RE 02-10-87.2 RESOLUTION NO. 021087.2 RESOLUTION AGREEING TO ADDITION OF LAND TO DENTON COUNTY ROAD UTILITY DISTRICT NO. 1, APPROVING PRELIMINARY PLANS, AND AGREEING TO ACCEPT CONVEYANCE OF FACILITIES AND RESPONSIBILITY OF MAINTENANCE THE STATE OF TEXAS COUNTY OF DALLAS CITY OF COPPELL The City Council of the City of Coppell met in regular session, open to the public, after due notice, at its regular meeting place on the ~0~- day of February, 1987; whereupon the roll was called of the members of the City Council, to-wit: Mayor Lou Dugqan Mayor Pro Tem Dale Ware Councilman Jim Cowman Councilman Tom Morton Councilman Bill Smothermon Councilman Dan Stanton Councilman Dean Wilkerson Councilman Mark Wolfe All members of the City Council were present except: WHEREUPON, among other business conducted by the City Council, Councilman ~ introduced the Resolution set out below and moved its adoption, which motion was seconded by Councilman ~oWn+on , and, after full discussion and the ques- tion being put to the City Council, said Resolution was carried by the following vote: "Aye" "No" Mayor Pro Tem Dale Ware Councilman Jim Cowman Councilman Tom Morton Councilman Bill Smothermon Councilman Dan Stanton Councilman Dean Wilkerson Councilman Mark Wolfe WHEREAS, Denton County Road Utility District No. 1 (the "District") was organized, created and established pursuant to Article 6674r-1, Vernon's Texas Civil Statutes, as amended, and Article III, Section 52 of the Constitution of Texas and was confirmed at an election held for such purpose within and for the said District on November 22, 1987; WHEREAS, Article 6674r-1, §33.1, Vernon's Texas Civil Statues, as amended, provides that an owner of land contiguous to a road utility district may petition that district's board of directors requesting the inclusion of such land within the said district; WHEREAS, the City Council of the City of Coppell has re- ceived notice that a petition to add land will be submitted to the Board of Directors of Denton County Road Utility District No. 1 on or about February 15, 1987; WHEREAS, Exhibit "A" attached hereto describes the land to be added to the District, Exhibit "B" attached hereto contains preliminary plans for proposed road system and drainage system facilities to be purchased, constructed or otherwise acquired by the District, which facilities (referred to in the preliminary plans as "Denton Tap Road West Lanes") are eligible upon completion to be conveyed to, and to be thereafter maintained by, the City of Coppell, and Exhibit "C" attached hereto contains preliminary plans for proposed road system and drainage system facilities to be purchased, constructed or otherwise acquired by the District, which facilities (referred to in the preliminary plans as "Spine Road West of Denton Tap Road") are eligible upon RESOLUTION AGREEING TO ADDITION OF LAND PAGE 2 completion to be conveyed to, and to be thereafter maintained by the State Department of Highways and Public Transportation; WHEREAS, action by the District on the said petition will be subject to review and approval of the petition and the preliminary plans by the State Highway and Public Transportation Commission pursuant to Article 6674r-1, ~33.1, Vernon's Texas Civil Statutes, as amended; IT IS, THEREFORE, RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL THAT: The City Council of Coppell, Texas acknowledges that it has received and reviewed descriptions attached hereto of land to be added to Denton County Road Utility District No. 1 and does hereby agree to such addition of land, and the City Council has received and reviewed and does hereby approve so much of the preliminary plans attached hereto as relate to certain road system and drainage system facilities designated therein to be conveyed to the City of Coppell upon purchase, construction or other acquisition by the said District; II. This Resolution shall additionally serve as notification to the appropriate governmental agencies that the City of Coppell hereby agrees to accept a conveyance of the said facilities on acquisition or on completion of construction or improvements by Denton County Road Utility District No. 1 as set out in the RESOLUTION AGREEING TO ADDITION OF LAND PAGE 3 preliminary plans, and the City of Coppell agrees to accept the responsibilities for maintaining the said facilities. III. The Mayor is authorized to execute and the City Secretary is authorized to attest this Resolution on behalf of the City Council and to do all things necessary and proper to carry out the purposes and intent hereof.
