OR 95-692 Coppell Telecommunications Board ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 95692 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE CODE OF ORDINANCES OF THE CITY OF COPPELL BY AMENDING, IN PART, ARTICLE 2-7, RENAMING THE COPPELL CABLE TELEVISION REVIEW BOARD TO "COPPELL TELECOMMUNICATIONS BOARD", AMENDING THE POWERS AND DUTlES OF THE BOARD; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS; SECTION 1. That the Code of Ordinances of the City of Coppell, Texas, be, and the same is hereby, amended by amending, in part, Article 2-7, renaming the Coppell Television Review Board to "Coppell Telecommunications Board", amending the powers and duties of the Board, as follows: "Article 2-7 COPPELL TELECOMMUNICATIONS BOARD Section 2-7-1 CREATION The Coppell Telecommunications Board is hereby established by the City Council of the City of Coppell, Texas and replaces the Coppell Cable Television Review Board. Section 2-7-2 APPOINTMENT A. The Coppell Telecommunications Board shall consist of five (5) members, two (2) alternates, appointed by the City Council and one (1) ex-officio member to be appointed by the City Manager and approved by the City Council. Members shall be registered voters and residents of the City of Coppell for at least twelve (12) months preceding the date of appointment. 1 AGG063B9 Section 2-7-4 MEETINGS A. The Coppell Telecommunications Board shall meet in regular sessions .... Three (3) members of the Coppell Telecommunications Board shall constitute a quorum. B. All meetings of the Coppell Telecommunications Board shall be open to the public .... C. The Coppell Telecmnmunications Board shall keep and maintain minutes .... Section 2-7-5 POWERS AND DUTIES OF THE BOARD A. The Board shah oversee implementation of the cable franchise agreement, and shall oversee Channel 19 for the full utilization of programming for the benefit of the citizens of Coppell, including programming rules (content and technical), and parameters for programming. B. The Board shall advise the City Council on all matters relating to telecommunications technologies, including but not limited to, cable television, both wire and wireless; and provide accurate and timely information regarding telecom- munications technologies to the City Council and the citizens of Coppell. C. The Board shall field citizens' concerns relating to cable television service and cable programming and make recommendations to the City Council. D. The Board shall stay abreast of emerging telecommunica- tions technologies and their uses in the City of Coppell and other cities in the area; and shall review and comment on new telecommunications technologies to the City. E. The Board shall monitor compliance with the cable televi- sion franchises and standards of performance by the ffanchisees. F. The Board shall assist in the evaluation of prospective franchises. AGGO63B9 G. The Board shall monitor and support the development of public, educational and governmental access programming. H. The Board shall assist and advise the Council on all matters relating to public, educational and governmental access programming. 1. The Board shall perform studies and make such other reports as the Council or the City may request. J. The Board shah develop policies regarding programming that will appear on the governmental access channel. K. The Board shall advise the City Council of objectives to be obtained in the City' s communication system based upon its continued evaluation of the Coppell telecommunication franchises and continued assessment of cable technology. L. The Board shall recommend the use of dedicated channels and sharing of public facilities, especially with regard to educational services. M. The Board shall review and comment on budgets proposed by the City involving the use of funds for governmental programming." SECTION 2. That all provisions of the Code of Ordinances of the City of Coppell, Texas, in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That should any word, phrase, paragraph, section or portion of this ordinance or of the Code of Ordinances, as amended hereby, be held to be unconstitutional or void, the same shall not affect the validity of the remaining portions of said ordinance or of the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 5.
