ORDINANCE NO. 95708
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS,
AMENDING CHAPTER 2, ARTICLE 2-1 AND ARTICLE 2-2 OF THE CODE
OF ORDINANCES BY AMENDING THE POWERS AND DUTIES OF THE
LIBRARY BOARD AND PARKS AND RECREATION BOARD; PROVIDING
A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND
PROVIDING AN EFFECTIVE DATE.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL,
TEXAS:
SECTION 1. That the Code of Ordinances of the City of Coppell, Texas, be, and the
same is hereby, amended by amending Chapter 2, Article 2-1 and Article 2-2, in part, to
read as follows:
"CHAPTER 2 - BOARDS AND COMMISSIONS
ARTICLE 2-1 LIBRARY BOARD
Sec. 2-1-1 CREATION
There is hereby created and established for the City a Library Board
composed of seven (7) regular members and two (2) alternate
members appointed by the City Council. Each member shall be a
qualified voter in the City and shall have been a resident of the City
for at least twelve (12) months preceding the date of appointment.
Sec. 2-1-2 TERM; VACANCIES
A. Members of the Library Board shall be appointed for two (2)
year terms with three (3) members whose terms expire in even
number years and four (4) members whose terms expire in odd
number years. Members shall serve at the pleasure of the City
Council.
B. All vacancies on the Board shall be filled by a majority vote of
the City Council for the remainder of the unexpired term within
thirty (30) days after the vacancy occurs.
C. The members of the Board shall serve without pay, but shall be

entitled to reimbursement for necessary expenses incurred in
the performance of their duties when approved by the City
Council.
D. The members of the Board shall have advisory powers only and
shall not be deemed to be public officials or agents of the City.
Sec. 2-1-3 OFFICERS
A. The Board shall each October elect from their membership a
chairman, vice-chairman and a secretary for one (1) year terms
of office, or until their successors are elected. Board members
may hold office for two (2) consecutive terms, after which one
(1) term must elapse before they are being eligible for re-
electioa
B. In the event of a vacancy in the office of chairman, the vice-
chairman shall assume the duties of the chairman until the next
regular meeting of the Board, at which time the Board shall
elect a new chairman.
C. In the event of a vacancy in the office of vice-chairman or
secretary, the chairman may appoint a Board member to
temporarily assume the duties of that office until the next
regular meeting, at which time an election will be held to fill
any such vacancy.
Sec. 2-1-4 MEETINGS
A. The Board shall meet in regular sessions at the times
established by the rules and regulations adopted by the Board
and approved by the City Council. The Board shall hold such
special meetings as shall be called by the Chairman, or upon
written request of at least two (2) members of the Board or at
the request of the City Council.
B. Five (5) members of the Board shall constitute a quorum for
the purpose of transaction of business, and no action of the
Board shall be valid or binding unless adopted by an affirmative
vote of four (4) or more members of the Board unless
authorized by the laws of the State of Texas.
C. All meetings of the Board shall be open to the public unless
otherwise permitted by law and shall be subject to the Open
Meetings Act.

D. The Board shall submit to the City Council a copy of the
minutes of each regular and special meeting with a list of any
members absent from such meetings.
E. If a Board member is absent for three (3) consecutive regular
meetings or by his absence causes a regular meeting to be
canceled because of a lack of a quorum, such position shall be
declared vacant and the vacancy shall be filled for the
remainder of the unexpired term by the City Council.
Sec. 2-1-5 POWERS AND DUTIES
The Board shall have the following powers and perform the following
duties:
A. Act in an advisory capacity only to the City Council in matters
that pertain to the library and shall not have any responsibility
or authority over the public officials or employees of the City
in the implementation of policies or operations of the library.
B. Receive suggestions and recommendations from citizens relating
to library service.
C. Study and encourage the development of adequate library
facilities for the residents of the City.
D. Recommend policies on library service to the Library Director.
E. Recommend to the City Council suggested programs on the
development of library facilities, programs and financial
support.
F. Recommend the development of long-range capital
improvement programs to the City Council.
G. Solicit gifts, revenues, requests for endowments of money or
property as donations or grants from persons, subject to the
approval and acceptance by the City Council.
H. Support the intellectual freedom and rights of access in the
public library.
I. Adopt rules and regulations for the governing of their actions,
proceedings, and deliberations, and set the time and place of
their meetings, subject to approval by the City Council.

J. Cooperate with organizations, clubs and groups concerned with
library facilities and programs in the City.
K. Follow the rules and regulations prescribed by the City Council
for the conduct of its business.

ARTICLE 2-2 PARKS AND RECREATION BOARD
Sec. 2-2-1 CREATION
There is hereby created and established for the City the Parks and
Recreation Board composed of seven (7) regular members and two (2)

proceedings, and deliberations and set the time and place of
their meetings, subject to approval by the City Council.
K. Recommend policies on park and recreation services to the
Director of Leisure Services.

SECTION 2. That all ordinances and provisions of the Code of Ordinances of the
City of Coppell, Texas in conflict with the provisions of this ordinance be, and the same are
hereby, repealed, and all other provisions not in conflict with the provisions of this
ordinance shall remain in full force and effect.
SECTION 3. That should any word, phrase, paragraph, section or portion of this
ordinance, or of the Code of Ordinances, as amended hereby, be held to be void or
unconstitutional, the same shall not affect the validity of the remaining portions of said
ordinance or of the Code of Ordinances, as amended hereby, which shall remain in full
force and effect.
SECTION 4. That this ordinance shall become effective immediately from and after
its passage as the law and charter in such cases provide.
