RE 07-23-96.2 A RESOLUTION OF THE CITY OF COPPELL, TEXAS RESOLUTION NO. 072396.2 A RESOLUTION OF THE CITY OF COPPELL, TEXAS, APPROVING THE TERMS AND CONDITIONS OF A COMMUNITY DEVELOPMENT BLOCK GRANT AGREEMENT BY AND BETWEEN THE CITY OF COPPELL, TEXAS AND THE COUNTY OF DALLAS, TEXAS; AUTHORIZING ITS EXECUTION BY THE MAYOR; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council has been presented a proposed Community Development Block Grant Agreement by and between the City of Coppell, Texas and the County of Dallas, Texas, a copy of which is attached hereto and incorporated herein by reference; and WHEREAS, upon full review and consideration of the Agreement, and all matters related thereto, the City Council is of the opinion and rinds that the terms and conditions thereof should be approved, and that the Mayor should be authorized to execute the Agreement on behalf of the City of Coppell, Texas; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, SECTION 1. That the Community Development Block Grant Agreement attached hereto having been reviewed by the City Council of the City of Coppell, Texas, and found to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all things approved, and the Mayor is hereby authorized to execute the Agreement on behalf of the City of Coppell, Texas. SECTION 2. This Resolution shall become effective immediately from and after its passage and it is accordingly so resolved. SMITH, CITY ATTORNEY (PGS/slp 7-19-96) SSI772 2 214 304 367~ 09/18/96 ]' '~1 CITY OF COPPELL 002 AGREE1VIENT OF coOp'I~RA]t'ION for CDBG/HOME Program WHEREAS, the 93rd Session of the Congress passed, and thc Prcsident of the United States signed into law, the I-louslng and Community Development Act of 1974 (PL93-353) which created the Urban Coumy Commumnity Development Block Grant (CDBG) program; and WHEREAS, Dallas County. Texas, is applying to tile U. S. Department of Housing and Urban Development for Urban County CDBG entitlement status; and WIIEREAS, in order to qualify for this status, Dallas County must enter into cooperative agrccmcnta with lo, al govcrmncntz and have the collective population of tile County's unincorporated area and thc participating local govermncnts wtal at least 100,000 people; and WHEREAS, Texas cities and counties are authorized under Chapter 373, Local Government Code, and Section 381.003, Local Government Code, to conduct cssantia] Housing and Community Development aotivitios; and WHEREAS, Texas cities and counties are authorized under Chapter 771, Government Code, to ~nter into cooperative agrccments with one another. NOW~ TItEREFORE, BE IT RESOLVED THAT: The City of Coppcll supports the efforts of Dallas County, Texas to qualify for the Urban County CDBG program and asks that its population be included in such a pr0gnun beginning with Federal Fiscal Years 1997, 1998 and 1999 and automatically for each successive three-year period unless the City or the County provides written notice that it elects to not participate in a successive three-year qualification period. This agreement covers both thc CDBG Entitlement program and, where applicable, the HOME Investment l'artn~r~hip program, This agreement remain~ in effect until the CDBG (and HOME, where applicable) funds and income received with respect to the three-year qualification period ( and any successive qualification periods under agreements that provide for automatic renewals) are expended and the funded activities completed, and that the County and City may not terminate or withdraw from the agreement while the agreement remains in effect. The City of C°Ppcll understaods that it: 1, May not apply for grm~ts under tim Small Cities m' State CDBG Program from appropriations tbr fiscal years duriug the period in which it is participating in thc Urban County CDBG program; and 2. May i~ot participate in an HOME consorfimn except through the Urban County, regardless of whether the Ulban County receives a HOME formula allocation. 214 504 36?3 07×18×96 1'-2 CITY OF COPPELL 003 Dallas County and thc City of Coppell agree to cooperate to undertake, or assist in undertaking community renewal and lower income'housing activities, specifically urban rencwal and publicly assisted housing; Dallas County mid the City of Coppc]l shall take all actions necessary to assure compliance with the Urban County's ccrtificatiou requircil by Section 104C0) of Title I of thc Housing and Community Development Act of 1974, as amended, including Title VI of the Civil Rights Act of 1964, Section 109 Title l of thc llousing and Conununity Development Act of 1974, and Title VIII of the Civil Rights Act of 1968; , Dallas County and the City of Coppell understand that Urban County funding will not be provided for activities in or in support of a coope~'atillg local government that docs not affirmatively further fair housing within its own jurisdiction or that impedes the County's actions to comply with its fair housing certifications; Thc City of Coppcll undcrstmlds, that ill accordance with 24 CFR 570~501(b) and 570.~03, it shall be subject to thc stone admlnlstrativc requirements as a sub-recipient should it receive funding under this program; The City of Coppell agrees to inform Dallas County of any income generated by the expenditure of CDBG/HOME funds received, and that any such prograin income must be paid to the County to bc used for eligible activities ill accordance with all HOME/Co~mnunity Development Block Grant requiremcn/s; Dallas County is responsible for monitoring and reporting t0 the U. $. Departlne~t of ltousing alld Urban Development on thc use of any such program income, and that in the event of close-out or change in status of the City of Coppell, any program income that is on hand or received s~bsequcnt to the close-out or change in status shall be paid thc County; The city of Coppell a/;rccs to notify Dallas County of any modification or change iu thc use of the real property from that planned at thc thne of acquisition or improvemeltt, including disposition, and further agrees to reimburse the County in au amount equal to thc current fair market value (less any portion thereof attributable to expendlturc of non-CDBG/HOME funds) for property acquired or improved wi~h CDBG/HOME funds that is sold or transferred for a use which does not qualify under the CDBG/HOME regulations; Any money generated fi'om thc dispo~itiou or transfer of property will be treated as program income/md returned to thc County prior to, or subsequent to, the close-out, change of Status, or termination of this cooperative agreement between Dallas County and the City of Coppell. Thc City of Coppcll has adopted and is enforcing: 1. A policy prohibiting tile usc of excessive force by law enforcement agencies within it~ jurisdiction against any individuals engaged in noll~ vlolcnt civil rights dcmo~lstrations; and 2.
