OR 95-695 Andrew Brown Jr Park AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 95695 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE CODE OF ORDINANCES OF THE CITY OF COPPELL, TEXAS BY AMENDING CHAFFER 9, SECTION 9-11-3 D, SECTION 9-11-3 P, ADDING SECTIONS 9-11-3 R AND S, AND SECTION 9-11-7 H; REGULATING THE OPERATION OF MODEL AIRPLANES; PROVIDING HOURS OF OPERATION FOR ANDREW BROWN JR. PARK (EAST AND WEST); PROHIBITING GOLFING VqITHIN ANY CITY PARK; AUTHORIZING THE SUPERINTENDENT OF PARKS AND RECREATION TO CANCEL OR SUSPEND USE OF ANY ATHLETIC FACILITY; PROVIDING A REPEALING CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING PENALTIES FOR VIOLATION OF THIS ORDINANCE NOT TO EXCEED THE SUM OF HVE HUNDRED DOLLARS ($500.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That Section 9-11-3 of the Code of Ordinances of the City of Coppell, Texas be and the same is hereby amended in part by amending subsections D and P and by adding subsections R and S to read as follows: "Sec. 9-11-3 GENERAL REGULATIONS Within the limits of any park, it shall be unlawful for any person or persons to do any of the acts hereinafter specified, except as may be otherwise provided: "D. To operate any model airplane, helicopter or radio controlled device, rocket, or to discharge any bow and arrow, except in such areas as may be specifically designated for such purposes by the Superintendent of 1 AGGO5F48 Parks and Recreation. P. To go into or remain in any City park at a time when the park is closed to the public without a special permit issued by the Superintendent of Parks and Recreation. The following parks shall be closed to the public during the times indicated, and signs indicating such shall be posted at conspicuous places to give notice thereof. 1. Andrew Brown, Jr. Community Park (East and West) - closed from 11:30 p.m. to 6:30 a.m. the following day. 2. All other parks shall be dosed from sunset to 6:30 a.m. the following day. R. To drive or hit golf balls." SECTION 2. That Section 9-11-7 of the Code of Ordinances of the City of Coppell, Texas be and the same is hereby amended in part by adding a subsection H to read as follows: "Sec. 9-11-7 ATHLETIC FACILITIES H. The Superintendent has the authority to cancel or suspend use of any athletic facility if, in the opinion of the Superintendent, such cancellation or suspension is in the best interest of the citizens and/or is necessary for the maintenance and control of the facilities." SECTION 3. That all provisions of the Code of Ordinances of the City of Coppell, Texas in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 4. An offense committed before the effective date of this ordinance is governed by the prior law and the provisions of the Code of Ordinances, as amended, in effect when the offense was committed and the former law is continued in effect for this 2 AGGO5F48 purpose. SECTION 5. That should any word, phrase, paragraph, section or portion of this ordinance or of the Code of Ordinances, as amended hereby, be held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance or of the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 6. That any person, firm, or corporation violating any of the provisions or terms of this ordinance or of the Code of Ordinances, as amended hereby, shall be guilty of a misdemeanor and upon conviction in the Municipal Court of the City of Coppell, Texas, shall be subject to a fine not to exceed the sum of Five Hundred Dollars ($500.00) for each offense, and each and every day such offense is continued shall constitute a new and separate offense. SECTION 7. That this ordinance shall become effective immediately from and after its passage as the law and charter in such cases provide.
