BM 2004-03-18 PZ Minutes of March 18, 2004 PLANNING AND ZONING COMMISSION The Planning and Zoning Commission of the City of Coppell met in pre-session at 6 p.m., and in regular session at 6:30 p.m., on Thursday, March 18, 2004, in the Council Chambers of Coppell Town Center, 255 Parkway Boulevard. Coppell, Texas 75019. The following members were present: Vice Chairman Lee Foreman Commissioner Rick McCaffrey Commissioner Anna Kittrell Commissioner Dornell Reese, Jr. Commissioner Mark Borchgardt Commissioner Paul Milosevich Also present were Assistant Planning Director Marcie Diamond, City Planner Matt Steer and Secretary Barbara Jahoda. Chairman Drew Halsey was absent. PRE-SESSION (Open to the Public) Briefing on the Agenda. Staff briefed the Commission on the cases. REGULAR SESSION (Open to the Public) Call to Order. Vice Chairman Foreman called the meeting to order. Approval of Minutes dated February 19, 2004. Commissioner Kittrell made a motion to approve the minutes of February 19, 2004, as written. Commissioner Borchgardt seconded; motion carried (6-0) with Commissioners McCaffrey, Milosevich, Kittrell, Borchgardt, Foreman and Reese voting in favor. None opposed. PUBLIC HEARING (Continued): Consider approval of Case No. S-1098R2~ Kroger, zoning change request from C-S-1098R (Commercial-Special Use Permit 1098 Revised) to C-S-1098R2 (Commercial, Special Use Permit-1098 Revision 2), to allow a drive-through pharmacy with canopy along the west side of the existing grocery store located at the northwest corner of Sandy Lake and MacArthur, at the request of Mike Clark of Winkelmann and Associates, Inc. Presentation: Assistant Planning Director Marcie Diamond introduced the item to the Commission, showing exhibits. After giving a brief history of this property and what is being proposed with this drive-through pharmacy, Ms. Diamond discussed staff' s concerns regarding safety if vehicles circulate around the back of the supermarket from the east side, due to delivery truck activities and the lack of lights after dark. Staff suggested an alternate route with a turn-around on the west side, inclusive of appropriate signage to encourage access from the west side of the building. She also addressed the sparse trees along the north property line, etc. Ms. Diamond then stated that staff recommends approval of this drive-through, subject to six conditions, which she read into the record. She also mentioned that 36 notices were sent to property owners within 200' and that two favorable and one opposing response were sent to the Planning Department. Richard Binkley, Facility Engineer with Kroger, 1331 E. Airport Freeway, Irving, TX, and Michael Doggett, Winkelmann and Associates, Inc., 6750 Hillcrest Plaza Drive, Suite 100, Dallas, TX 75230, were present to represent this case before the Commission and answer any questions, both stating agreement with staff conditions. A sample of the EIFS product for the proposed canopy and proposed color (#6050 White Linen) were presented to the Commission. Discussion: There was discussion relative to the U-turn for the drive-through, whether or not the handicap ramp would be affected when using this turn-around, whether or not the applicant has met with the neighbors about this proposal, etc. Public Hearing: (continued from February 19, 2004) Vice Chairman Foreman asked for people who wanted to speak either in favor or opposition or wanted to comment on this request to come forward. No one spoke. Vice Chairman Foreman closed the Public Hearing. Action: Commissioner McCaffrey made a motion to recommend approval of Case No. S-1098R2, Kroger, zoning change request from C-S-1098R to C-S-1098R2, to allow a drive-through pharmacy, subject to the following conditions (staff's condition #1 re sample materials was satisfied): 1) Revise Note #5 on the site plan to specify the timing of the external lights on the west and north sides of the building. 2) Revise the note on the site plan which states "Review and inventory existing trees and replace missing or dead trees to comply with original approved landscape plan" to add "within three months from the passage of the Ordinance". 3) Provide for signage to discourage circulation around the rear of building. 2 4) The site shall be developed in accordance with the revised site plan, elevations and canopy details. 