ORDINANCE NO. 204A1
AN O1RDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY, AS HERETOFORE AMENDED,
SO AS TO CHANGE THE ZONING CLASSIFICATION ON THE PROPERTY HERE-
INAFTER DESCRIBED AND DESIGNATED; PROVIDING A REPEALING CLAUSE:
PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF
THIS ORDINANCE NOT TO EXCEED THE SUM OF TWO HUNDRED DOLLARS
FOR EACH OFFENSE; AND DECLARING AN EFFECTIVE DATE.
WHEREAS, the Cit.v Zoning Commission of the City and the governing body
of the City, in compliance with the ]aws of the State of Texas with reference to the
granting of zoning changes under the zoning ordinance and zoning map, have ~iven
requisite notices by publication and otherwise, and have held due hearings that hove
afforded a full and fair hearing to all property owners a'enerol]y and to the persons
interested in the area and situated in the orea, 8nd
WHEi~EAS, the City Council is of the opinion that the zonin~ change set
herein on application of Coppe]] Cab]evision, Inc. sbou]c~ be grantec~ ~n~ in the exercise
of its legislative discretion the Comprehensive Zoning' Ordinance sho~dd be 8rnen~ec'
to reflect such change.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION ~. That the Comprehensive Zoning Ordinance of the City be, ~nc~
the same is hereby amended by amending the zoning map of the City, so as to ~ve
the following describeO property located within the c(~porate limits of tho ~itv. the
zoning distr]ct classification as hereinafter design&~e(!,:
Said tract to be changed from "R" Retail Zoning District Classification to "R"
Retail Zoning District Classification with a Special Use Permit for a Tower and
Receiving Station for operation of cable television.
Said tract being described as follows:
BEING a survey of a tract of l~nd of 0.~79 acres of ]and in the JA,¥ES
W. ANDERSON SURVEY Abst. No. ~.8, Dallas Country, Texas~ and being
in the City of Coppe]]; and being Dart of First and Second Tracts as
described in deed from W. E. Corbin, et. u×., to E. C. Gentrv d~.ted
9/~4/3]~, fi]ed 2/!5/32, D1RDCT; ~nd being more partieularl~ described
as follows:
COMMENCING at the SW corner of sai~ Anderson Survey;
THENCE East 707.7 feet;
THENCE N 01 deg. 04' 00" W, 30.0 feet to the POINT OF BEGINNING,
said beginning point being on the north line of Bethel School Road;
THENCE N 00 deg. 55' 00" ~A', ~_64.0 feet;
THENCE east 77.4 feet;
THENCE S 01 deg. 19' 00" W, ~64.0~ feet to a point in the north line
of Bethel School Road;
THENCE west along the north line line of said Road (30.0 feet north
of and parallel with said Road's centerline), 7].0~ feet to the POINT
OF BEGINNING and containing 0.279 acres (].2,!67 scuare feet~ of land.
Special Consideration: There shall be constructed and maintained along the
sides and rear of said proDerty a fence of chain link design or equal cua]itv which
will be at least six feet in height and maintained with inserts for screening purDoses.
SECTION 2. That all ordinances of the City in conflict with the p,ovision of
this ordinance be, and the same are hereby, repealed and all other ordinances of the
City not in conflict with the provisions of this ordinance shall remain in full force
and effect.
SECTION 3. That the above described proDert.v shall be ~sed only in the
manner and for the purposes provided for in the ComDrehensive Zoning Ordinance of
the City, as amended herein by the granting of this zoning classification.
SECTION 4. That should an.v Daragraph, sentence, subdivision, clause, Dhrase
or section of this ordinance be adjudged or held to be unconstitutional, illegal or
invalid, the same shall not affect the validity of this ordinance as a whole or any part
or provision thereof other than the part so decided to be invalid, illegal or uncon-
stitutional and shah not affect the validity of the Comprehensive Zoning Ordinance as
a whole.
SECTION 5. That any person, firm or corporation violatin~r any of the Drovisions
or terms of this ordinance shall be subject to the same pe~.edt.v as provided for in the
Comprehensive Zoning Ordinance of the City, as heretofore amended, and upon con-
viction shall be ptmished by fine not to exceed the sum of two hundred do]lets ($200.00)
for each offense, and that each day such violation sba]] continue to exist shall constitute
a separate offense.
SECTION 6. It is necessary to give the property described herein the above
mentioned zoning classification in order to permit its proper deve]oDment and in order
to protect the public interest, comfort end general welfare of the City. Therefore,
this ordinance shah take effect immediately from and after its Dassaffe and mlb]ie~tion
of its caption, as the ]aw in such cases provides.
