OR 18 Regulates installation & maintenace of septic tanks ORDINANCE NO. 18 AN ORDINANCE OF THE TOWN OF COPPELL, TEXAS, REGULATING THE INSTALLATION AND MAINTENANCE OP SEPTIC TANKS; PROVIDING FOR SEPTIC TANKS TO BE INSTALLED IN COMPLIANCE WITH THE REQUIREMENTS OF THE HEALTH OFFICER OF DALLAS COUNTY; PROVIDING A PENALTY; AND DECLARING AN EMERGENCY. WHEREAS, the Town of Coppell has no ordinance regulat- ing the installation and maintenance of septic tanks; and WHEREAS, the installation and maintenance of septic tanks in the Town of Coppell if not properly done will create health hazards; and WHEREAS, the County Health Officer of Dallas County, Texas, will assist in the supervision of the installation and maintenance of septic tanks, provided said septic tanks are installed and maintained in accordance with the specifications and requirements of the Health Officer of Dallas County; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE TOWN OF COPPELL, TEXAS: 1. That all septic tanks hereinafter installed in the Town of Coppell shall be installed in accordance with the specifications and requirements of the Health Officer of Dallas County, Texas. 2. That hereafter, all septic tanks located in the Town of Coppell shall be maintained in accordance with the specifications and requirements of the Health Officer of Dallas County so as to prevent said septic tanks from con- stituting a health hazard. 3. That hereafter, it shall be unlawful and an offense for any persos to permit their septic tanks to be in such a condition as to constitute a health hazard to the residents of the Town of Coppell. 4. If any section, paragraph or sub-section of this ordinance shall be adjudged invalid, or held unconstitutional, the same shall not effect the validity of this ordinance as a whole, or any part or provision thereof, other than the parts so decided to be invalid or unconstitutional. 5. Any person violating any of the provisions of this ordinance shall be deemed guilty of a misdemeanor and each such person shall be deemed guilty of a separate offense for each and every day, or portion thereof, during which any violation of any of the provisions of this ordinance is committed, continued or permitted, such violation, such person shall more than $100.00. 6. The fact that there and upon conviction of any be punishable by fine of not is presently no ordinance regulating the installation and maintenance of septic tanks in the Town of Coppell creates an urgency and emergency in the preservation of the public health, safety and welfare, and requires that this ordinance shall take effect from and after its passage and publication, as the law in such cases provides.
