OR 96-761 Adopts sales tax to construct an aquatic & recreation facility AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 96761 SALES TAX ELECTION Coppell, Texas, May 4, 1996 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, CANVASSING THE RETURNS OF AN ELECTION FOR THE ADOPTION OF AN ADDITIONAL SALES AND USE TAX WITHIN THE CITY AT THE RATE OF ONE-HALF OF ONE PERCENT TO CONSTRUCT AND DEVELOP AN ALL-SEASON AQUATIC FACILITY, A COMMUNITY MULTI-PURPOSE RECREATION FACILITY. A NEW ATHLETIC COMPLEX, AND THE FIRST PHASE OF A HIKE AND BIKE TRAIL SYSTEM, SAID ADDITIONAL SALES AND USE TAX TO TERMINATE UPON THE PAYMENT AND RETIREMENT OF BONDS AND OBLIGATIONS NOT TO EXCEED TWENTY (20) YEARS FROM THE ISSUANCE OF SAID BONDS OR OBLIGATIONS, PURSUANT TO SECTION 4B OF THE DEVELOPMENT CORPORATION ACT OF 1979. ARTICLE 5190.6. TEXAS REVISED CIVIL STATUTES; ORDERING THAT SAID TAXES BE IMPOSED: INSTRUCTING THE CITY SECRETARY TO FORWARD CERTIFIED COPY OF THIS ORDINANCE TO THE COMPTROLLER OF PUBLIC ACCOUNTS AND ESTABLISHING AN EFFECTIVE DATE. BE IT REMEMBERED THAT on this the 9 <"~day of May, 1996, at a meeting of the City Council of the City of Coppell, Texas. a quorum being present. the meeting was called to order and the following business was transacted. Upon motion of Councilmember ,L fl.Jd,~l}/ //fl, YO and seconded by Councilmember CL ,4AJ/7/ --.R//E'K~'///I,d. it was unanimously ordered that the City Council consider the official returns of an election held in the city on May 4. 1996. tk~r the adoption of an additional sales and use tax within the city at the rate of one-half of one percent AGG0851B to construct and develop an all-season aquatic facility, a community multi-purpose recreation facility, a new athletic complex, and the first phase of a hike and bike trail system, said additional sales and use tax to terminate upon the payment and retirement of bonds and obligations not to exceed twenty (20) years from the issuance of said bonds or obligations, pursuant to Section 4B of the Development Corporation Act of 1979, Article 5190.6, Texas Revised Civil Statutes. WHEREUPON said official returns were opened, examined, canvassed and the results declared as follows: CANVASS OF RETURNS AND DECLARATION OF RESULTS WHEREAS, there was held an election in the City of Coppell, Texas, on May 4, 1996, on the question of the adoption of an additional sales and use tax within the city at the rate of one-half of one percent to construct and develop an all-season aquatic facility, a community multi-purpose recreation facility, a new athletic complex, and the first phase of a hike and bike trail system, said additional sales and use tax to terminate upon the payment and retirement of bonds and obligations not to exceed twenty (20) years from the issuance of said bonds or obligations, pursuant to Section 4B of the Development Corporation Act of 1979, Article 5190.6, Texas Revised Civil Statutes: and, WHEREAS, immediately after said election the Presiding Judge and other officials holding said election made their returns of the results thereof to the City Council as follows, and said returns being made according to law, and duly authenticated, and it being shown that written notice of said election was given for the time and in the manner provided by law, and all other proceedings pertaining to said election having been shown to have been done and performed at and within the manner provided by law, and all papers pertaining thereto having been returned and filed with the City Council and it appearing that said election was in all respects legally held and that said retums were duly and legally made and no protest or objection being made to or regarding any matter pertaining to said election: NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That after examining said returns and opening and canvassing the votes of said election, the result of said election in regard to Proposition Number I is as follows: PROPOSITION NUMBER 1 The adoption of an additional sales and use tax within the city at the rate of one-half of one percent to construct and develop an ail-season aquatic facility, a community multi- purpose recreation facility, a new athletic complex, and the first phase of a hike and bike trail system, said additional sales and use tax to terminate upon the payment and retirement of bonds and obligations not to exceed twenty (20) years from the issuance of said bonds or obligations, pursuant to Section 4B of the Development Corporation Act of 1979, Article 5190.6, Texas Revised Civil Statutes. That there were cast at said election 1655 total votes of which 891 votes were cast FOR the adoption of Proposition Number 1, and 764 votes were cast AGAINST the adoption of Proposition Number 1. A majority of the qualified voters having voted FOR the adoption of an additional sales and use tax within the city at the rate of one-half of one percent to construct and develop an all- season aquatic facility, a community multi-purpose recreation facility, a new athletic complex, and the first phase of a hike and bike trail system, said additional sales and use tax to terminate upon the payment and retirement of bonds and obligations not to exceed twenty (20) years from the issuance of said bonds or obligations, pursuant to Section 4B of the Development Corporation Act of 1979, Article 5190.6, Texas Revised Civil Statutes, said proposition is declared approved and said tax is hereby imposed in the City of Coppell, Texas, pursuant to Section 321.404 of the Texas Tax Code, and shall become effective as provided by law, and the City Secretary is hereby instructed to forward to the Comptroller of Public Accounts, State Capital, Austin, Texas, by registered or certified mail a certified copy of this ordinance. SECTION 2. That this canvass and declaration of results of said election be entered in the Minutes of the City Council. SECTION 3. This ordinance shall take effect immediately upon its passage as provided by the chattel' of this City and the laws of the State of Texas.
