OR 99-893 Election on propositions pertaining to the issuance of bonds CERTIFICATE FOR ORDINANCE NO. 99893 THE STATE OF TEXAS § COUNTIES OF DALLAS AND DENTON § CITY OF COPPELL § We, 'the undersigned officers of said City, hereby certify as follows: 1. The City Council of said City convened in REGULAR MEETING ON THE 24TH DAY OF AUGUST, 1999, at the City Hall, and the roll was called of the duly constituted officers and members of said City Council, to-wit: Candy Sheehan, Mayor Marsha Tunnell, Mayor Pro Tern Gregg Garcia Pat Keenan Doug Stover Jayne P. Peters Larry Wheeler Bill York Libby Ball, Interim City Secretary and all of said persons were present, except the following absentees: ~ thus constituting a quorum. Whereupon, among other business, the following was transacted at said Meeting: a written AN ORDINANCE OF TItE CITY OF COPPELL, TEXAS, CALLING FOR AN ELECTION FOR NOVEMBER 2,1999, TO VOTE FOR OR AGAINST PROPOSITIONS PERTAINING TO TI-IE ISSUANCE OF BONDS; PROVIDING FOR POLLING LOCATIONS; PROVIDING FOR EARLY VOTING; PROVIDING FOR TItE APPOINTMENT OF ELECTION JUDGES AND CLERKS; AND PROVIDING FOR AN EFFECTIVE DATE. was duly introduced for the consideration of said City Council and read in full. It was then duly moved and seconded that said Ordinance be passed; and, after due discussion, said motion carrying with it the passage of said Ordinance, prevailed and carded by the following vote: AYES: All members of said City Council shown present above voted "Aye". NOES: None 2. That a true, full and correct copy of the aforesaid Ordinance passed at the Meeting described in the above and foregoing paragraph is attached to and follows this Certificate; that said Ordinance has been duly recorded in said City Council's minutes of said Meeting; that the above and foregoing paragraph is a true, full and correct excerpt fi.om said City Council's minutes of said Meeting pertaining to the passage of said Ordinance; that the persons named in the above and fore- going paragraph are the duly chosen, qualified and acting officers and members of said City Council as indicated therein; that each of the officers and members of said City Council was duly and sufficiently notified officially and personally, in advance, of the time, place and purpose of the aforesaid Meeting, and that said Ordinance would be introduced and considered for passage at said Meeting, and each of said officers and members consented, in advance, to the holding of said Meeting for such purpose, and that said Meeting was open to the public and public notice of the time, place and purpose of said meeting was given, all as required by Chapter 551, Texas Government Code. 3. That the Mayor of said City has approved and hereby approves the aforesaid Ordinance; that the Mayor and the Interim City Secretary of said City have duly signed said Ordinance; and that the Mayor and the Interim City Secretary of said City hereby declare that their signing of this Certificate shall constitute the signing of the attached and following copy of said Ordinance for all purposes. M~a~_~Yo~r _~~~ Interim Cit~ Secretary SEAL AN ORDINANCE OF THE CITY OF COPPELL, TEXAS CALLING AN ELECTION FOR THE ISSUANCE OF BOND ORDINANCE NO. ~ ~ AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, CALLING FOR AN ELECTION FOR NOVEMBER 2, 1999, TO VOTE FOR OR AGAINST PROPOSITIONS PERTAINING TO THE ISSUANCE OF BONDS; PROVIDING FOR POLLING LOCATIONS; PROVIDING FOR EARLY VOTING; PROVIDING FOR THE APPOINTMENT OF ELECTION JUDGES AND CLERKS; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, this City Council of said City deems it advisable to call the election hereinafter ordered; and WHEREAS, it is hereby officially found and determined: that holding the hereinafter called election is in the public interest; and that said meeting was open to the public, and public notice of time, place, and purpose of said meeting was given, all as required by Texas Government Code, Chapter 551. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That an election shall be held between the hours of 7:00 A.M. and 7:00 P.M. on November 2, 1999 in. said City, at the Town Center Atrium, First Floor, 255 Parkway Boulevard, Coppell, Texas 75019, and the following officers are hereby appointed to hold said election: Presiding Judge: Margaret Hills Alternate Presiding Judge: Barbara Davidson SECTION 2. That the Presiding Judges shall appoint not less than two qualified election clerks to serve and assist in conducting said election; provided that if the Presiding Judge actually serves as expected, the Alternate Presiding Judge shall be one of such clerks. 