RE 08-27-85 RESOLUTION Ol~ THE CITY OF COPPELL, TEXAS RESOLUTION NO. 082785 WHI~REAS, it being the opinion of a majority of the City Council of the City 1985, to authorize the Mayor to proceed with the acquisition of certain re~d property for the City; and WHEREAS, a procedural question has been raised in regard to such vote. NOW, THERF-FORE, be it resolved by the City Council of the City of Coppell, Texas: SECTION 1. That the Mayor of the City of Coppell, Texas, is authorized to take the following action, and to the extent such action has already been taken, the City Council does hereby ratify such action. A. To enter into a contract with Milton Scott Brown, Trustee, for the acquisition of a 10-acre tract of land to be acquired by the City for streets, rights- of-way, easements and such other uses as the City Council may from time to time direct. Said 10-acre tract being that shown on Exhibit "A" attached hereto and made a part hereof for all purposes. B. That the consideration to be paid by the City for such real property shall be cash in the sum of $660,000.00 and the trade of that certain tract of land shown on Exhibit "B" attached hereto for all purposes which said tract was acquired by the City for rights-of-way and easements and used by the City for easements and as a location of a pump station. Said pump station having since been abandoned. The City of Coppell to retain the right to maintain its sanitary sewer force main, as a 20-foot easement, and the City of Coppell-TRA 20-foot easement, both of which are shown on Exhibit "B" attached hereto. Said property also being burdened with a 16-inch Lone Star gas line along its south boundary line as shown on Exhibit "B," which if not a recorded easement is to be retained by the City as such to the extent necessary to permit Lone Star Gas Company to maintain such gas line. SECTION 2. The City Council finds, as determined by an appraisal obtained by the City, that the property being traded is not being traded for a consideration less than its fair market value. The City Council also finds that the trade of said tract as shown on Exhibit "B" is a trade within the meaning of subsection d of Article 5421c-12 V.A.C.S. in that it was originally acquired for the purpose of rights-of way and easements for utilities. The City Council further authorizes the Mayor of the City of Coppell to execute such instruments as are necessary to carry out the purchase of such property partly for cash and partly for trade or exchange as authorized by said sta(ute.
