RE 12-16-86.1RESOLUTION NO. 121686.1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPRLL, TEXAS, DETERMINING THE NECESSITY OF ACQUIRING FEE SIMPY.~ TITLE TO A TRACT OF 3.0774 ACRES FOR A GROUND WATER STORAGE TANK AND FOR A 20" EASEMENT FOR WATER LINES WITHIN THE CITY OF COPPELL, DALLAS COUNTY, TEXAS. BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL TEXAS: SECTION 1. The City Council of the City of Coppell, Texas, hereby determines that a public necessity exists that requires the acquisition of 3.0774 acre tract of land, more or less, for the purpose of providing the city with a site for a ground water storage site, said 3.0774 acres of land being more particularly described in Exhibit "A" a copy of which is attached hereto and incorpor~tea herein. SECTION 2. The City Council of the City of Coppell, Texas, also hereby determines that a public necessity exists that requires the acquisition of a 20' easement for a water line alonq the east boundary of owner's tract of land, said easement being more particularly described in Exhibit "B" which is attached hereto and incorporated herein. SECTION 3. That for the purDoses of acquirinq said tract and easement, and belie~,inq that the sum of money hereinafter set forth reDre~ents a fair cash market value of said tract and full damages leQally allowable by law, Frank Trando, Acting City Manager, is hereby authorized and is hereby emDowered to offer the property owner the sum of $ 3.25 for the necessary Deed to said approximate 3 acre tra~t and the sum of $ 0.81¢ for the 20 ft. easement described herein, if not then proceed with condemnation of land for the construction of a ground storaqe facility. SECTION 4. The City Manager is further authorized to make a tender of said offer in person to said owners, if said owners can be located in the City of Coppell, but if not, then said tender offer shall be made by certified mail, return receipt requested, addressed to said owners ~' ~ their last known mailing address. SECTION 5. That the City Manager and the City Attorney are authorized to comply with the statutes of the State of Texas with reference to the necessary legal prerequisites existing in or relating to the the exercise of eminent domain to appropriate said tracts for the purposes of acquiring a site for a ground water storage facility for the City of Coppell, Texas, and to exercise eminent domain to appropriate said easement, both tracts to be considered jointly or as individual tracts for the purpose of eminent domain procedure. SECTION 6. That the Owners or parties claiming an interest in the hereinbefore described property are RIVERC~IASE JOINT VENTURE by Terra Land Development Co., Venture Manager, whose maiting address is Two Lincoln Centre, Suite 1370, 5420 L.B.J.
