AN ORDINANCE OF THE CITY OF COPPELL, TEXAS
CANVASSING THE RETURNS AND DECLARING THE RESULTS OF AN ELECTION
HELD IN THE CITY OF COPPELL, TEXAS, ON NOVEMBER 7, 1995
FOR ADOPTION OF PROPOSED AMENDMENTS
TO THE HOME RULE CHARTER
OF THE CITY OF COPPELL, TEXAS
BE IT RE~IEMBERED THAT, heretofore. the City Council of the City of Coppell.
Texas duly called an election to be held on the 7th day of November. 1995, for the purpose of
sabmitting to the qualified voters of the City proposed amendments to the Home Rule Charter
uf the City of Coppell. Texas: and
BE IT FURTHER REMEMBERED THAT on this the 1 lth day of November, 1995.
at a meeting of the City Council of the City of Coppell. Texas. a quorum being present. the
meeting ,,~as called to order and the following business was transacted:
Upon motion of Councilmember Z;~z~. [~;L[;,,., iQe,~,., and seconded by

Council consider tbe official returns of an election held in the City on the 7th day of November.
1995. for ~he purpose of submitting to the qualified vuters of the City proposed amendments to
the Home Rule Cha~ter of the City of Coppell, Texas.
WHEREUPON said official returns were opened, examined, canvassed and the results
declared as follows:

WHEREAS, heretofore, the City Council of the City of Coppell, Texas, adopted an
ordinance calling an election to be held in the City on Nove~nber 7, 1995, for the purpose of
submitting to the qualified w~ters of the City eighteen (18) propositions amending certain sections
of the Home Rule Charter of the City of Coppell, and caused notice of said election to be given
in the manner and for the time provided by law, which order, together with the notices thereon,
are recorded in the minutes and records of the City Council and is hereby retorted to and made
a part hereof; and
WHEREAS, immediately at~er said election the Presiding Judge and other officials
holding said election made their returns of the results thereof to the City Council as follows, and
said returns being made according to law, and duly authenticated, and it being shown that written
notice of said election was posted for the time and in the manner provided by law, and all other
proceedings pertaining to said election having been shown to have been done and performed at
and within the manner provided by law, and all papers pertaining thereto having been returned
and filed with the City Council and no protest or objection being made to or regarding any matter
pertaining to said election; NOW, THEREFORE;
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF COPPELL,
TEXAS:
That 'after examining said returns and opening and canvassing the votes cast at said
election, the results of said election are as follows:

That 301 "For" votes were cast in favor of Proposition No. 1. and 25 "Against" votes
were cast against Proposition No. 1, which read as follows:
PROPOSITION NO. 1
Shall the Coppell City Charter be amended to delete obsolete or unnecessary references
to State law without making substantive changes by amending the following sections and
paragraphs: Sections 1.03, 2.02, 4.08B, 5.07.8.03D. 11.23.
It appearing that a majority of the votes cast were for the adoption of the charter
amendment set out in Proposition No. 1, and the same is hereby adopted.
That 282 "For" votes were cast in favor of Proposition No. 2, and 43 "Against" votes
were cast against Proposition No. 2, which read as follows:
PROPOSITION NO. 2
Shall the Coppell City Charter be amended to delete redundant or obsolete charter
language. to clarify language without making substantive change, improve grammar, and
eliminate gender ret~rences by making the charter gender neutral. by mending the following
sections and paragraphs: 3.01B. 3.02, 3.03, 3.04. 3.05. 3.06A, 3.06B, 3.06C, 3.08A, 3.08B,
3.lIB, 4.01A, 4.01B~ 4.01D, 4.01E, 4.02B, 4.03B, 4.04B, 4.05, 4.06B, 4.06C, 4.07F, 4.10D,
5.02A3.5.04, 5.08, 6.01, 6.03, 6.04, 6.06, 6.07, 6.10. 6.11.6.12, 6.13, 6.15. 7.04C, 7.09, 7.10,
8.02, 8.04F, 1!.03, 11.05, i1,09, 11.15, 11.18.
It appearing that a majority of the votes cast were for the adoption of the charter
amendment set out in Proposition No. 2, and the same is hereby adopted.

