RE 08-27-91.1 RESOLUTION 082791.1 W~EREAS, the called session(s) of the 72nd Texas Legislature convened on July 15, 1991; and WHEREAS, many legislative issues affecting local government will be considered; and WHEREAS, many cities across the State are plagued by problems of public safety and diminished economic development because of the inability to regulate possession of open alcoholic beverage containers in public places; and WHEREAS, State law, pursuant to the Texas Alcoholic Beverage Code, appears to preempt local regulation of possession of open alcoholic beverage containers; and WHEREAS, the City of Coppell would prefer that municipalities be allowed to regulate possession of open alcoholic beverage containers within certain designated areas of the municipality; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL: SECTION 1. The the City Council of the City of Coppell support passage of legislation in the Texas Legislature which would allow home rule municipalities to regulate possession of open alcoholic beverage containers within designed portions of a city. SECTION 2. That the City Manager/City Attorney is directed to communicate the purpose of this resolution to members of the Texas Legislature and the Governor. SECTION 3. That the City Council of the City of Coppell requests the Governor to add this issue of home-rule authority to the agenda of the called sesslon(s) of the 72nd Legislature. SECTION 4. That this resolution shall take effect immediately from and after its passage in accordance with the provisions of the Charter of the City of Coppell and it is accordingly so resolved.
