OR 95-699 Eliminate term limits for memebers of Keep Coppell Beautiful Committee AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 95699 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE CODE OF ORDINANCES BY AMENDING ARTICLES 2-3-3 AND 2-3-4 TO ELIMINATE TERM LIMITS FOR MEMBERS OF THE "KEEP COPPELL BEAUTIFUL COMMITTEE'', AND ESTABLISHING A QUORUM OF SEVEN MEMBERS; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, the City Council of the City of Coppell finds that it is necessary for the health, safety and general welfare of the citizens of the City of Coppell, to adopt a city-wide policy to decrease the amount of loose refuse in the City; and WHEREAS, the City Council has determined that a committee should be established to assist the City Council in establishing such policy; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Code of Ordinances of the City of Coppell, Texas, be, and the same is hereby, amended, in part, by amending Articles 2-3-3 and 2-3-4 to read as follows: "ARTICLE 2-3 KEEP COPPELL BEAUTIFUL COMMITTEE Sec. 2-3-1 CREATION A committee to be known as the "Keep Coppell Beautiful Committee" is hereby created for the purpose of assisting the City Council and the City staff in establishing a city-wide policy for decreasing the amount of loose refuse in the City. Sec. 2-3-2 MEMBERSHIP The Committee shall be comprised of thirteen (13) members to be selected as follows: (1) twelve members sha~~ be appointed by the City Council Deletions are indicated by s~2:eeut text, mid additions to the text are in italics. 1 and shall be residents of the City or own or operate a business within the City, selected from the representative groups listed below; (2) the thirteenth member shall be a non-voting ex officio member of the Committee, shall be the Director of Information and Customer Services or his designee, and shall serve as Coordinator of the Committee. GROUP REPRESENTED NUMBER OF PLACE NUMBER MEMBERS Business &Industry 2 1-2 Representatives Civic Organizations 1 3 Education 2 4-5 Communications 1 6 Funding 2 7-8 Members at Large 4 9-12 Coordinator (Director of 1 13 Information & Customer Services, or his designee) Total 13 13 Sec. 2-3-3 TERMS Members, except the Place 13 member who shall serve an indefinite term, shall serve the following terms: (1) members appointed to fill odd- numbered places shall serve for a term of one year, and (2) members appointed to fill even-numbered places shall serve for a term of two years. No committee m~mber shall serve two successive terms, provided, however that a committee member appointed to complete the term of another committee member, at the completion of such term, shah be eligible for appointment for another full term. All members shall serve at the pleasure of the City Council. Sec. 2-3-4 RULES That the Committee shall be governed by the following rules: A. Quorum. Five Seven members of the Committee shall constitute a quorum for the conduct of business. 2 B. Attendance. The members of the Committee shall regularly attend meetings and public hearings of the Committee. An annual report shah be submitted to the City Council showing the cumulative attendance of each member with notation of members who have been absent from three (3) consecutive meetings. C. Compensation. The members of the Committee shall serve without compensation. D. Meetings. The Committee shall hold an organizational meeting each year and shall elect a Chairman and Vice-Chairman from among its members before proceeding to any other matters of business. The Committee shall meet regularly and shall designate the time and place of its meetings in accordance with its by-laws. E. Procedure. The Committee shall adopt its own by-laws and rules of procedure and keep a record of its proceedings in accordance with the provisions of the ordinances and charter of the City. F. Installation of Members. Newly appointed members shall be installed at the first regular meeting after their appointment. Sec. 2-3-5 DUTIES That the Committee shall recommend refuse and environmental management policies to the City Council and City staff so that all City refuse policies and the Committee's activities may follow a common purpose. The Committee shall have the following responsibilities: A. Assist City Administration and City Council in reducing litter and associated problems. B. Assist in development of further beautification programs for the community as may be needed. C. Assist in the development of city-wide refuse and environmental pOliCy plan(s) for review and adoption. D. Assist City Administration in evaluating the effectiveness of the policies developed. E. Determine and recommend to the City Council and the City Administration program priorities on a city-wide basis. 3 F. Recommend enforcement and additional program alternatives. G. Carry out such other tasks as the City Council and City Administration may designate. Sec. 2-3-6 SUBCOMMITTEES The Committee shall establish subcommittees to accomplish the foregoing responsibilities, such subcommittees to include, but not be limited to, the areas of business and industry, communications, community organizations, municipal operations, and schools. Each subcommittee shall be chaired by a Committee member with an unspecified number of community volunteers chosen by the Committee as working subcommittee staff. Sec. 2-3-7 Repealed and reserved for future use." SECTION 2. That all provisions of the Code of Ordinances of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That should any word, phrase, paragraph, section or portion of this ordinance or of the Code of Ordinances, as amended hereby, be held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or of the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 4. That this ordinance shall become effective from and after its passage as the law and charter in such cases provide.
