RE 03-13-84.1 RESOLUTION NO. 031384.1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS, MAKING FINDINGS AS TO AND DESIGNATING ADDITIONAL AREAS OF THE CITY OF COPPELL AS ECONOMICALLY DEPRESSED AREAS FOR PURPOSES OF THE DEVELOPMENT CORPORATION ACT OF 1979; DESCRIBING THE CITY'S OVERALL REDEVELOPMENT OBJECTIVES; REQUESTING THE TEXAS ECONOMIC DEVELOPMENT COMMISSION TO APPROVE COMMERCIAL PROJECTS WITHIN SUCH AREAS; DESCRIBING THE TYPE OF PROJECTS FOR COMMERCIAL USES DESIRED AND AUTHORIZED BY THE CITY OF COPPELL; AND REPRESENTING THAT THE CITY COUNCIL WILL REVIEW ALL PROJECT DESCRIPTIONS WHEREAS, the City Council of the City of Coppell (the "City") on December 13, 1983 after giving proper notice of a public hearing pursuant to the Development Corporation Act of 1979, Article 5190.6, Vernon's Annotated Texas Civil Statutes, as amended (the "Act"), und the regxtlatioas (the "Regulations") promulgated by the Texas Economic Development Commission thereunder (Chapter 107, Title 10, Texas Administrative Code, as a~nended) designated certain areas of the City as economically depressed (the "Economically Depressed Areas") under and for the purposes of the Act and the Regulations; ~md WHEREAS, the City Council now believes it to be in the best interests of the City to designate additional areas of the City as Economically Depressed Areas; and WHEREAS, the City Council gave due and proper notice of a public hemring pursuant to the Act and the Regxtlations to be held on this date for the purpose of considering the designation of additional Economically Depressed Areas; and WHEREAS, the City Council has found that notice was properly posted and published as required by the Act and the Regulations, that the public hearing was held on this date in accordance with law, that the public was given the opportunity to be and was heard on the proposal submitted and that the City Council has given due and proper regard to the testimony presented; and WHEREAS, the City Council has found that areas of the City which are located to the north of the Dallas-Fort Worth Regional Airport, directly under the flight paths of incoming and outgoing jets, are unsuitable for residential development thereby creating an overabundance of non-residential property and making it difficult for the City to promote development in such areas; and WHEREAS, the City Council has determined und hereby finds that the following economically depressed conditioas exist within the areas described in Exhibit A attached hereto, designated in this Resolution as Economically Depressed Areas within the City of Coppell, to-wit: The Economically Depressed Areas contain the presence of a substantial number of substandard, slum, deteriorated or deteriorating structures or contains high relative rates of unemployment; and WHEREAS, the City Council, after the conduct of the said public hearing, finds and determines that the existence of such conditions stated above in the Economically Depressed Areas substantially impair or arrest the sound growth of the City of Coppell, or constitute an economic or social liability and are a menace to the public health, safety or welfare in their present eundition and use; and WHEREAS, the City presently has no specific plans for public improvements in the Economically Depressed Areas; WHEREAS, the City Council has further found and determined that the City of Coppell's economic base depends in substantial part on manufacturing and industrial activities, distribution of products in intrastate and interstate commerce, as well as various commercial activities, and that by virtue of the conditions recited the City of Coppell is experiencing a need for an increased tax base, increased commercial activities and a need for jobs of a character suitable for its unemployed population in order that the present and prospective right to gahfful employment and the general welfare of the people of the City might be realized, and that the provisions of the Act and Regulations will assist the City of Coppell in achieving these objectives in the Economically Depressed Areas, and that the availabihty of financing of projects for commercial uses ander the Act and the Regulations will contribute significantly to the alleviation of the economically depressed conditions foand to exist in the said Economically Depressed Areas established hereby. NOW, THEREFORE, BE [T RESOLVED BY THE CITY COUNCIL OF THE CITY OF COPPELL: Section 1. That the declarations, determinations and findings recited and declared in the preambles to this Resolution are hereby restated, repeated and incorporated herein as the current, proper and lawful declarations, determinations and findings of the City Council. Section 2. That the areas within the boundaries of the City of Coppell, conforming to the description and the map of the City attached hereto as Exhibit A are hereby designated as an Economically Depressed Areas under and for the purposes of the Act and the Regulations. Section 3. That the City Coancil requests the Texas Economic Development Commission to approve commercial projects for financing under the Act and the Regulations within said Economically Depressed Areas of the following types, to-wit: (a) offices and office complexes; (b) commercial facilities; (c) convention and related facilities; (d) hotel/motel and related facilities; and (e) other commercial activities contributing to revitalization of and providing services to residents located within and adiaeent to Economically Depressed Areas that will result in the improvement of the economically depressed conditions existing therein by adding additional employment and jobs thereto or by expanding the tax base thereof. O041. x Section 4. That the City Council represents that it will review all project descriptions for approval of specific projects for commercial uses in order to determine whether such projects ace consistent with the City's objectives for redevelopment and rehabilitation of the Economically Depressed Areas designated herein. Section 5. That this Resolution shall take effect immediately from and after its adoption. PASSED AND APPROVED BY THE CITY COUNCIL on this 13th day of March, 1984.