That 297 "For" votes were cast in favor of Proposition No. 3, and 26 "Against" votes
were cast against Proposition Nn. 3, which read as follows:
PROPOSITION NO. 3
Shall the Coppell City Charter be amended to delete obsolete or redundant provisions or
references to the charter without making substantive changes by amending the following sections
and paragraphs: 3.10. 6.15, 8.03A, 9.02, 11.22. 11.24, 11.26, 12.0l.
It appearing that a majority of the votes cast were for the adoption of the charter
amendment set out in Proposition No. 3, and the same is hereby adopted.
That 294 "For" votes were cast in favor of Proposition No. 4. and 27 "Against" votes
were cast against Proposition No. 4, which read as follows:

Shall Section 3.11 of the Coppell City Charter be amended to conform to the State law
regarding conflicts of interest and to clarify the language regarding abstention.
It appearing that a majority of the votes cast were fi~r the adoption of the charter
amendment set out in Proposition No. 4, and the same is hereby adopted.

That 290 "For" votes were cast in favor of Proposition No. 5, and 31 "Against" votes
were cast against Proposition No. 5, which read as follows:
PROPOSITION NO. 5
Shall Section 3.13B of the Coppell City Charter be amended to provide that copies of
proposed ordinances for City Council adoption shall be made available to the City Council and
the public concurrently.
It appearing that a majority of the votes cast were for the adoption of the charter
amendment set out in Propositinn No. 5, and the same is hereby adopted.
That 268 "For" votes were cast in favor of Proposition No. 6, and 56 "Against" votes
were cast against Proposition No. 6, which read as follows:

Shall Section 4.01C of the Coppell City Chin'let be amended to delete unnecessary
language regarding the removal of the City Manager.
It appearing that a majority of the votes cast were for the adoption of the charter
amendment set out in Proposition No. 6, and the same is hereby adopted.

That 232 "For" votes were cast in faw~r of Proposition No. 7, and 88 "Against" votes
were cast against Proposition No. 7, which read as follows:

Shall Section 4.05 of the Coppell City Charter be amended to provide for the appointment
and removal of the City Secretary by the City Manager.
It appearing that a majority of the votes cast were for the adoption of the charter
amendment set out in Proposition No. 7, and the same is hereby adopted.
That 250 "For" votes were cast in favor of Proposition No. 8. and 56 "Against" votes
were cast against Proposition No. 8, which read as follows:

Shall Section 4.07 of the Coppell City Charter be amended to delete Section 4.07D.
It appearing that a majority of the votes cast were for the adoption of the charter
amendment set out in Proposition No. 8, and the same is hereby adopted.

That 240 "For" votes were cast in favor of Proposition No. 9, and 83 "Against" votes
were cast against Proposition No. 9, which read as follows:

Shall Section 4.11 of the Coppell City Charter be a~nended to authorize the City Manager
to create new departments, abolish or consolidate offices and departments, divide and subdivide
the administration of any department, except those specifically established by the Charter.
It appearing that a majority of the votes cast were for the adoption of the charter
amendment set out in Proposition No. 9. and the same is hereby adopted.
That 309 "For" votes were cast in favor of Proposition No. 10, and 13 "Against" votes
were cast against Proposition No. 10, which read as follows:

Shall the Coppell City Charter be amended to conform to State law with respect to early
voting for elections, nepotism and notice of claims by amending the following sections and
paragraphs: 5.03C, l 1.03, 11A}9.
It appearing that a majority of the votes cast were for the adoption of the charter
amendment set out in Proposition No. 10, and the same is hereby adopted.

That 226 "For" votes were cast in favor of Proposition No. 11. and 95 "Against" votes
were cast against Proposition No. 11. which read as follows:
PROPOSITION NO. 11
Shall Section 6.02 of the Coppell City Charter be amended to reduce the number of
qualified voters to twenty-five (25) required fi~r a Petitioner's Committee to propose ordinances,
to require reconsideration of adopted ordinances and to recall City Council members.
It appearing that a majority of the votes cast were for the adoption of the charier
amendment set out in Proposition No. 11, and the same is hereby adopted.
That 219 "For" votes were cast in favor of Proposition No. 12. and 105 "Against" votes
were cast against Proposition No. 12, which read as follows:
PROPOSITION NO. 12
Shall Section 6.05A of the CoppeI1 City Charter be amended to reduce the number of
signatures required for a petition to recall City Council member from 25% to 15% of the
qualified voters on the date of the last regular municipal election.
It appearing that a majority of the votes cast were for the adoption of the charter
amendment set out in Proposition No. 12, and the same is hereby adopted.

