OR 95-706 Abandons a portion of Ledbetter Rd AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 95706 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, ABANDONING A PORTION OF LEDBETTER ROAD, DEPICTED IN EXHIBIT "A" AND BEING FURTHER DESCRIBED IN EXHIBIT "B", ATTACHED HERETO, IN FAVOR OF THE ABUTTING PROPERTY OWNERS, CARDINAL COMMUNICATIONS PARTNERS L.P., EXPLORER PIPE LINE, KAMWELL, INC., AND KKR INVESTMENTS, INC.; PROVIDING THAT SUCH ABANDONMENT SHALL BE THE INTEREST WHICH THE CITY MAY LEGALLY AND LAWFULLY ABANDON; PROVIDING THAT SAID ORDINANCE SHALL CONSTITUTE A QUITCLAIM DEED THAT MAY BE RECORDED WITH THE COUNTY CLERK OF DALLAS COUNTY, TEXAS; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Coppell has determined that the portion of Ledbetter Road depicted in Exhibit "A" and being further described in Exhibit "B", is no longer needed for City services; and WHEREAS, the City Council of the City of Coppell has determined that the interest of the City and the public therein should be abandoned; and WHEREAS, the abutting property owners desire that such portions of Ledbetter Road be abandoned; and WHEREAS, the City Council of the City of Coppell has determined that the City and public have no need for such portion of Ledbetter Road, and that the cost of keeping and maintaining such portion of Ledbetter Road is in excess of the fair market value of the City's interest in the portion of Ledbetter Road being abandoned; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the City Council of the City of Coppell, Texas has determined that the portion of Ledbetter Road depicted in Exhibit "A" and being further described in Exhibit "B", attached hereto and made a part hereof for all purposes, is no longer needed or necessary for public purposes and should be abandoned in favor of the abutting property owners, Cardinal 1 AGG06E2C Communications Partners L.P., Explorer Pipe Line, Kamwell, Inc., and KKR Investments, Inc., conditioned upon said adjoining property owners providing the City with their express consent to the abandonment and/or the execution of a mutual access easement among said parties providing access to their property from Beltline Road. SECTION 2. That the City of Coppell, Texas, hereby abandons all its right, title, and interest in and to said portion of Ledbetter Road, and abandons, conveys, and relinquishes all such public interest the City may have in and to said portion of Ledbetter Road to the abutting property owners, subject to the conditions set forth above in Section 1. SECTION 3. That the City Council of the City of Coppelt, Texas, has determined that the cost of keeping and maintaining such portion of Ledbetter Road is in excess of the fair market value of the City's interest in the portion of Ledbetter Road being abandoned. SECTION 4. That the abandonment ordinance of the City's interest in said portion of Ledbetter Road shall constitute a Quitclaim Deed in favor of the abutting property owners, and a certified copy of the same may be filed in the Deed Records of Dallas County, Texas, to indicate such abandonment. SECTION 5. That the abandonment provided for herein shall extend only to the public right, title and interest which the City of Coppell, Texas, may have in and to said portion of Ledbetter Road, and shall be construed to extend only to such interests that the governing body of the City of Coppell, Texas, may legally and lawfully abandon. SECTION 6. That this ordinance shall become effective from and after its passage as the law and charter in such cases provide, and subject to the conditions set forth in Section 1 above. 2 AGG06E2C DULY PASSED by the City Council of the City of Coppell, Texas, this the / day of June, 1995. KENNEDY SURVEY, ABSTRACT NO. 741, as recorded in the Plat Records of Dallas County, Texas and being more particularly described by metes and bounds as follows: COMMENCING at the most easterly Northeast comer of Tract 2 of the JAMES M. KENNEDY SURVEY, ABSTRACT NO. 741, said point being an intersection point of the South right-of-way line of East Belt Line Road with the West right-of-way line of Ledbetter Road; THENCE leaving the West right-of-way line of Ledbetter Road, South 65° 53' 34" East along the projected South right-of-way line of East Belt Line Road a distance of 22.96 feet to the POINT OF BEGINNING, said point being an intersection point of the South right-of-way line of East Belt Line Road with the centerline of Ledbetter Road; BEGINNING at an intersection point of the South right-of-way line of East Belt Line Road with the centerline of Ledbetter Road; THENCE following said centerline of Ledbetter Road, South 05' 19' 21" East a distance of 704.05 feet to a point of curvature; THENCE along a centerline curve to the left having a central angle of 38' 20' 57", a radius of 312.38 feet, a chord bearing of South 26° 31' 43" East, a chord distance of 205.20 feet, and an arc length of 209.08 feet to a point of reverse curvature; THENCE along a centerline curve to the right having a central angle of 49' 22' 13", a radius of 231.66 feet, a chord bearing of South 27' 21' 26" East, a chord distance of 193.50 feet, and an arc length of 199.62 feet to a point; THENCE continuing along said centerline, South 07° 09' 34" East, a distance of 1853.02 feet to a point of curvature; THENCE along a centerline curve to the right having a central angle of 98' 30' 5Y', a radius of 85.23 feet, a chord bearing of South 42' 00' 58" West, a chord distance of 129.15 feet, and an arc length of 146.55 feet to a point; THENCE continuing along said centerline North 88° 59' 01" West, a distance of 192.48 feet to an angle point; THENCE along said centerline, South 88' 13' 21" West, a distance of 428.48 feet to an end point and containing 3.428 acres of land, more or less.
