RE 2006-1115.1 Canvass Resolution RESOLUTION NO. 2006-1115.1 LOCAL OPTION AND CHARTER AMENDMENT ELECTION Coppell, Texas NOVEMBER 7, 2006 CANVASS OF RETURNS AND DECLARATION OF RESULTS OF LOCAL OPTION AND SPECIAL ELECTION th BE IT REMEMBERED THAT on this the 15 day of November, 2006, at a meeting of the City Council of the City of Coppell, Texas, a quorum, pursuant to § 67.004(a) of the T EXAS EC, being present, the meeting was called to order and the following business was LECTION ODE transacted. Upon motion it was unanimously ordered that the City Council consider the official returns of an election held in the City on November 7, 2006, for the local option and charter amendment special election. WHEREUPON said official returns were opened, examined, canvassed and the results declared as follows: CANVASS OF RETURNS AND DECLARATION OF RESULTS WHEREAS , heretofore, the City Council of the City of Coppell, Texas, called a local option election under the TABC and TEC and EXAS LCOHOL EVERAGE ODEEXAS LECTION ODE charter amendment special election to be held in the City on November 7, 2006, to submit to the voters the following propositions: “Shall the City of Coppell permit the legal sale of beer and wine for off-premise consumption only?” and ___________________________________ Canvass of Returns and Declaration of Results of Election - Page 1 71656 “Shall the City of Coppell permit the legal sale of mixed beverages in restaurants by food and beverage certificate holders only? and “Whether or not to adopt an amendment to the Home Rule Charter of the City of Coppell by adding Section 11.22 to regulate the sell of liquor or beer in residential areas, to regulate the hours when beer may be sold and to regulate alcoholic beverages as permitted by state law.” WHEREAS , immediately after said election the Presiding Judge and other officials holding said election made their returns of the results thereof to the City Council as follows, and said returns being made according to law, and duly authenticated, and it being shown that written notice of said elections were posted for the time and in the manner provided by law, and all other proceedings pertaining to said election having been shown to have been done and performed at and within the manner provided by law, and all papers pertaining thereto having been returned and filed with the City Council and no protest or objection being made to or regarding any matter pertaining to said election. NOW, THEREFORE , be it resolved by the City Council of the City of Coppell, Texas, after examining said returns and opening and canvassing the votes of said election, that the results of said local option election and special election are as follows: Proposition That the following number of votes were cast in the local option election, No. 1,“The legal sale of beer and wine for off-premise consumption only?” EARLY ELECTION DAY TOTAL VOTES VOTES VOTES FOR 3290 3527 6817 AGAINST 1452 1792 3244 It appearing that a majority of all votes cast for Proposition No. 1 were in favor of said proposition, Proposition No. 1 is hereby declared to be passed and approved. ___________________________________ Canvass of Returns and Declaration of Results of Election - Page 2 71656 Proposition That the following number of votes were cast in the local option election, No. 2,“The legal sale of mixed beverages in restaurants by food and beverage certificate holders only?” EARLY ELECTION DAY TOTAL VOTES VOTES VOTES FOR 3651 4098 7749 AGAINST 1070 1184 2254 It appearing that a majority of all votes cast for Proposition No. 2 were in favor of said proposition, Proposition No. 2 is hereby declared to be passed and approved. That the following number of votes were cast in the special election for the following Proposition for amendments to the Home Rule Charter, to-wit: PROPOSITION “Whether or not to adopt an amendment to the Home Rule Charter of the City of Coppell by adding Section 11.22 to regulate the sell of liquor or beer in residential areas, to regulate the hours when beer may be sold and to regulate alcoholic beverages as permitted by state law.” EARLY ELECTION DAY TOTAL VOTES VOTES VOTES FOR 3612 3858 7470 AGAINST 1082 1302 2384 It appearing that a majority of all votes cast were in favor of the Proposition, said Proposition for the amendment to the Home Rule Charter is hereby declared be passed and adopted. IT IS FURTHER ORDERED that this canvass and declaration of results of said election shall be entered in the Minutes of the City Council and that the City Secretary shall ___________________________________ Canvass of Returns and Declaration of Results of Election - Page 3 71656 record in the office of the City Secretary, under the seal of the City, showing the approval by the qualified voters of the City ofCoppell, Texas. This Resolution, declaring the results of the general and special elections shall become effective immediately after its passage.
