OR 96-778 Amends Uniform Fire code AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 96778 AN ORDINANCE OF TFIE CITY OF COPPELL, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING ARTICLE 15- 2, SECTION 15-5-2(23) TO AMEND APPENDIX VII OF THE UNIFORM FIRE CODE, 1994 EDITION RELATING TO AUTOMATIC FIRE SPRINKLER SYSTEMS TO PROVIDE AN EXCEPTION FOR CERTAIN ADDITIONS TO EXISTING BUILDINGS; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR A PENALTY FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF FIVE HUNDRED DOLI.ARS ($500.00) FOR EACH OFFENSE, EXCEPT, HOWEVER, WHERE A DIFFERENT PENALTY HAS BEEN ESTABLISHED BY STATE LAW FOR SUCH OFFENSE, THE PENALTY SHALL, BE THAT FIXED BY STATE LAW, AND FOR ANY OFFENSE WHICH IS A VIOLATION OF PROVISION OF LAW THAT GOVERNS FIRE SAFETY, ZONING, OR PUBLIC HEALTH AND SANITATION, INCLUDING DUMPING OF REFUSE, THE PENALTY SHALL BE A FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY TBE~ CITY COUNCIL OF THF~ CITY OF COPPEIJ.~ TEXAS: SECTION 1. That the Code of Ordinances of the City of Coppell, Texas, be and the same is hereby amended by amending Chapter 15, Article 15-5, Section 15-5-2(23) in part to amend Appendix VII of the Uniform Fire Code, 1994 Edition, to read as follows: "Sec. 15-5-2 AMENDMENTS 23. APPENDIX VH, is hereby added to the Uniform Fire Code, 1994 Edition, to read as follows: "Appendix. VH - Automatic Sprinkler System Requirements. In addition to other sections of the 1994 Edition of the Uniform Fire Code, an approved automatic fire extinguishing system shall be installed in the occupancies and locations as set forth in this section. 1 SS4671 1. AH Buildings, 3 or morn stories or, 35 feet in height, or greater than 5,000 square feet, Excluding Group R, Division 3, Except for Group R, Division 3, any building or structure three or more stories or greater than thirty-five (35) feet in height; or any structure with a gross square footage greater than five thousand (5,000) square feet shall be equipped with an automatic fire sprinkler system. Any Group R, Division 3 buildings with a gross square footage greater than ten thousand (10,000) square feet shall be equipped with an automatic fire sprinkler system. EXCEPTION:t For all existing buildings regulated bF this code, cot automaHc .fire extin~ntishing system shall not be required regardless of the building's size, until the area of att3; new buildin~ addition exceeds 5,000 square feet. At such time when this additional area has been reached the entire building shall be equipped with an automatic fire extinguishing sFstem. " SECTION 2. That all ordinances and provisions of the Code of Ordinances of the City of Coppell, Texas in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That should any word, phrase, paragraph, section or portion of this ordinance, or of the Code of Ordinances, as amended hereby, be held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance, or of the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 4. An offense committed before the effective date of this ordinance is governed by the prior law and the provisions of the Code of Ordinances, as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. ~ Material added to the text appears in italic underlined print and material deleted from the text appears in strike,~ut print 2 ss4671 SECTION 5. That any person, firm, or corporation violating any of the provisions of this ordinance or the Code of Ordinances as amended hereby, shall be guilty of a misdemeanor and upon conviction in the Munidpal Court of the City of Coppell, Texas, shall be subject to a fine not to exceed the sum of Five Hundred Dollars ($500.00) for each offense, except where a different penalty has been estabfished by State law for such offense, the penalty shall be that fixed by State law, and for any offense which is a violation of any provision of law that governs fire safety, zoning or public health and sanitation, including dumping of refuse, the penalty shall be a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense; and each and every day such offense is continued shall constitute a new and separate offense. SECTION 6. That this ordinance shall become effective immediately fi'om and af[er its passage and the publication of the caption, as the law and charter in such cases provide.