1 SS27903 SECTION 3. That early voting shall be conducted by mail at the City Secretary's Office, Town Center, 255 Parkway Boulevard, Coppell, Texas 75019, and early voting by personal appearance shall be held at Town Center Atrium, First Floor, 255 Parkway Boulevard, Coppell, Texas 75019, during the period early voting is required or permitted by law, being October 18, 1999 through October 29, 1999 with the hours designated for early voting by personal appearance shall be from 8:00 A.M. to 5:00 P.M. for weekdays of October 18, 1999 through October 22, 1999 and from 7:00 A.M. to 7:00 P.M. for weekdays of October 25, 1999 through October 29, 1999 and early voting by personal appearance on Saturday, October 23, 1999, being from 8:00 A.M. to 5:00 P.M. and on Sunday, October 24, 1999, being from 1:00 P.M. to 6:00 P.M; and the early voting clerk shall keep said early voting place open during such hours for early voting by personal appearance. The early voting clerk for said election shall be Libby Ball, Interim City Secretary. SECTION 4. That an early ballot board is hereby created to process early voting results, and Margaret Hills is hereby appointed the Presiding Judge of said board. The Presiding Judge shall appoint at least two other,members of the board. SECTION 5. That all resident, qualified electors of said City shall be entitled to vote at said election. SECTION 6. That notice of said election shall be given by posting a substantial copy of this Ordinance at the Town Center on the bulletin board used for posting notices of the meetings of the City Council, and at three other places in said City, not less than 15 days prior to the date set for said election; and a substantial copy of this Ordinance shall also be published on the same day in each of two successive weeks in a newspaper of general circulation published in said City, 2 SS27903 the date of the first publication to be not earlier than the 30th day or later than the 14th day prior to the date set for said election. SECTION 7. That at said election the following PROPOSITIONS shall be submitted in accordance with law: PROPOSITION NO. 1 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $30,345,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed 40 years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of constructing, improving and equipping permanent public improvements, to-wit: the City's streets, including but not limited to West Sandy Lake Road (Denton Tap Road to S.H. 121); East Sandy Lake Road (Kimbel Court to east city limits); Bethel Road I (Freeport Parkway to west city limits); Bethel Road II (Freeport Parkway to Denton Tap Road); Coppell Road (West Sandy Lake Road to Bethel Road); Creekview Road (Ruby Rd./State Rd. west along south edge of Wagon Wheel Park); and Freeport Parkway (Bethel Road to I.H. 635), and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? PROPOSITION NO. 2 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $8,685,000, with the bonds ofeech such series or issue, respectively, to mature serially within not to exceed 40 years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the City Council, for the purpose of acquiring, constructing, equipping and improving permanent public improvements for the City's parks, including but not limited to the development of: MacArthur Park; Wagon Wheel Park; Andrew Brown Park East; new Senior Citizen Center; tennis courts; extension of North Zone Trail System; and renovation of Grapevine Springs, and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? 3 8827903 PROPOSITION NO. 3 Shall the City Council of said City be authorized to issue the bonds of said City, in one or more series or issues, in the aggregate principal amount of $1,700,000, with the bonds of each such series or issue, respectively, to mature serially within not to exceed 40 years from their date, and to be sold at such prices and bear interest at such rates as shall be determined within the discretion of the .City Council, for the purpose of acquiring, constructing and improving permanent public improvements for the City's drainage, including but not limited to Kaye Street; Meadowcreek Road; Stream G-2; Stream G-6; Sandy Knoll/Shadowcrest; The Meadows Subdivision; Cottonwood Estates; and Hunterwood park, and shall said City Council be authorized to levy and cause to be assessed and collected annual ad valorem taxes in an amount sufficient to pay the annual interest on said bonds and provide a sinking fund to pay said bonds at maturity? SECTION 8. That the official ballots for said election shall be prepared in accordance with the Texas Election Code so as to permit the electors to vote "FOR" or "AGAINST" the aforesaid PROPOSITIONS, with the ballots to contain such provisions, markings and language as required by law, and with such PROPOSITIONS to be expressed substantially as follows: PROPOSITION NO. 1 FOR ) FOR THE ISSUANCE OF $30,345,000 OF STREET IMPROVEMENT AND EQUIPMENT TAX BONDS, INCLUDING BUT NOT LIMITED TO WEST SANDY LAKE ROAD (DENTON TAP ROAD TO S.H. 121); EAST SANDY LAKE ROAD (KIMBEL COURT TO EAST CITY LIMITS)kBETHEL ROAD I (FREEPORT PARKWAY TO WEST CITY LIMITS); BETHEL ROAD II (FREEPORT PARKWAY TO DENTON TAP ROAD); COPPELL ROAD (WEST SANDY LAKE ROAD TO BETHEL ROAD); CREEKVIEW ROAD (RUBY RD./STATE RD. That in all respects said election shall be conducted in accordance with the Texas Election Code. SECTION 10. That this ordinance shall take effect immediately from and after its passage and the publication of the caption, as the law and charter in such cases provide.
