A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS,
SETTING THE TERMS OF AN AGREEMENT BETWEEN THE CITIES OF COPPELL,
TEXAS AND GRAPEVINE, TEXAS, EOR MUTUAl, ASSISTANCE IN THE PROVISION
OF UTILITY SERVICES TO A DEFINED AREA BORDERING WITH THE CITY OF
GRAPEVINE, TEXAS.
WHEREAS, it has been found that a portion of the corporate limits between
the Cities of Coppell and Grapevine lies along the Dallas and Tarrant County boundary
line, and no physical delineation exists along such portion of said corporate limits; and,
WHEREAS, it has been found that the natural gravity flow of sewage collection
service within such surrounding area is eastward into the City of Coppell; and,
WHEREAS, it has been found that a sanitary sewer collection line of sufficient
capacity to serve a portion of the City of Grapevine presently exists within the City
of Coppeil within approximately 600 feet of said corporate limit; and,
WHEREAS, it has been found that the adequate provision of sanitary sewer
collection service to such area by the City of Grapevine would not be economically
feasible at this time based on the need generated by the amount of development within
such area; and,
WHEREAS, it has been found that the City of Grapevine has water distribution
facilities existing within the immediate area with sufficient capacity to serve a portion
of the City of Coppell; and,
WHEREAS, it has been found that the City of Coppell has neither water
distribution or water storage facilities within approximately 7,200 feet of said corporate
limits; and,
WHEREAS, it has been found that tim adequate provision of water distribution
service to such area by the City of Coppell would not be economically feasible at this
time based upon the need generated by the amount of development within such area;
and,
WHEREAS, it has been found that development has been proposed for the
immediate future within such area, said development lying within both the Cities of
Coppe]l and Grapevine; and,
WHEREAS, it has been found that it would be to the mutual benefit of both
cities to agree to mutually assist the provision of utility services to such area.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION i - It is agreed that when Connell Development Company, the present
owner of the property known as Airport Business Park, which is to be served under
this mutual assistance agreement, shall construct at its sole expense all lines and other
necessary improvements, both on site and off site, to connect with existing sewer
mains within the City of Coppeli and has paid to the City of Coppell as prorata charge
the amount of $400.00 per acre, the City of Coppell will allow to be provided, s~nitary
sewer collection service to that area of approximately 85 acres lying within the City
of Grapevine as indicated on Exhibit "A" attached and made a part hereto.
SECTION 2 - It is agreed that when Connell Development Company, shall
construct at its sole expense all lines and necessary improvements, both on site and
off site, necessary to connect with the City of Grapevine water distribution system
and has paid to the City of Grapevine a prorata charge in the amount of $400.00 per
acre, the City of Grapevine will allow to be provided, water distribution service to
that area of approximately 73 acres lying within the City of Coppell as indicated on
Exhibit "A" attached and made a part hereto.
SECTION 3 - It is agreed that the Cities of Coppell and Grapevine will develop
a method for exchange of information necessa~'y for adequate accounting and monthly
billing for water and sanitary sewer services for the respective areas, such method to
be acceptable to each City Council and approved by the City Manager of the City of
Grapevine and the City Administrator of the City of Coppell. Said monthly billing
shall be at such prevailing rate as shall be from time to time established by the city
furnishing such service.
SECTION 4 - The provisions of this agreement may be cancelled, changed or
modified by mutual agreement between the City of Grapevine and the City of Coppell
and the land area covered by this agreement may be expanded to include other areas
by mutual consent of both cities.
In the event the City of Grapevine shall hereafter determine that it is
economically and physically feasible for it to serve said area which lies within its
corporate limits with sewer service, it shall have the right to relieve the City of
Coppell from its obligation to serve such area, as may have been undertaken by this
agreement, and assume such service to the area. Provided, however, any cost of such
change over shall be at the expense of the City of Grapevine and not at the expense
of the City of Coppell.
In the event the City of Coppell shall hereafter determine that it is economically
and physically feasible for it to serve said area which lies within its corporate limits
with water service, it shall have the right to relieve the City of Grapevine from its
obligation to serve such area, as may have been undertaken by this agreement, and
assume such service to the area. Provided, however, any cost of such change over
shall be at the expense of the City of Coppell and not at the expense of the City of
Grapevine.
SECTION 5 - It is agreed that at some future date the two cities will provide
for an emergency interconnect between the water distribution systems of the two
cities, the date, place and manner of providing such interconnect to be determined by
mutual agreement between the two cities and approval by the City Manager and/or
City Administrator of each city.
SECTION 6 - This agreement shall become effective from and after the date
of its passage, except that it shall not become effective unless and until the passage
of a Resolution by the City Council of the City of Grapevine, Texas, agreeing to the
identical terms of this Resolution.
DULY PASSED AND RESOLVED by the City Council of the City of Coppell,
