aseocia- tion or corporation, or its successors or assigns, or the agent of any of the aforesaid. "Unit Plot." A Unit Plot is that space of ground set aside and permanently marked off as provided in t~ls ordtnanoe and designated as a parking space for a house trailer in a House Trailer ParL Section 2: SCOPE OF ORDINANCE. New House Trailer hrks and all House Trailer Parks no~ existing or hereafter constructed or laid out within the city shall conform to the requirements of this ordinance. Provided, however, that House Trailer Parks now exlstin~ within the City shall hays 3 days from tho date of passage of this ordinaries to conform ~' te~'~r;quiremonts hereof. No person shall erect or construct or procsed with the erection or construction of any Rouse Trailer Park or building or structure related thereto, nor add to, enlarge, move, improve, alter, repair, convert, extend or demolish any House Trailer Park or any part thereof or install any plumbing, electrical er mechanical equipment as a part of a building or structure, or make any other improvement in any building or structure or cause the sue to be done within any House Trailer Park as defined heroin without first obtainin2 a Building Permit therefor from the ~uilding Inspector. In the absence of an official Building Inspector for the City, said permit Shall be obtained from the City Council. Section 4: APPLICATION FOR PERMIT. Application for a Building Permit shall be filed with the Building Inspector or the City Council as the case may be in writing. Every application for a Building permit for a House Trailer Park shall be accompanied by two copies of the plans and specifications and a site plot plan showin~ the "Unit Plo~s" to be located in the House Trailer Park. Said application will show the location of the proposed buildings to be erected and all sxistlng bulldin2s, if any, on the property or premises, Said plot plan shall also clearly indicate all streets, roads, drivss, property lines, administrative buildings, toilet btxi]d- lags, plumbing connections, accessory buildings and feucem together with the necessary space for parking passon2ar vehicles. Before proceeding with the actual work of constructing said House Trailer Park, the applicant shall have such plans approved by the Building Inspector or in the absence of an official Building Inspector for the City, by the City Council. Such plans shall be drawn to scale upon substantial, clean, colorless paper or shall be good blue prints. Said plans and specifica- tions shall be of sufficient clarity to indicate the nature and character of the work proposed. Section 5: LOCATIO~ OF HOUSE TRAILER PARKS. All land used as a House Trailer Park shall be located, on a well-drained site of ample sl~e and in an area zoned for such use. Section 6: REQUIREMENTS FOR KACH UNIT PLOT. Every House Trailer Park shall be required to have at least five (5) enit Plots which shall be clearly defined on the ground by proper permanent markers at each corner. ~ach Unit Plot shall contain sufficient apace for the accommodation of one House Trailer and one automotive vehicle. At least five (5) of the Unit Plots in every Rouse Trailer Park shall be constructed so as to provide for separate sewer, water and electrical connection and separate sewage disposal connections at each Unit Plot. Said connections to be approved by the · uildlng end Pleabind Inspector a~d in the absence of an official · ullding and Plumbing Inspector, the City Council. All such conn~tio~s shalI be in cumpliance with all other City Ordinances. Section 7: APPROVED TOILET, WATER AND ZLECTRiCAL FACILITIES. Itshall be unlawful for any person operating a House Trailer Park to allow any person to occupy, with a Rouse Trailer, any Unit Plot which does not have approved toilet, water and ele~tricl facilities available to said Unit Plot, ~ectlon 8: LICENSE REQUIRED TO OPSRATE ROb"3E TRAILER PARK. It shall be unlawful for any person to open, maintain or operate within the City a House Trailer l~rk as defined heroin without first having secured a license from the City. Any person desiring to open, maintain or operate a House Trailer Park within the City shall make application for said license to the City, furnishing complete infox-matlon as to the o~n~er- ship and management and compliance with this ordinance. Said license may be issued for an indefinite period of time but may be revoked by the City Council for non-c(~apliance with this ordinance. Provided, however, that no such license shall be revoked without first giving such owner or operator written n~tice mailed at least ten (10) days prior to a hearing thereon, advising said person to appear at such hearing and show cause why such license should not be cancelled. Said notice shall t~m mailed to said oMmer or operator at the address shown on said person's application for license. Section 9: CITY (EXCEPTIONS). UNI~WFUL TO PARK HOUSE TRAILER WITHIN Except as provided heroin, it shall be unlawful to park or place any Rouse Trailer on any strse~ lot, tract or psr~ ~- ~and within the City for a period longer then 3days. ,except in the following instances: (a) Where said Rouse Trailer is located on the praises of a *'House TTailer Park" which is licensed to operate under the provisions of this Ordinance. (b) Where a special temporary permit has been issued by the City. Section 10: SPECIAL TF1PORARY PERMIT,TO PARK TRAILER HOUSE. Isne City Council may in its sole discretion issue a temporary permit allowing the parking or use of a House Trailer within the City at a location other than at an approved House Trailer Park. Such permit shall be for a specific time as established by the City Council but may be renewed by the City Council. ~wne City Council may, at the time of the issuance of such special permit or at any time thereafter, impose any type of condition which must be complied with in order that said permit remain in effect. Requests for such temporary special permit must be made to the City Council and upon approval, the City Council will direct the City Clerk to issue said permit in Friting setting forth such conditions. Such special permit is not a right granted under this ordinance but shall be a temporary privilege granted where the circumstances of the particular fact situation warrant the issuance of such special privileae for a limited time. All prior ordinances in conflict with this ordinance are in all thin~s repealed. Section 12. P~BTY CLAUSE. Any person violatin2 any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and, upon conviction thereof, shall be fined not to exceed the sam of $200.00 for each offense, and each and every day such violation s hall o~cur shall constitute a separate offense. Section 13: SEVERABILITY CLAUSE. If any article, paragraph, sub-division, clause, phrase or other provision of this ordinance shall be adJudaed invalid or unconstitutional, the same shall not effect the validity of this ordinance as a whole or any part or provision thereof, other than the part so declared to be invalid or unconstitutional. Section 14: EMERGENCY CLAUSE. The fact that the City of Coppell is in the need of an ordinance regulating House Trailers and House Trailer Parks within the City creates an urZency and an emergency and requires that this ordinance shall take effect immediately fro~ and after its passage and the publication of the caption of said ordinance as the law in such cases provides.