5) The hours of operation for this pharmacy shall not exceed: 9 a.m. to 9 p.m. - Monday through Friday, 9 a.m. to 7 p.m. -Saturday, and 10 a.m. to 4 p.m. on Sunday. Commissioner Reese seconded the motion; motion carried (6-0) with Commissioners McCaffrey, Milosevich, Kittrell, Borchgardt, Foreman and Reese voting in favor. None opposed. PUBLIC HEARING: Consider approval of Case No. S-1194R3~ Firehouse Wings, zoning change request from PD-178R-S-1194R2 (Planned Development-178R- Special Use Permit-Il94 Revision 2) to PD-178R-S-1194R3 (Planned Development- 178R-Special Use Permit-Il94 Revision 3), to allow an approximate 1,405 square- foot restaurant, with private club, to be located in Suite 600 of the Town Center West Retail Center at 171 N. Denton Tap Road, at the request of Garret Lucero. Presentation: Assistant Planning Director Marcie Diamond introduced the item to the Commission, showing exhibits. After reviewing the floor plan, proposed hours of operation and sign plan, she stated that staff recommends approval of this Special Use Permit, subject to two conditions, which she read into the record. Ms. Diamond also stated that of 16 notices sent to property owners within 200' of this request, no responses were returned to the Planning Department. Garrett Lucero and Ronnie Harris, partners in Firehouse Wings, 171 N. Denton Tap Road, Suite 600, Coppell, TX, were present to represent this case before the Commission and answer any questions, stating agreement with staff conditions. They stated that 18 varieties of wings will be offered and since they are firemen in Dallas, the d6cor of the establishment will be firehouse related, featuring Coppell Fire Department memorabilia. Discussion: There was a question regarding this restaurant's proximity to the high school. that other restaurants in this shopping center also had private clubs. Staff stated Public Hearing: Vice Chairman Foreman opened the Public Hearing, asking for people who wanted to speak either in favor or opposition or wanted to comment on this request to come forward. Action: Commissioner Borchgardt made a motion to recommend approval of Case No. S-- 1194R3, Firehouse Wings, zoning change from PD-178R-S-1194R2 to PD-178R-S- 1194R3, subject to the following conditions: o 1) The hours of operation shall not exceed 7 a.m. to 12 midnight, seven days week. 2) The development of this property shall be in accordance with the attached site plan, elevations, floor plan and sign plans. Commissioner McCaffrey seconded the motion; motion carried (6-0) with Commissioners McCaffrey, Milosevich, Kittrell, Borchgardt, Foreman and Reese voting in favor. None opposed. Consider approval of the Town Center Addition~ Lot 3~ Block 3~ First American Bank Site Plan Amendment, to allow two additional attached signs on the existing 4,995 square-foot bank building on 1.13 acres of property located at 252 Denton Tap Road, at the request of Jim Hagle, Chandler Signs. Presentation: In Planning Director Gary Sieb's absence, City Planner Matt Steer introduced the item to the Commission, showing exhibits. After discussing the existing signage and what is proposed, he stated that the logo, with the proposed signage, on the front elevation will now become legal/non-conforming, since it exceeds the 20% requirement. He stated that staff recommended arching the new lettering over the entryway, but the applicant rejected this suggestion. He then stated that staff recommends approval of this Site Plan Amendment, subject to one condition, which he read into the record. Jim Hagle, Chandler Sign Company, 3201 Manor Way, Dallas, TX 75235, was present to represent this case before the Commission and answer any questions, addressing the bank' s stance on staff' s recommendation to arch the lettering. Discussion: There was some discussion regarding the logo and proposed signage. Action: Commissioner Kittrell made a motion to recommend approval of the Town Center Addition, Lot 3, Block 3, First American Bank Site Plan Amendment, to allow two additional attached signs, subject to the following condition: 1) Place note on face of signage exhibits that states the logo becomes a legal, non-conforming sign and if damaged, destroyed or removed for any reason, the logo will have to abide by the then current signage regulations. Commissioner McCaffrey seconded the motion; motion carried (6-0) with Commissioners McCaffrey, Milosevich, Kittrell, Borchgardt, Foreman and Reese voting in favor. None opposed. 