RE 02-28-95.1 A RESOLUTION OF THE CITY OF COPPELL, TEXAS RESOLUTION NO. 022895.1 ELECTION OF MUNICIPAL OFFICERS Coppell, Texas May 6, 1995 ELECTION ORDER BE IT REMEMBERED THAT on this 28TH day of February, 1995, at a meeting of the City Council of the City of Coppell, Texas, a quorum being present, the meeting was called to order and the Council issued the following order: IT IS ORDERED that an election be held in the City of Coppell, Texas, on the 6th day of May, 1995, the same being the first Saturday of said month, for the following purpose: To elect a Mayor for a two year term, one Councilmember for Place 2 for a two year term, one Councilmember for Place 4 for a two year term and one Councilmember for Place 6 for a two year term. The candidate for each such office receiving a majority of all votes cast for all candidates for such office shall be elected to serve such term or until his or her successor is duly elected and qualified. (CC5.06) In the event any candidate for any one of said offices falls to receive a majority of all votes cast for all the candidates for such office, a mn-off election shall be held. The polling place for said election shall be The Coppell City Hail, 255 Parkway Boulevard, Coppeil, Texas. The polls shall be open from 7:00 a.m. to 7:00 p.m. None but legally qualified voters of the City shall be entitled to vote at said election. Voting for both early voting and regular voting shall be by paper ballot. Notice of said election shall be published once in the official newspaper of the City not earlier than April 6, 1995, the 30th day before election day, and not later than April 26, 1995, the 10th day before election day. Such notice shall also be posted on the Bulletin Board used to publish notice of City Council Meetings not later than April 15, 1995, the 21st day before election day. (4.003) A copy of the published notice that contains the name of the newspaper and the date of publication shall be retained as a record of such notice, and the person posting the notice shall make a record at the time of posting stating the date and place of posting and deliver a copy of each notice posted to the Mayor of the City of Coppell after the last posting is made. (4.005 & 4.002) A Presiding Election Judge and an Alternate Presiding Election Judge shall be appointed to serve at said polling place by written resolution of the City Council of the City of Coppell, Texas. (32.005, 32.001) The Alternate Presiding Judge shall serve as Presiding Judge if the regularly appointed Presiding Judge cannot serve and where the election is conducted by the regularly appointed Judge, the Presiding Judge shall appoint the Alternate Presiding Judge as one of the Clerks. (32.001b, 32.032) An Early Voting Ballot Board is hereby created. (87.001) The Presiding Election Judge shall also serve as the Presiding Judge of the Early Voting Ballot Board. The other members of the Early Voting Ballot Board shall be appointed by the Presiding Judge in the same manner as the Presiding Election Judge appoints Election Clerks. (87.001-87.002) The Presiding Election Judge shall appoint two Election Clerks and as many additional Clerks as are necessary for the proper conduct of the election. Provided, however, 12 shall be the maximum number of Clerks which may be appointed to serve at said polling place. (32.033) All Judges and Clerks appointed by the Presiding Election Judge shall be qualified votem in the City. (32.051 c) The City Secretary of the City of Coppell shall be the Early Voting Clerk for said election (83.005). The period for early voting by personal appearance shall begin on April 17, 1995 and continue through May 2, 1995. The main early voting polling place shall be the regular office of the City Secretary located at the Coppell City Hall, 255 Parkway Boulevard, Coppell, Texas, where early voting by personal appearance shall be conducted on the weekdays of the early voting period and during the hours the City Secretary's main business office is regularly open for business. On the weekdays of the period of early voting the City Secretary's main business office shall be regularly open for business as follows: April 17, 1995, through April 21, 1995, during the hours of 8:00 a.m. to 5:00 p.m.; April 24, 1995, through April 28, 1995, during the hours of 7:00 a.m. to 7:00 p.m.; and May 1, 1995, through May 2, 1995. The City Secretary, as early voting clerk, is authorized by law to order in writing, voting by personal appearance on one or mom Saturdays or Sundays during the early voting period and if such order is made the days and times shall be included in the published and posted notice of this election. (85.006 b) The City Secretary may by written order appoint one or more of the City Secretary's permanent deputies as deputy early voting clerks. (83.032) After holding said election, the Presiding Election Judge shall promptly deliver the original of the election returns in person to the Mayor or if the Mayor is unavailable, to the City Secretary. (66.051, 66.001) The City Secretary shall present such returns to the City Council for the canvassing of said election. (66.051, 66.052) The canvass of said election returns shall be conducted by the City Council not earlier than the 2nd day nor later than the 6th day after the election. (67.003a, 67.001) The Presiding Election Judge shall be paid the sum of $ 6.00 per hour, plus an additional sum of $25.00 for services in delivering the returns of the election. The Alternate Presiding Election Judge shall be paid the sum of $ 6.00 -- per hour, and each Election Clerk shall be paid the sum of $ 6.00 per hour for their services in holding the election. Such payments shall not exceed the maximum amounts set out in the Texas Election Code, to-wit: $6.00 per hour for each election official, plus an additional amount paid to the Presiding Judge for delivering the returns, not to exceed $25.00.
