OR 95-684 Amends Article 15-5, Coppell Fire Code AN ORDINANCE OF THE CITY OF COPPELL, TEXAS ORDINANCE NO. 95684 AN ORDINANCE OF THE CITY OF COPPELL, TEXAS, AMENDING THE COPPELL FIRE CODE CODIFIED AT ARTICLE 15-5 OF THE CODE OF ORDINANCES OF THE CITY OF COPPELL, TEXAS, BY AMENDING THE UNIFORM FIRE CODE, 1991 EDITION, AS HERETOFORE ADOPTED AND AMENDED, TO ADD CERTAIN AMENDMENTS AND ADDITIONS; PROVIDING A REPEALING CLAUSE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; PROVIDING FOR A PENALTY OF FINE NOT TO EXCEED THE SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE; AND PROVIDING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL, TEXAS: SECTION 1. That the Coppell Fire Code, codi~ed at Article 15-5 of the Code of Ordinances of the City of Coppell, Texas, be, and the same is hereby, amended, by amending the following Sections of the Uniform Fire Code, 1991 Edition, to read as follows: (1) Section 10.204 FIRE LANES is amended by adding subsection e. "e . Collapse Zone Exclusion. On buildings where the Fire Chief determines that a building collapse potential is present, the Fire Chief may determine that the Fire Lane be so located that the building walls are distanced at least one and one- haft times (1.5) the height of the building from the closest point of the Fire Lane." (2) Section 10.507(h). Group R, Division 1 Occupancies is amended to read as follows: "(h) Group R, Division 1 Occupancies. All Group R, Division 1 Occupancies shall be equipped with an approved, hydraulically designed automatic fire sprinkler system. Residential or quick response standard sprinklers shall be used in the dwelling units and guest room portions of the building." (3) Section 10.507 is amended to add subsection (i) Group R, Division 3 Occupancies to read as follows: "Section 10.507(i) Group R, Division 3 Occupancies. All Group R, Division 3 Occupancies which contain two or more separate dwelling units shall be equipped with an approved, hydraulically designed, automatic fire sprinkler system, Residential or quick response standard sprinklers shall be used in the dwelling units and guest room portions of the building." (4) Section lO.510(b) is amended to read as follows: "Section 10.510(b). Where Required. Class I, I and II, or HI standpipes in all Group I, H, B, Division 1, 2 or 3 Occupancies less than 4 stories in height but greater than 20,000 square feet per floor." (5) TABLE NO. 10.510-A--STANDHPE REQUIREMENTS is amended in part to read as follows: NONSPRINKLERED SPRINKLERED BU1LDiNG~ BUiLDiNG23 OCCUPANCY Standpipe Hose Standpipe Hose Class Requirement Class Requirement 5. Groups I. H.B, Div. I, or I and IP, or Yes L or I and II, or Yes 1, 2 or 3 Occupancies III III less than 4 stories in height but greater than 20,000 square feet per floor. SECTION 2. That all ordinances and provisions of the Code of Ordinances of the City of Coppell, Texas in conflict with the provisions of this ordinance be, and the same are hereby, repealed, and all other provisions not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 3. That should any word, phrase, paragraph, section or portion of this ordinance, or of the Coppell Fire Code, or of the Code of Ordinances, as amended hereby, be 2 AGG06455 held to be void or unconstitutional, the same shall not affect the validity of the remaining portions of said ordinance, the Coppell Fire Code, or of the Code of Ordinances, as amended hereby, which shall remain in full force and effect. SECTION 4. An offense committed before the effective date of this ordinance is governed by the prior law and the provisions of the Coppell Fire Code and the Code of Ordinances, as amended, in effect when the offense was committed and the former law is continued in effect for this purpose. SECTION 5. That any person, firm, or corporation violating any of the provisions or terms of this ordinance, the Coppell Fire Code, or of the Code of Ordinances, as amended hereby, shall be guilty of a misdemeanor and upon conviction in the Municipal Court of the City of Coppell, Texas, shall be subject to a fine not to exceed the sum of Two Thousand Dollars ($2,000.00) for each offense, and each and every day such offense is continued shall constitute a new and separate offense. SECTION 6. That this ordinance shall become effective immediately from and after its passage and the publication of the caption, as the law and charter in such cases provide.
