RE 07-24-90.1 A RESOLUTION OF THE CITY OF COPPELL, TEXAS EESOLUTION NO. 072490.1 A RESOLUTION OF THE CITY OF COPPELL, TEXAS, ENCOURAGING THE TEXAS ALCOHOLIC BEVERAGE COMMISSION TO CONSIDER ALL THE FACTS SURROUNDING THE COMPLAINT AGAINST GASPAR'S RESTAURANT, IN THE CITY OF COPPELL, TEXAS. WHEREAS, Gaspar's Restaurant has just celebrated its first year anniversary as one of the community's first fine dining restaurants and has attracted visitors to our City from the Metroplex, the State of Texas, other states, and foreign countries; and, WHEREAS, the owners of said restaurant are a local Coppell family that have spent their savings to open a quality dining establishment in our community and have become very active in community affairs, the local Chamber of Commerce, etc.; and, WHEREAS, due to the culinary expertise and quality of the preparation of dishes, many foods are cooked with wine, and therefore, cooking wine has been in use since the opening of the restaurant; and, WHEREAS, after conferring with authoritative sources, said restaurant began offering complimentary wine upon request with no increase in menu prices; and, WHEREAS, either one individual or one extremely small group of Coppell citizens apparently have filed a protest with the only apparent reason being their opposition to the presence of alcoholic beverages within our community; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the entire City Council is concerned and wishes for clarification of the Attorney General of Texas Opinion Number C-421 dated April 13, 1965. The word "opinion," which seems to have no accompsnying statute, appears to have suddenly been revived in an apparent orchestrated maneuver against Gaspar's restaurant. If an in depth study was done of restaurants in other "dry" areas of Dallas county, it may be ascertained that a similar practice has been, or is currently being done, by other restaurants, with no action being taken against them. If this opinion is to be law in this state, then our City Council respectfully requests that entities such as restaurant trade associations and state a~d local agencies be made fully aware of this interpretation. SECTION 2. That the Coppell City Council encourages the Texas Alcoholic Beverage Commission to consider the facts, including, but not limited to, the apparent erroneous information that said restaurant received from local agencies and the apparent political harassment by a few against the restaurant. That the City Council highly respects this State's appointed commission and believes it has done a wonderful job of protecting and serving the State of Texas. That we have every reason to believe that the Texas Alcoholic Beverage Commission will be very fair and forthright in their decision after hearings on this issue. SECTION 3.
