RE 05-11-93.1 A RESOLUTION OF THE CITY OF COPPELL, TEXAS RESOLUTION NO. 051193.1 RUNOFF ELECTION OF MUNICIPAL OFFICERS Coppell, Texas June 5, 1993 RUNOFF ELECTION ORDER BE IT REMEMBERED THAT on this llth day of May, 1993, at a meeting of the City Council of the City of Coppell, Texas, a quorum being present, the meeting was called to order and the Council issued the following order: WHEREAS, at the election held in the City of Coppell, Texas, on May 1, 1993, no candidate received a majority of all votes cast for all candidates for the office of Councilmember Place 2, making it necessary to hold a runoff election for such office, and; WHEREAS, it appearing that Flo McFadden Stably and Walter Pettijohn were the two candidates receiving the highest number of votes for the office of Councilmember Place 2, NOW THEREFORE, IT IS ORDERED that a runoff election be held in the City of Coppell, Texas, on the 5th day of June, 1993. (2.025 EC2.022) Candidates Flo McFadden Stahly and Walter Pettijohn shall be entitled to have their names printed on the ballot for the office of Councilmember Place 2, and no other names shall be permitted on the ballot for such office and no write-in votes shall be permitted. The candidate who receives the highest number of votes for the office shall be elected to such office for a term of two years. The polling place for said election shall be The Coppell City Hall, 255 Parkway Boulevard, Coppell, Texas. The polls shall be open from 7:00 a.m. to 7:00 p.m. None but legally qualified voters of the City shall be entitled to vote at said election. Notice of said election shall be published once in the official newspaper of the City not later than May 25, 1993, the same being a date not later than the 10th day before said election day. (4.003al) Notice of said election shall also be posted on the Bulletin Board used to publish notice of City Council meetings not later than May 20, 1993, the same being a date not later than the 15th day before said election day. (2.026) A copy of the published notice that contains the name of the newspaper and the date of publication shall be retained as a record of such notice, and the person posting the notice shall make a record at the time of posting stating the date and place of posting and deliver a copy of each notice posted to the Mayor of the City of Coppell after the last posting is made. (4.005 & 4.002) The same Presiding Election Judge and Alternate Presiding Election Judge appointed to serve at the election held on May 1, 1993, shall serve as the election officials to conduct this runoff election. The Alternate Presiding Judge shall serve as Presiding Judge if the regularly appointed Presiding Judge cannot serve and where the election is conducted by the regularly appointed Judge, the Presiding Judge shall appoint the Alternate Presiding Judge as one of the Clerks. (32.001b, 32.032) If the regularly appointed Alternate Judge cannot serve a substitute replacement may be appointed by order signed by a majority of the members of the City Council which said order need not be recorded in the minutes of a meeting of the City Council. (32.005, 32.008) An Early Voting Ballot Board is hereby created. (87.001) The Presiding Election Judge shall also serve as the Presiding Judge of the Early Voting Ballot Board. The other members of the Early Voting Ballot Board shall be appointed by the Presiding Judge in the same manner as the Presiding Election Judge appoints Election Clerks. (87.001-87.002) The Presiding Election Judge shall appoint two Election Clerks and as many additional Clerks as are necessary for the proper conduct of the election. Provided, however, 10 shall be the maximum number of Clerks which may be appointed to serve at said polling place. (32.033) All Judges and Clerks appointed by the Presiding Election Judge shall be qualified voters in the City. (32.051 c) The City Secretary of the City of Coppell shall be the Early Voting Clerk for said election (83.005). The period for early voting by personal appearance shall begin on Monday May 17, 1993 and continue through June 1, 1993. Early voting for the above designated election shall be held at the regular office of the City Secretary at the City Hall Building, Coppell, Texas, and said place of early voting shall remain open on each day of early voting which is not a Saturday, Sunday or a legal state holiday. Said place of early voting shall remain open on the weekdays of the early voting period and during the hours the City Secretary's office is regularly open for business. (85.005) The City Secretary may by written order appoint one or more of the City Secretary's permanent deputies as deputy early voting clerks. (83.032) After holding said election, the Presiding Election Judge shall promptly deliver the original of the election returns in person to the Mayor or if the Mayor is unavailable, to the City Secretary. (66.051, 66.001) The City Secretary shall present such returns to the City Council for the canvassing of said election. (66.051, 66.052) The canvass of said election returns shall be conducted by the City Council not earlier than the 2nd day nor later than the 6th day after the election. (67.003a, 67.001) The Presiding Election Judge shall be paid the sum of $5.00 per hour, plus an additional sum of $25,00 for services in delivering the returns of the election. The Alternate Presiding Election Judge shall be paid the sum of $5.00 per hour, and each Election Clerk shall be paid the sum of $5,00 per hour for their services in holding the election. Such payments shall not exceed the maximum amounts set out in the Texas Election Code, to-wit: $5.00 per hour for each election official, plus an additional amount paid to the Presiding Judge for delivering the returns, not to exceed $25.00. The address of the Alternate Presiding Judge named above is 217 Simmons, Coppell, Texas 75019 A copy of this order of appointment together with a copy of the order calling the election shall be delivered to the above appointed officer.
