ORDINANCE NO. 91500-A-429
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS,
AMENDING THE CODE OF ORDINANCES BY AMENDING CHAPTER
12, COMPREHENSIVE ZONING ORDINANCE, DELETING SECTIONS
12-24-6.4 AND 12-24-6.5 IN THEIR ENTIRETY AND RENUMBERING
ACCORDINGLY; PROVIDING FOR THE ELIMINATION OF THE
REQUIREMENT FOR AN ARCHITECTURAL REVIEW BOARD AND A
MERCHANTS ASSOCIATIONS IN THE TC (TOWN CENTER)
DISTRICT, PROVIDING A REPEALING CLAUSE; PROVIDING A
SEVERABILITY CLAUSE; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the requirement for an Architectural Review Board and the Merchants
Association in the Town Center area were established as part of private deed restrictions that were
placed on this property; and
WHEREAS, these provisions of the deed restrictions expired after twenty years, which was
in 2002; and
WHEREAS, The Town Center area is essentially built-out, and
WHEREAS, after review of the Planning and Zoning Commission's recommendation,
the City Council is of the opinion that Section 12-24-6.4 and 6.5 of the Comprehensive Zoning
Ordinance should be deleted;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF COPPELL, TEXAS;
SECTION 1. That the Comprehensive Zoning Ordinance of the City of Coppell, Texas,
be, and the same is, hereby amended by the deletion of Sections 12-24-6.4 and 12-24-6.5 in their
entirety and renumbering accordingly, which shall read as follows:
"Sec. 12-24-6. Special conditions.

4. Screening of mechanical equipment, patio and balconies and refuse
facilities in townhouse or multi-family type construction shall confirm to
the respective districts."
SECTION 2. That all provisions of the Ordinances of the City of Coppell, Texas, in
conflict with the provisions of this ordinance be, and the same are hereby repealed, and all other
provisions of the Ordinances of the City not in conflict with the provisions of this ordinance shall
remain in full force and effect.
SECTION 3. That should any word, sentence, paragraph, subdivision, clause, phrase or
section of this ordinance, or of the Code of Ordinances, as amended hereby, be adjudged or held to
be void or unconstitutional, the same shall not affect the validity of the remaining portions of said
ordinance or the Code of Ordinances, as amended hereby, which shall remain in full force and
effect.
SECTION 4. That this ordinance shall take effect immediately from and after its passage
as the law and charter in such cases provide.