4 o PUBLIC HEARING: Consider approval of a text amendment to Chapter 12, Zoning, of the Code of Ordinances, Section 12-42-1, to add two new definitions regarding Warehouse/Distribution and Limited Assembly and Manufacturing uses. Presentation: Assistant Planning Director Marcie Diamond introduced the item to the Commission, explaining the need for these definitions. Public Hearing: Vice Chairman Foreman opened the Public Hearing, asking for people who wanted to speak either in favor or opposition or wanted to comment on this request to come forward. Discussion: Some discussion followed, resulting Warehouse/Distribution definition. in additional language being added to the Action: Commissioner Milosevich made a motion to recommend approval of a text amendment to Chapter 12, Zoning, of the Code of Ordinances, Section 12-42-1, to add a definition of Warehouse/Distribution to read as follows: A use devoted to storage, warehousing and distribution of goods, merchandise, supplies and equipment. Accessory uses not considered to be part of storage and warehousing areas may include, but are not limited to, retail and wholesale sales areas, offices, sales offices, research and development areas and display areas for products sold and distributed from the storage and warehousing areas. Parking for all herein-defined accessory uses shall be provided, on a gross square-foot basis, in accordance with the Section 12-31-6 of the Coppell Zoning Ordinance. and providing for a definition of Assembly and Manufacturing (limited) to read as follows: The assembly, repair, disassembly and manufacturing of finished products or parts from previously prepared materials and parts. Fabrication may be used in limited form to shape or define the final product, but shall not comprise the primary activity of such operations. Basic industrial processing, which transforms raw materials into a new substance, compound or product, is not permitted. Excluded uses include, but are not limited to, meat packing, chemical and petroleum processing and manufacturing, and foundries. Commissioner Kittrell seconded the motion; motion carried (6-0) with Commissioners McCaffrey, Milosevich, Kittrell, Borchgardt, Foreman and Reese voting in favor. None opposed. go PUBLIC HEARING: Consider approval of a text amendment to Chapter 12, Zoning, of the Code of Ordinances, Sections 12-22-1 and 12-30-9, to revise the uses permitted in Highway Commercial districts. Presentation: Assistant Planning Director Marcie Diamond introduced the item, reminding the Commission of over 200 acres that the City rezoned from LI (Light Industrial) to HC (Highway Commercial) in order to raise the bar on uses and building standards (80% masonry) along major freeways and intersections, stating this was the appropriate time to revise the uses permitted in HC to assure that the City's goals are achieved. Discussion: There was considerable discussion regarding the Highway Commercial district and some changes were recommended for both permitted uses and uses permitted by Special Use Permit. Public Hearing: Vice Chairman Foreman opened the Public Hearing, asking for people who wanted to speak either in favor or opposition or wanted to comment on this request to come forward. Action: Commissioner Milosevich made a motion to recommend approval of text amendments to Chapter 12, Zoning, of the Code of Ordinances, Sections 12-22-1 and 12-30-9 as follows: Sec. 12-22-1. Use regulations for HC Zoning District shall be amended to read as follows: A building or premise shall be used only for the following purposes: 1) Auto parts sales (new) 2) Barber and beauty shop 3) Business or trade school 4) Business support services 5) College or university 6) Communications services 7) Community centers (public or private) 8) Consumer repair services 9) Drug store or pharmacy 10) Dry cleaning and laundry 11) Exhibition hall 12) Film developing and priming 13) Financial services 14) Fix-it shops for such items as bicycles and lawn mowers but without outside storage 15) Florist (no outside storage) 16) Fraternal club or lodge 17) Furniture stores 18) Hardware store 19) Hospital 20) Jeweler (retail) 21) Laboratory: Scientific, research, testing, medical, dental, or optical so long as all operations are conducted indoors 22) Meat market (retail only) 23) Municipal buildings 24) Museum 25) Other general retail sales of similar nature and character provided that the business establishment is subject to the following conditions: (A) that it be conducted wholly within an enclosed building (B) that required yards not be used for display, sale or storage or merchandise, or for the storage of vehicles, equipment, containers or waste material (C) that all merchandise be first-hand and be sold at retail on the premises (D) that such use not be objectionable because of odor, excessive light, smoke, dust, noise, vibration or similar nuisance 26) Office/Warehouse (warehouse being limited to a maximum of 20 percent of the gross floor area) 27) Personal services 28) Pet services 29) Photography studio 30) Postal facilities 31) Printing shop or company (retail only) 32) Professional and administrative offices where services are provided only and no chattels or goods are offered for sale on the