BM 2003-03-20 PZ Minutes of March 20, 2003 PLANNING AND ZONING COMMISSION The Planning and Zoning Commission of the City of Coppell met in pre-session at 6 p.m., and in regular session at 6:30 p.m., on Thursday, March 20, 2003, in the Council Chambers of Coppell Town Center, 255 Parkway Boulevard, Coppell, Texas 75019. The following members were present: Chairman Greg McGahey Vice Chairman Drew Halsey Commissioner Anna Kittrell Commissioner Lee Foreman Commissioner Dornell Reese, Jr. Also present were Graduate Engineer Teresa Turner, Planning Director Gary Sieb, Assistant Planning Director Marcie Diamond, Economic Development Coordinator Andrea Roy and Sr. Administrative Secretary Barbara Jahoda. Commissioners Ann Dragon and Rick McCaffrey were absent. PRE-SESSION (Open to the Public) Briefing on the Agenda. Staffbriefed the Commission on the cases. REGULAR SESSION (Open to the Public) Call to Order. Chairman McGahey called the meeting to order. Approval of Minutes dated February 20, 2003 Commissioner Foreman made a motion to approve the minutes of February 20, 2003, as written. Vice Chairman Halsey seconded; motion carried (5-0) with Commissioners Reese, Kittrell, McGahey, Halsey and Foreman voting in favor. None opposed. Review and discussion relating to ensuring consistency between the Old Coppell Master Plan, the Zoning Ordinance and the 1996 Comprehensive Plan. Presentation: Planning Director Gary Sieb introduced the item to the Commission, 1 showing exhibits, stating that in February, Council directed staff to undertake a study to assure consistency between the 1996 Comprehensive Master Plan, the 2002 Old Coppell Master Plan and zoning. They also asked for historical data regarding the D/FW Airport's position on residential zoning cases in the general area of the Historic Overlay district. He stated that both he and Assistant Planning Director Marcie Diamond are prepared to respond to these directives. Mr. Sieb proceeded with a review of a 17-page report that outlines what the Planning staff has determined to be consistencies and inconsistencies with the two Plans and gave a brief history of both. As part of the Old Coppell Master Plan, he mentioned that the consulting firm (Looney Ricks Kiss) recommended expanding the Historic Overlay district from 60 acres to approximately 100 acres, which included a variety of residential types and densities. With that in mind, in the latter part of 2002, staff received an application from a developer to rezone approximately four acres of commercial property to residential. This proposal concerned City Council, resulting in a joint meeting with the Planning and Zoning Commission on December 10, 2002. At that point, the applicant asked to have his request continued until Council's concerns were resolved. Referring to the 1996 Comprehensive Master Plan, Mr. Sieb discussed how it should be read, particularly with regard to the noise and land use issues. To summarize, Mr. Sieb stated that residential uses in the Historic Overlay district are appropriate and based on Part 150 of the Federal Aviation Regulations, airport noise is not a legal issue as all proposed residential areas in the Plan are outside the LDN 65-dB area. As far as inconsistencies between the two Plans, Mr. Sieb stated only three are relevant: 1) the building height in the Comprehensive Master Plan was recommended to be one-story; the Old Coppell Master Plan recommends 2~A stories; 2) the Old Coppell Master Plan gets into more detail as to the retail area; i.e., being close to the street, the use of glass, and providing mixed-use in the second story; 3) the 1996 Comprehensive Master Plan showed residential use in the Grapevine Springs area and the Old Coppell Master Plan shows that area as it is today (owned by the City of Coppell and planned as a park area). Mr. Sieb then mentioned that as far back as 1972, residential use has always been shown for this area. Mr. Sieb concluded that no zoning changes would be recommended at this time for the Historic Overlay area, noting these changes should be developer-driven. He then suggested that the Commission authorize a Public Hearing to consider modifying the current Historic Overlay boundary to include that area as suggested by the consulting firm of Looney, Ricks, Kiss (LRK). Discussion: Discussion followed relative to the Airport runways and decibel levels in relationship to the following subdivisions: Shadow Wood, Oakbend, Old Coppell Estates, The Woodlands, Deer Run and the proposed Westchase development, which was denied by Council in May of 1999; reasons for the proposed purchase of the 22-acre Carter/Crowley property west of Coppell Road, south of Bethel Road; expanding the Historic Overlay district to possibly include the Hunterwood Park area, to provide more pedestrian traffic in the area, etc. Action: Commissioner Foreman made a motion to instruct staff to prepare for a Public Hearing the modification of the current Historic Overlay district to incorporate the area as proposed in the Old Coppell Master Plan, including a study and recommendation as to whether or not to include the Hunterwood Park area; acknowledged consistency between the two 2 o o go Master Plans; acknowledged that the D/FW Airport noise, as defined by Part 150 of the Federal Aviation Regulations, does not appear to be an issue with regard to proposed residential development in the Old Coppell Historic Overlay area, and acknowledged that any rezoning in the Historic Overlay district should be developer-driven. Vice Chairman Halsey seconded the motion; motion carried (5-0) with Commissioners Reese, Kittrell, McGahey, Halsey and Foreman voting in favor. None opposed. Review and discussion on the inconsistencies between the 1996 Comprehensive Plan and the existing Zoning Ordinance. Presentation: Assistant Planning Director Marcie Diamond introduced Items 5, 6, 7 and 8 to the Commission, showing exhibits, stating that discussion will center around 1) recommended revisions to the Comprehensive Master Plan, based on existing land use and zoning, 2) recommended revisions to the Comprehensive Master Plan, based on planning and development in Coppell over the past five or six years, 3) recommended rezonings based on the existing Comprehensive Master Plan, and 4) recommended rezonings based on recommended amendments to the Comprehensive Master Plan. She mentioned that in 2000, 14 amendments were approved for the Comprehensive Master Plan, bringing it in compliance with the zoning and land use at that time. She then reviewed the six areas to be considered for land use reclassification and finally recommended proper zoning on all six properties. Discussion: Discussion followed relative to each parcel; i.e., access, floodplain issues, etc. It was recommended that consideration be given to extending the HC (Highway Commercial) zoning along Business S.H. 121 frontage, northward. Although rezoning the Ardinger tract, west of Denton Tap Road; north of Wynnpage, makes sense, concern was expressed that being the last large tract of commercial property at a main intersection, rezoning to single family would restrict retail/commercial projects. Staff responded that over the years, there's been sporadic interest for commercial uses on this property, but nothing has materialized. Action: Vice Chairman Halsey made a motion to ask staffto bring forward Public Hearings with regard to the six recommended rezonings, including extending the Highway Commercial designation along Business S.H. 121, northward, and land-use changes discussed in Items 5-8. Commissioner Kittrell seconded the motion; motion carried (5-0) with Commissioners Reese, Kittrell, McGahey, Halsey and Foreman voting in favor. None opposed.
