OR 96-779 Exception to fire extinguishing systems AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 96779 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER15, ARTICLE 15-1, SECTION 15-1-2(10)(1) BY AMENDING SECTION 904.2.1, OF THE UNIFORM BUILDING CODE, 1994 EDITION RELATING TO AUTOMATIC FIRE EXTINGUSHING SYSTEMS TO PROVIDE AN EXCEPTION FOR CERTAIN ADDITIONS TO EXISTING BUILDINGS; BY AMENDING SECTION 15-1-2(23) APPENDIX CHAPTER 4, DIVISION 1 RELATING TO THE LOCATION OF LATCHING DEVICES FOR DOORS AND GATES FOR SWIMMING POOLS, SPAS AND HOT TUBS; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A PENALTY FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENCE; EXCEPT HOWEVER, WHERE A DIFFERENT PENALTY HAS BEEN ESTABLISHED BY STATE LAW FOR SUCH OFFENSE THE PENALTY SHALL BE THAT FIXED BY STATE LAW, AND FOR ANY OFFENSE WHICH IS A VIOLATION OF ANY PROVISION OF LAW THAT GOVERNS FIRE SAFETY, ZONING, OR PUBLIC HEALTH AND SANITATION, INCLUDING DUMPING OF REFUSE, THE PENALTY SHALL BE A FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. Sec. 904.2.1 shall be amended to read as follows: "See. 904.2.1 Where required. An automatic fire extinguishing system shall be installed in the occupancies and locations as set forth in this section. 1. All buildings, 3 or more stories or, 35 feet in height, or greater than 5,000 square feet, excluding Group R, Division 3. Except for Group R, Division 3, any building or structure three or more stories or greater than thirty-five (35) feet in height; or any structure with a gross square footage greater than five thousand (5,000) square feet shall be equipped with an automatic fire sprinkler system. Any Group R, Division 3 buildings with a gross square footage greater than ten thousand (10,000) square feet shall be equipped with an automatic fire sprinkler system. EXCEPTION? For all existing buildings regulated bF this code. an automatic/ire extinguishing system shall not be required re~,ardless o[ the buila~ngs size, until the area o[anv new building addition exceeds 5. 000 square feet. At such time when this ad~tional area has been reached the entire building shall be equipped with an automatic l~re extinguishing system. 23. Appendix Chapter 4, Division 1(1994 Uniform Build'rag Code) is hereby amended to read as follows: DOORS AND GATES Sec. 421.2 Access gates shall comply with the requirements of Items 1 through 6 above and shall be equipped with one or more of the following types of doors or gates and none other: 1. A gate or door used for general ingress or egress to and liom the enclosed area which is not a door of an occupied dwelling, when dwelling structure forms a part of the enclosure required by this Article. Such gate or door shall be equipped with and shall be maintained with self-dos'rag and self-latching devices designed to keep and capable of keep'rag such door or gate securely closed and latched at all times when not in actual use, and such latching device ~ Material added to the text appears in italic underlined print and material deleted from the text appears in at~Jcccut print 2 ss4670 to be attached no lower than forty-twos~ inches (4_26") ~-om the grade level measured at the outside of the gate or door." SECTION 2. That should any word, sentence, paragraph, subdivision, clause, phrase or section of this ord'mance, or of the Code of Ord'mances, as mended hereby, be adjudged or held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 3. That all provisions of the Code of Ordinances of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ord'mance shall remain in full force and effect. SECTION 4. An offense committed before the effective date of this ordinance is governed by the prior law and the provisions of the Code of Ordinances, as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 5. That any person, finn or corporation violating any of the provisions of this ordinance or of the Code of Ordinances, as amended hereby, shall be deemed guilty of a misdemeanor and, upon conviction in the municipal court of the City of Coppelt, Texas, shall be subject to a fine not to exceed the sum of five hundred dollars ($500.00) for each offense, except however, where a different penalty has been established by state law for such offense the penalty shall be that fixed by state law, and for any offense which is a violation of any provision of law that governs fire safety, zoning, or public health and sanitation, including dumping of refuse, the penalty shall be a fine not to exceed the sum of two thousand dollars ($2,000.00) for each offense; and each and every day said violation is continued shall constitute a separate offense. 3 SS4670 SECTION 6. That this ordinance shall take effect immediately ~'om and after its passage and the publication of the caption as the law and charter in such cases provide.