premises, including but not limited to doctors, dentists, attorneys, architects, engineers, urban planners, insurance, real estate, banks and similar offices 33) Radio, television or microwave receiving dish (subject to screening regulations; see Section 12-33-1) 34) Temporary amusement activity, i.e., carnival (approved by City Council resolution) 35) Temporary buildings for use incidental to construction work on the premises, which said building shall be removed 36) Veterinarian or animal hospital (no outside kennels or runs)." PUBLIC HEARING: Consider approval of text amendments to Chapter 12, Zoning, of the Code of Ordinances, Sections 12-29-4.2(A) and 4.3(A)i, regarding Sign Regulations for Business districts. Presentation: Assistant Planning Director Marcie Diamond introduced the item to the Commission, stating these proposed changes relate to monument signs (limiting these signs to advertise only the name & address of development), attached signage (limiting signage to one color per development; preferably, beige, cream, ivory, black or white) and Industrial areas (allowing unrestricted color of attached signage, including logo size and mountings). Discussion: Some discussion followed. Action: Commissioner Borchgardt made a motion to approve text amendments to Chapter 12, Zoning, of the Code of Ordinances, Section 12-29-4.2(A) to read as follows: Signs are permitted in any business zoning district, subject to the following restrictions. Monument signs: Monument signs are permitted in business zoning districts as follows. (A) Monument signs must be built on a monument base, as opposed to a pole base, with no separation between the base of the sign and natural grade. A monument sign shall contain only the name, logo, address, product or service of the establishment, and in the case of gasoline service stations only, the price per gallon of gasoline, and in the case of governmental and religious organizations only, information concerning forthcoming public events. In the case of a multi-tenant office or retail/ commercial building, the monument sign shall only advertise the name/address of the building or retail center, and not the individual tenants of the building. No other advertising or promotional information is permitted thereon. Such sign may be single or double- faced. Can signs made of plastic or similar materials are not permitted as detached (monument) signs. Backlit plastic is not permitted within detached (monument) signs. And Section 12-29-4.3(A)i to read as follows: Attached signs: Attached signs are permitted in business areas in accordance with the following provisions: Attached signs shall consist of individually-mounted channel letters in white, ivory, black or neutral colors. In the event that a building has existing attached signs of all one color, not compliant with the colors specified herein, then the new sign may either match the color of the existing signs on the building, or be white, ivory, black or neutral. It is the intent of this provision that all tenant signage be the same color in any individual building. Raceways shall match the color of the materials to which they are mounted. All illumination shall be limited to white or off-white. Logos in any color shall be permitted, but shall not exceed 20 percent 9 of the area of the sign. Attached signs in areas zoned Light Industrial are exempt from the color and logo size restrictions and the requirement for individually- mounted letters. Refer to 12-29-4.3(D) for additional regulations on attached signs in Industrial zoned areas. Commissioner Reese seconded the motion; motion carried (6-0) with Commissioners McCaffrey, Milosevich, Kittrell, Borchgardt, Foreman and Reese voting in favor. None opposed. 10. General discussion concerning planning and zoning issues. A. Update on Council planning agenda action on March 9, 2004: a. Case No. S-1213, Roly Poly Sandwiches, zoning change request from C to C-S-1213. b. Vista Ridge Addition, Lot IA and lB, Block D, Replat, to allow the subdivision of 22.59 acres of property into two lots, located at the northeast corner of Denton Tap Road and S.H. 121. c. Hidden Valley, Final Plat, to allow a 16-lot single-family subdivision on 7.3 acres of property zoned PD-106-SF-9, located along the southerly extension of Hidden Valley Road. d. Champions School of Real Estate, Lot 1, Block 1, Site Plan Amendment, to allow one additional 20 square-foot sign on the west elevation of the existing 6,293 square-foot office building. Assistant Planning Director Diamond stated that Council approved the above-listed items on March 9th, as recommended by the Planning Commission. Director's comments: There was no discussion.
