A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS,
DECLARING A MORATORIUM ON THE ISSUANCE OF BUILDING PERMITS FOR A
PERIOD OF SIXTY (60) DAYS ON TRACTS A1 AND A2 AS DESCRIBED IN ZONING
CASE NO. ZC-553(CH); PROVIDING FOR THE GRANTING OF EXCEPTIONS BY THE
CITY COUNCIL; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, Zoning Case ZC-553(CH) was called by the Planning and Zoning
Commission to consider recommendation of appropriate zoning on several tracts of land
lying generally on the east side of MacArthur Boulevard, north of the T.U. Electric right-of-
way line; and
WHEREAS, the Planning and Zoning Commission made its recommendation to
the City Council for a change of zoning on said tracts; and
WHEREAS, the City Council conducted a public hearing on Case ZC-553(CH) on
June 14, 1994, and partially ruled on the case, but took under advisement tracts A1 and
A2 until August 9, 1994; and
WHEREAS, the City Council desires to declare a moratorium to prevent
development thereon during the time appropriate zoning is being considered;
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. That a moratorium is hereby declared on the issuance of any
building permit for development on tracts A1 and A2, described in Exhibit "A" attached
hereto and made part hereof for all purposes, for a period of sixty (60) days from the
effective date hereof or until a final determination is made in Case ZC-553(CH) as to the
permanent zoning of said tracts by the City Council, whichever comes first.
SECTION 2. That the City Council may extend the length of the moratorium
by appropriate amendment of this resolution so long as the contemplated change of
zoning is still under advisement and being considered by the City Council.
SECTION 3. That any person, firm or corporation owning property
contained within the boundaries of tracts A1 or A2 may petition the City Council at any
time during the period of this moratorium for a special exception to allow issuance of a
building permit. Any such application will be placed on the next following City Council
agenda, provided it is filed in time to be processed for such agenda in the usual manner
in which agenda items are established.
