RESOLUTION OF THE CITY OF COPPELL, TEXAS RESOLUTION NO. 100885.2 WHEREAS, Lomas and Nettleton and others are the owners of a tract of land lying north of the corporate limits of the City of Coppell, Texas; and WHEREAS, the City of Lewisville, Texas, has annexed all or a portion of said property, some of which is claimed by the City of Coppell, Texas, as a part of its extraterritorial jurisdiction; and WHEREAS, the City Council of the City of Coppe]], Texas, and the City Council of the City of Lewisville, Texas, wish to enter into an agreement apportioning the extraterritorial jurisdictional rights as between them and the disannexation and annexation of property so as to arrive at an agreed common boundary between said Cities; and WHEREAS, said property owners have indicated their intention to petition the City of Coppell to annex within the area; and WHEREAS, said agreement has been reduced to writing, a copy of which is attached hereto as Exhibit "1" and made a part hereof for all purposes. HOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the City Council of the City of Coppell, Texas, hereby approves the agreement attached hereto as Exhibit "1" and authorizes the Mayor of the City to execute the same for and on behalf of the City of Coppell, Texas. SECTION 2. That this resolution shall take effect immediately from and after its passage as the law in such cases provides. APPROVED: ATTEST: SECR RY AGREEMENT BETWEEN CITY OF LEWISVILLE AND CITY OF COPPELL WHEREAS, the City of Lewisville, Texas (hereinafter "Lewisville") has previously, pursuant to a request by the landowner to receive water or sewer services, annexed a tract of land described in Exhibit "A" attached hereto; and WHEREAS, the City of Coppell, Texas (hereinafter "Coppell") has previously claimed that a portion of the tract of land described in Exhibit "A" was within the Extraterritorial Jurisdiction (as defined in Article 970a of Vernon's Texas Code Annotated) of Coppell; and WHEREAS, in order to avoid the cost and uncertainty of litigation over the boundaries between Coppell and Lewisville and to set a new defined and established boundary between Lewisville and Coppell; NOW, THEREFORE, Coppell and Lewisville agree as follows: 1. Lewisville shall discontinue or disannex the property described in Exhibit "B" attached hereto so that the said property is no longer within the corporate boundaries of Lewisville. 2. Lewisville shall, following the action in paragraph 1 above, take all appropriate action necessary to release and disclaim and hereby releases and disclaims any right or claim to the Extraterritorial Jurisdiction over the property described in Exhibit "B" in favor of Coppell. 3. Coppell shall take all action necessary to release and disclaim and hereby releases and disclaims any right or claim to the Extraterritorial Jurisdiction over the land described in Exhibit "A", with the exception of the land described in Exhibit "B" in favor of Lewisville. Coppell hereby claims and asserts Extraterritorial Jurisdiction over the land in Exhibit "B". AGREEMENT PAGE 1 EXHIBIT No. I 4. Coppell agrees, if requested by the landowner, to annex the property described in Exhibit "B" and serve said property with utilities at a level compatible with the General Business Zoning currently applicable to the property. 5. Lewisville and Coppell further agree to align MacArthur Boulevard along the route generally described in Exhibit "C" attached hereto. Lewisville and Coppell shall insure that the right-of-way for MacArthur Boulevard is available so that MacArthur Boulevard may be constructed as soon as possible. 6. Coppell recognizes that Lewisville has previously approved the preliminary plans regarding construction of facilities within the property described in Exhibit "B" for the creation of Denton County Road Utility District No. 1 in accordance with Article 6742r-1, Vernon's Texas Code Annotated. Coppell concurs in this action of Lewisville and will accept the constructed facilities, providing that they are completed in accordance with the rules and regulations of Coppell. This Agreement is effective when signed by the Mayor of both Cities.
