CIVIL SERVICE ELECTION

BE IT REMEMBERED THAT on this 26th day of March, 1991, at
a meeting of the City Council of the City of Coppell, Texas, a
quorum being present, the meeting was called to order and the
Council issued the following order:
WHEREAS, on February 11, 1991, a petition (the "Petition") was
presented to the Mayor and City Council of the City of Coppell
requesting that the City Council order an election submitting to
the voters of the City the question of whether the City of Coppell
should adopt the fire fighters' and police officers' civil service
law that is permitted to be adopted by municipalities having a
population of more than 10,000, pursuant to Chapter 143 of the
Local Government Code; and
WHEREAS, said petition was properly verified and found to be
signed by at least the number of signatures necessary to require
the calling of an election on the proposition; and
WHEI~AS, the City Council on March 12, 1991, pursuant to
reports that the Federal Census had determined that Coppell has a
population more than 10,000, issued an order calling for the
election to be held on May 4, 1991; and
WHEREAS, the above mentioned civil Service Statute applies
only to a municipality that has a population of 10,000 or more; and
WHEP~EAS, the City Attorney has informed the City Council that
he has discovered a State Statute, dealing with the date of
official notice of the Federal Decennial Census that prohibits the
City from acting upon any report or publication of the Federal
Census before the first day of September of the year immediately
following the calendar year during which such census is taken and
that in his opinion such limitation would affect the validity of
the Civil Service Election if it were to be held on May 4, 1991.
That said statute reads as follows:

was ~ken.
NOW, THEREFORE, IT IS ORDERED AND RESOLVED BY THE CITY COUNCIL
OF THE CITY OF COPPELL, TEXAS that the call for the Civil Service
Election heretofore ordered to be held in the City of Coppell,
Texas, on the 4th day of May, 1991, is hereby rescinded, canceled
and repealed and that said election will shall not be held on that
May 4, 1991.
The City Secretary is hereby directed to return the petition
to the party filing the same, together with a copy of this
resolution advising that said petition may be again filed any time
after September 1, 1991, and that although the names of the persons
signing the petition will have to be recertified, the same petition
may be filed after September 1, 1991, together with any additional
newly signed petitions.
