RE 03-13-90.2 A RESOLUTION OF THE CITY OF COPPELL, TEXAS RESOLUTION NO. 031390.2 ESTABLISHING A CAPITAL IMPROVEMENTS ADVISORY COMMITTEE UNDER THE PROVISIONS OF SENATE BILL 336 WHEREAS, Senate Bill 336 was passed the Texas Legislature in June 1987 (now Chapter 395, Local Government Code) to provide a method for municipal ities to impose impact fees for recouping the cost of off-site capital improvements necessitated by new development; and WHEREAS, as part of provisions of Chapter 395, a Capital Improvements Advisory Committee is required to be established to advise and assist in the implementation of the impact fee process; and WHEREAS, the Committee's responsibilities require input at every stage of implementation of Chapter 395; NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL: SECTION 1. The Planning and Zoning Commission is hereby appointed to serve as members of the Capital Improvements Advisory Committee. In the event the Planning and Zoning Commission ceases to have as one of it's members a person who is a representative of the real estate, development, or building industries, the City Council will appoint an additional ad hoc voting member of the Planning and Zoning Commission to serve when it acts as the Capital improvements Advisory Committee who is not an employee or official of the City. SECTION 2. The membership of the Capital Improvements Advisory Committee will serve in an advisory capacity and perform the duties and responsibilities provided in section 395.058 (c) of the Local Government Code.
