ORDINANCE NO. 2007-1157
AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING
THE CODE OF ORDINANCES BY AMENDING CHAPTER 6,
“BUSINESS REGULATIONS,” ARTICLE 6-12, LAWN SPRINKLERS, BY
ADDING A NEW SECTION 6-12-3 PROHIBITING OPERATION OF
SPRINKLERS WHEN TEMPERATURE IS AT FREEZING OR BELOW
FREEZING; PROVIDING A REPEALING CLAUSE; PROVIDING A
SEVERABILITY CLAUSE, AND; PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS,
Article 6-12 of the Code provides for lawn sprinklers within the City; and
WHEREAS,
the provisions contained therein do not provide for temperatures at or
below the freezing level; and
WHEREAS,
the City Council believes that persons owning or operating a lawn sprinkler
system and permit the lawn sprinklers to engage in freezing or below freezing temperatures are
creating a safety hazard; and,
WHEREAS,
the City Council has determined that Article 6-12 should be amended by
adding a new section 6-12-3 making it unlawful to operate sprinklers when the temperature is at
or below freezing.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF COPPELL, TEXAS;
SECTION 1.
That Chapter 6, Article 6-12 of the City of Coppell Code of Ordinances,
be and the same is hereby amended, by adding a new section 6-12-3 making it unlawful to
operate sprinklers when the temperature is at or below freezing, which shall read as follows:
“ARTICLE 6-12 Lawn Sprinklers
. . . . .
Sec. 6-12-3 Unlawful to operate sprinklers when temperature is at or
below freezing.
It shall be unlawful for any person or organization owning or operating a
lawn sprinkler system within the City to permit operation and engagement of such
system when the temperature is at or below freezing (32° F or 0° C) or to permit
water to spray or run-off from said system to freeze onto any streets, alleys,
sidewalks or thoroughfares of the City. The creation of such a dangerous and
hazardous condition is hereby declared to be a nuisance per se and is subject to

redress and abatement by the City.

SECTION 2. That all provisions of the Ordinances of the City of Coppell, Texas, in
conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other
provisions of the Ordinances of the City not in conflict with the provisions of this ordinance shall
remain in full force and effect.
SECTION 3. Should any sentence, paragraph, subdivision, clause, phrase or section of
this ordinance be adjudged or held to be unconstitutional, illegal or invalid, the same shall not
affect the validity of this ordinance as a whole, or any part or provision thereof other than the
part so decided to be invalid, illegal or unconstitutional, and shall not affect the validity of the
Code of Ordinances of the City ofCoppell, Texas
SECTION 4. That this ordinance shall take effect immediately from and after its passage
as the law and charter in such cases provide.
