AN ORDINANCE OF THE CITY OF COPPELL, TEXAS

AN ORDINANCE OF THE CITY OF COPPELL, TEXAS,
ABANDONING A PORTION OF RIVERCHASE DRIVE WEST OF
MACARTHURBOULEVARD, BEING FURTHER DESCRIBED IN EXHIBIT
"A", AND DEPICTED IN EXHIBIT "B" ATTACHED HERETO; PROVIDING
THAT SUCH ABANDONMENT SHALL BE THE INTEREST WHICH THE
CITY MAY LEGALLY AND LAWFULLY ABANDON; PROVIDING THAT
SAID ORDINANCE SHALL CONSTITUTE A QUITCLAIM DEED THAT
MAY BE RECORDED WITH THE COUNTY CLERK OF DALLAS
COUNTY, TEXAS; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of Coppell has determined that the portion
of Riverchase Drive west of MacArthur Boulevard being further described in Exhibit "A'
and depicted in Exhibit "B", is no longer needed for City services; and
WHEREAS, the City Council of the City of Coppell has determined that the interest
of the City and the public therein should be abandoned; and
WHEREAS, the City Council of the City of Coppell has determined that the City and
public have no need for such portion of Riverchase Drive west of MacArthur Boulevard,
and that the cost of keeping and maintaining such portion of Riverchase Drive west of
MacArthur is in excess of the fair market value of the City's interest in the portion of
Riverchase Drive west of MacArthur Boulevard being abandoned;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF COPPELL, TEXAS:
SECTION 1. That the City Council of the City of Coppell, Texas has
determined that the portion of Riverchase Drive being further described in Exhibit "A" and
depicted in Exhibit "B", attached hereto and made a part hereof for all purposes, is no
longer needed or necessary for public purposes and should be abandoned in favor of the
abutting property owner, Dallas Area Affordable Partners IV, L.P., a California Limited
Partnership.

SECTION 2. That the City of Coppell, Texas, hereby abandons all its right, title, and
interest in and to said portion of Riverchase Drive, and abandons, conveys, and relinquishes
all such public interest the City may have in and to said portion of Riverchase Drive to the
abutting property owners.
SECTION 3. That the City Council of the City of Coppell, Texas, has determined
that the cost of keeping and maintaining such portion of Riverchase Drive is in excess of the
fair market value of the City's interest in the portion of Riverchase Drive being abandoned.
SECTION 4. That the abandonment ordinance of the City's interest in said portion
of Riverchase Drive shall constitute a Quitclaim Deed in favor of the abutting property
owners, and a certified copy of the same may be filed in the Deed Records of Dallas
County, Texas, to indicate such abandonment.
SECTION 5. That the abandonment provided for herein shall extend only to the
public right, title and interest which the City of Coppell, Texas, may have in and to said
portion of Riverchase Drive, and shall be construed to extend only to such interests that the
governing body of the City of Coppell, Texas, may legally and lawfully abandon.
SECTION 6. That this ordinance shall become effective from and after its passage
as the law and charter in such cases provide.

ORTION OF RIVERCHASE DRI,
Being an abandonment of a tract of land situated in the City of Coppell, Dallas County,
Texas, out of the James Parrish Survey, Abstract No. 1139, the S.A. & M.G. Survey,
Abstract No. 1442, and the Singleton Thompson Survey, Abstract No. 1493, and being the
same tract of land dedicated as right-of-way by the Riverchase Drive Plat as recorded in
Volume 86090, Page 3527 of the Plat Records of Dallas County, Texas, and being more
particularly described by metes and bounds as follows:
COMMENCING at a 1/2" iron rod found at the intersection of the north right-of-way line of
the St. Louis & Southwestern Railroad (Cotton Belt Railway 100 feet wide) with the
northwest right-of-way of a 100 foot T.P. & L. Easement as recorded in Volume 3887, Page
110, Deed Records of Dallas County, Texas;
THENCE North 29' 13' 41" East along the northwest line of said T.P. & L. easement, a
distance of 747.53 feet to the POINT OF BEGINNING;
THENCE North 29° 13' 41", continuing along the northwest line of said T.P. & L., a
distance of 59.95 feet to an iron rod set for corner;
THENCE South 62' 02' 00" East, a distance of 24.47 feet to an iron rod set for corner and
the beginning of a circular curve to the left;
THENCE Northeasterly along said curve having a central angle of 51' 00' 00", a radius of
395.00 feet, a tangent of 188.41 feet, and an arc length of 351.60 feet to a point of reverse
curvature;
THENCE Southeasterly along said curve having a central angle of 50' 18' 38", a radius of
455.00 feet, a tangent length of 213.67 feet, and an arc length of 399.53 feet to an iron rod
set for corner, said point being the intersection of said curve and the west right-of-way line
of MacArthur Boulevard (110 foot right-of-way) as recorded in Volume 84221, Page 984 of
the Deed Records of Dallas County, Texas;
THENCE South 27' 08' 01" West, along said west line of MacArthur Boulevard, a distance
of 60.06 feet to an iron rod set for corner, said point being the beginning of a non -tangent
curve to the left whose center bears South 24` 16' 39" West a distance of 395.00 feet;
THENCE Northwesterly along said curve having a central angle of 49' 56' 01", a radius of
395.00 feet, a tangent length of 183.91 feet and an arc length of 344.24 feet to an iron rod
set for corner and a point of reverse curvature;
THENCE Southwesterly along said curve having a central angle of 51' 00' 00", a radius of
455.00 feet, a tangent length of 217.02 feet, and an arc length of 405.00 feet to an iron rod
set for corner, said point also being a point of tangency;
THENCE North 62' 02' 00" West, a distance of 28.54 feet to the POINT OF BEGINNING
and containing 1.0698 acres of land save and except easements to the D.P. & L. as recorded
in Volume 4594, Page 302 and to the T.P. & L. as recorded in Volume 3887, Page 110 of
the Deed Records of Dallas County, Texas.
