RE 2006-0822.2 RESOLUTION NO. 2006-0822.2 A RESOLUTION OF THE CITY OF COPPELL, TEXAS, AUTHORIZING THE CITY MANAGER TO EXECUTE A LEASE OR RENTAL AGREEMENT FOR THE RENTAL OF ONE OR MORE HART INTERCIVIC “SYSTEM 5” VOTING SYSTEM OR OTHER APPROVED ACCESSIBLE VOTING SYSTEM FROM THE COUNTY OF DENTON OR OTHER QUALIFIED PROVIDERS TO BE PROVIDED IN EACH POLLING PLACE IN EVERY LOCATION USED TO CONDUCT ANY GENERAL OR SPECIAL ELECTION ORDERED ON OR AFTER JANUARY 1, 2006; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, Section 61.012 of the Texas Election Code requires that the City must provide at least one accessible voting system in each polling place used in a Texas election on or after January 1, 2006; and WHEREAS, said system must comply with state and federal laws setting the requirements for voting systems that permit voters with physical disabilities to cast a secret ballot; and WHEREAS, the Office of the Texas Secretary of State has certified that the Hart Intercivic “System 5” Voting System and Software as an accessible voting system (hereinafter “AVS”) that may legally be used in Texas elections; and WHEREAS, Sections 123.032 and 123.035 of the Texas Election Code authorized the acquisition of voting systems by local political subdivisions and further mandate certain minimum requirements for contracts relating to the acquisition of such voting systems; and WHEREAS, the City Council has determined that the City of Coppell shall lease or rent from the County of Denton at least one Hart Intercivic “System 5” Voting System to be placed in each polling place in every location within Denton County used to conduct its election; NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, THAT : SECTION 1. The City Council of the City of Coppell hereby authorizes the City Manager to execute a lease or rental agreement for the rental of one or more Hart Intercivic “System 5” Voting System or other approved AVS from the County of Denton or other qualified providers to be provided in each polling place in every location used to conduct any general or special election ordered on or after January 1, 2006 by the City, as required in accordance with State law.
