OR 97-799 City Manager to execute legal instruments to acquire real estate AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 97799 AN ORDINANCE OF THE CITY OF COPPEI,I; TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING ARTICLE 1-5, SECTION 1-5.6 TO ADD SUBSECTION I TO AUTHORIZE THE CITY MANAGER TO ACQUIRE ANY TITLE, ESTATE, OR RIGHT IN REAL PROPERTY BY SETTLEMENT, ACCEPTANCE OF COMMISSIONER'S AWARD, PAYMENT OF A COURT JUDGMENT, OR BY PURCHASE AND TO APPROVE LEGAL INSTRUMENTS RELATED THERETO lF THE CITY COUNCIL PREVIOUSLY AUTHORIZED SUCH ACTIONS OR FOR APPROVED BUDGET ITEMS OR CAPITAL IMPROVEMENT PROJECTS; PROVIDING A REPEAIJNG CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE~ CITY OF COPPELL, TEXAS: SECTION 1. That the Code of Ordinance of the City of Coppell, Texas be, and the same is hereby amended by amending Article 1-5, Section 1-5-6 in part to add subsection I to read as follows: "Sec. 1-5-6 AUTHORITY TO PUBCHASE AND APPROVE CHANGE ORDERS I. The City Manager is authorized to accept and approve upon behalf of the City, any legal instrument executed by a person who grants, gives, conveys, quit claims or releases any right in real property, whether such right is fee sunpie or any lesser title, estate or fight. The City Manager is also authorized to acquire any title, estate or fight in real prope~J by settlemere, acceptance of commissioner's award, payment of a court judgment, or by purchase if the City Council has previously authorized eminent domain proceedings on the real property, or for approved budget items and capital improvement projects, provided however there are budgeted funds to cover the cost to the City. City Manager is authorized to accept, approve, and execute any legal instrument necessary to perform any of the powers granted herein." SS10584 SECTION 2. That all provisions of the Code of Ordinances of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That should any word, phrase, paragraph, section or phrase of this ordinance or of the Code of Ordinances, as amended hereby, be held to be unconstitutional, illega/or invalid, the same shall not affect the validity of this ordinance as a whole, or any part or provision thereof other than the part so decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the Code of Ordinances as a whole. SECTION 4. That this ordinance shall take effect immediately l~om and after its passage and the publication of the caption, as the law and charter in such cases provide.
