A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPELL,
TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE A CONTRACT WITH
CRAIG OLDEN, INC. FOR EMERGENCY SLOPE STABILIZATION
CONSTRUCTION ON GRAPEVINE CREEK; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, Article I-5, Section 1-5-6G of the Code of Ordinances of the City of
Coppell, Texas authorized expenditures exceeding Fifteen Thousand Dollars and No/100
($15,000) in the event of an emergency declared by the City Manager and approved by the City
Council; and
WHEREAS, the City Manager has declared that an emergency exists with regard to the
slope stabilization construction work on Grapevine Creek Phase 1I as described in RFQ #1872,
and is further described in the contract with Craig Olden, Inc. attached hereto as Exhibit "A"; and
WHEREAS, the City Manager and the City Council find that a procurement for the
aforesaid construction is necessary to preserve and protect the public health or safety of the
residents of Coppell and because of public calamity exists that requires the immediate
appropriation of money to relieve the necessity of the residents of Coppell and to preserve the
property of the City; and
WHEREAS, the City Council of the City of Coppell, Texas approves the declaration for
the emergency expenditure by the City Manager; and
WHEREAS, the City Council desires to authorize the execution of the Contract by and
between the City of Coppell, Texas and Craig Olden, Inc. dated April 26, 1997 attached hereto as
Exhibit "A";
NOW TffEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF COPPELL, TEXAS:
SECTION 1. That the City Manager of the City of Coppell, Texas declares that the
emergency exists as to the necessity for certain soil stabilization construction on Grapevine Creek
as further described in RFQ# 1872 and in the Contract by and between the City of Coppell, Texas
and Craig Olden, Inc. attached hereto as Exhibit "A".

SECTION 2. That the City Council of the City of Coppell, Texas approves the
emergency declaration made by the City Manager and finds that a procurement is necessary to
preserve or protect the public health and safety of the residents of Coppell and because a public
calamity exists which requires the immediate appropriation of the money to relieve the necessity
of the residents of Coppell and to preserve the property of the City.
SECTION 3. That the City Manager is authorized to execute the Contract by and
between the City of Coppell, Texas and Craig Olden, Inc. attached hereto and marked Exhibit
SECTION 4. This resolution shall become effective immediately from and after its
passage, as the law and charter in such cases provide.