That 208 "For" votes were cast in faw>r of Proposition No. 13, and 114 "Against" votes
were cast against Proposition No. 13, which read as follows:
PROPOSITION NO. 13
Shall Section 6.05B of the Coppell City Charter be amended to reduce the number of
signatures required for initiative or referendum from 15% to 10% of the qualified voters on the
date of the last regular municipal election.
It appearing that a majority of the votes cast were for the adoption of the charter
amendment set out in Proposition No. 13, and the same is hereby adopted.
That 215 "For" votes were cast in t~avor of Proposition No. 14, and 101 "Against" votes
were cast against Proposition No. 14, which read as follows:
PROPOSITION NO. 14
Shall Section 6.12 of the Coppell City Charter be amended to provide that an ordinance
adopted by initiative or an ordinance repealed by referendum may be repealed, amended, or re-
enacted, as the case may be, at any time after the expiration of two (2) years by an affirmative
vote of four (4) or more Council members.
It appearing that a majority of the votes cast were for the adoption of the charter
amendment set out in Proposition No. 14, and the same is hereby adopted.

That 256 "For" w~tes were cast in favor of Proposition No. 15, and 64 "Against" votes
were cast against Proposition No. 15, which read as follows:

Shall Section 7.03A10 of the Coppell City Charter be amended to require a
reserve/contingency fund of not less than 10% of the proposed City expenditures.
It appearing that a majority of the vows cast were fi~r the adoption of the chager
amendment set out in Proposition No. 15, and the same is hereby adopted.
That 304 "For" votes were cast in favor of Proposition No. 16, and 12 "Against" votes
were cast against Proposition No. 16, which read as follows:

Shall Article 8. Sections 8.02 and 8.03 of the Coppell City Charter be amended to require
that committees appointed by the City Council comply with the same rules and requirements
applicable to boards and commissions.
It appearing that a majority of the votes cast were tbr the adoption of the charter
amendment set out in Proposition No. 16, and the same is hereby adopted.

That 282 "For" votes were cast in favor of Proposition No. 17, and 38 "Against" votes
were cast against Proposition No. 17, which read as follows:
PROPOSITION NO. 17
Shall Section 9.02 of the Coppell City Chm'ter be amended to delete obsolete Charter
language and to amend the duties and powers of the Planning and Zoning Commission to provide
for the review and recommendation of amendments of the master plan to the City Council and
to authorize appropriate action on plats and subdivisions proposals.
It appearing that a majority of the w)tes cast were fur the adoption of the charter
amendment set out in Proposition No. 17, and the same is hereby adopted.
That 262 "For" votes were cast in favor of Proposition No. 18, and 57 "Against" votes
were cast against Proposition No. 18, which read as follows:
PROPOSITION NO. 18
Shall Section I 1.06 of the Coppell City Charter be amended to clarity the conflict of
interest rules applicable tn City consultants and to delete conflict of interest rules for employees
which are governed by the City employee personnel rules.
It appearing that a majority of the votes cast were far the adoption of the charter
amendment set oat in Proposition No. 18. and the same is hereby adopted.

IT IS FURTHER ORDERED that this canvass and declaration of results of said election
be entered in the Minutes of the City Council and that the City Secretary shall record in the
Office of the City Secretary the amendments adopted by the voters of the City and the Mayor
shall certify to the Secretary of State of Texas, an authenticated copy of the amendments, under
the seal of the City, showing the approval by the qualified voters of the City of Coppell, Texas.
This Ordinance. declaring the results of the election held on November 7, 1995, shall
become effective immediately after its passage.
DULY ADOPTED by the City Council of the City of Coppell, Texas, this the 1 lth day
of November, 1995.
